📚 Year 11 WJEC Law: Case Analysis Practice | Year 11 WJEC
Case analysis is the heart of legal study. For WJEC GCSE Law, you must learn to dissect a set of facts, pinpoint the legal issues, apply the correct rules, and argue a conclusion just as a lawyer would. This guide walks you through practical exercises covering criminal law, tort, contract, and human rights, all designed to build your confidence for the exam.
1. Why Case Analysis Matters |
In the WJEC Law examination, you will often be presented with a scenario and asked to advise the parties on their legal rights or liabilities. This requires more than just memorising statutes and case names; you need to apply the law to new situations. Case analysis develops your ability to think critically, structure an answer, and use legal authority persuasively.
2. The IRAC Method: A Simple Framework | IRAC
To keep your analysis clear, use the IRAC structure: Issue (identify the legal question), Rule (state the relevant law, with case or statute), Application (explain how the law applies to the facts), and Conclusion (give a reasoned outcome). This method prevents you from jumping to conclusions without proper legal reasoning.
为了让你的分析清晰明了,可以使用 IRAC 结构:Issue(识别法律问题)、Rule(陈述相关法律及判例或法条)、Application(解释法律如何适用于事实)和 Conclusion(得出有理由的结果)。
- Issue: "Can D be liable for battery?"
- Rule: "Battery is the intentional or reckless application of unlawful force (Collins v Wilcock)."
- Application: "When D pushed V, he applied force directly and intentionally."
- Conclusion: "Therefore, D is likely to be found guilty of battery."
3. Understanding Judicial Precedent |
Case analysis requires a solid grasp of stare decisis – the doctrine of precedent. When a court decides a point of law, lower courts must follow that decision if the facts are materially similar. Always link your analysis to binding or persuasive precedents from cases like Donoghue v Stevenson or R v Cunningham.
For example, the 'neighbour principle' from Donoghue v Stevenson [1932] AC 562 is the foundation of the modern duty of care in negligence. You must be able to explain how the ratio decidendi of such a case applies to new facts.
4. Statutory Interpretation in Practice |
Many scenarios turn on the meaning of a word in a statute. Courts use rules of interpretation: the literal rule, the golden rule, the mischief rule, and the purposive approach. In your case analysis, show awareness of these tools by discussing how a word like 'vehicle' or 'offer' might be interpreted differently.
| Rule | Example in Practice |
|---|---|
| Literal Rule | Fisher v Bell [1961] – a flick knife displayed in a shop window was not an 'offer for sale' but an invitation to treat. |
| Mischief Rule | Smith v Hughes [1960] – the court looked at the mischief Parliament intended to remedy, not just the literal words. |
5. Case Exercise 1: Criminal Law – Battery and ABH |
Facts: During a crowded music festival, Amy deliberately shoved Beth, causing Beth to stumble into a metal barrier and sustain a deep cut on her forehead requiring stitches. Amy claims she only meant to push past Beth, not to injure her.
Issue: Can Amy be liable for battery and/or assault occasioning actual bodily harm (ABH) under section 47 of the Offences Against the Person Act 1861?
Rule: Battery is the intentional or reckless application of unlawful force to another person (R v Ireland; Collins v Wilcock). ABH requires proof of an assault or battery which causes 'actual bodily harm' – any hurt or injury calculated to interfere with the health or comfort of the victim (R v Miller). The mens rea for ABH is the same as for the underlying assault or battery: intention or subjective recklessness as to the infliction of unlawful force (R v Savage; DPP v Parmenter).
Application: Amy deliberately shoved Beth. This direct application of force satisfies the actus reus of battery. The push caused Beth to fall and receive a deep cut – clearly 'actual bodily harm'. Although Amy claims she did not intend to cause injury, the mens rea for battery only requires intention to apply unlawful force, not intention to cause the specific harm. As she intended to push, the mens rea is made out. The requirements for ABH are therefore satisfied.
Conclusion: It is highly likely that Amy would be found guilty of ABH under section 47.
6. Case Exercise 2: Tort Law – Negligence and Duty of Care |
Facts: A supermarket employee mopped the floor in the fruit aisle but forgot to put out a warning sign. Five minutes later, a customer, Raj, slipped on the still-wet floor and fractured his wrist. Raj had been looking at his shopping list and did not notice the shiny floor.
Issue: Does the supermarket owe Raj a duty of care in negligence, and has that duty been breached, causing his injury?
Rule: To establish negligence, the claimant must prove: (1) duty of care, (2) breach of that duty, and (3) causation of damage. The modern test for duty of care comes from Caparo Industries plc v Dickman [1990]: (a) was harm reasonably foreseeable? (b) was there proximity between the parties? (c) is it fair, just and reasonable to impose a duty? For breach, the standard is that of the reasonable person (Blyth v Birmingham Waterworks Co). In cases of occupiers' liability, the Occupiers' Liability Act 1957 also applies, but negligence principles remain central.
Application: It is reasonably foreseeable that a customer might slip on a wet floor if no warning is given. There is proximity: Raj was a lawful visitor in the supermarket, and the supermarket had control over the premises. It is fair, just and reasonable to impose a duty on the occupier to keep the premises reasonably safe. The employee's failure to place a warning sign fell below the standard of a reasonable occupier, especially as mopping creates a known hazard. The breach directly caused Raj's fall and fracture. While Raj's inattention might be raised as contributory negligence, it is unlikely to fully break the chain of causation.
Conclusion: The supermarket is likely liable in negligence for Raj's injuries, though damages might be reduced if the court finds contributory negligence.
7. Case Exercise 3: Contract Law – Offer, Acceptance and Consideration |
Facts: On Monday, Priya texted her friend Lee: 'Selling my laptop for £200 if you want it.' Lee replied on Tuesday: 'I'll give you £180 for it.' Priya did not respond. On Wednesday, Lee sent another message: 'OK, I accept your original price of £200.' Priya had already sold the laptop to someone else.
Issue: Is there a binding contract between Priya and Lee?
Rule: A valid contract requires an offer, an acceptance that mirrors the offer, and consideration. An offer must be distinguished from an invitation to treat. A counter-offer destroys the original offer (Hyde v Wrench (1840)). Once an offer is rejected by a counter-offer, it cannot later be accepted unless the offeror renews it. Acceptance must be communicated effectively.
Application: Priya's text 'Selling my laptop for £200 if you want it' appears to be an offer, not an invitation to treat, because it was made to a specific person with clear terms. Lee's reply of 'I'll give you £180' is a counter-offer, which terminates the original £200 offer. Priya did not accept the counter-offer. When Lee later 'accepts' the £200, there is no offer left to accept – it was already extinguished by the counter-offer. Thus, no contract was formed.
Conclusion: No binding contract was created. Priya was free to sell the laptop to a third party.
8. Case Exercise 4: Human Rights – Balancing Qualified Rights |
Facts: A school uniform policy prohibits all headwear, including religious headscarves. Mariam, a Muslim student, wishes to wear a hijab that matches the school colours. The school refuses, stating that the policy is necessary to promote a secular learning environment and avoid distinctions between pupils. Mariam argues this breaches her right to manifest her religion under Article 9 of the European Convention on Human Rights (ECHR).
Issue: Does the school's ban on religious headwear unlawfully interfere with Mariam's Article 9 right?
Rule: Article 9 protects the right to manifest one's religion or belief. However, this is a qualified right; interference may be justified under Article 9(2) if it is (a) prescribed by law, (b) pursues a legitimate aim, and (c) is necessary in a democratic society. Legitimate aims include the protection of the rights and freedoms of others. The proportionality test is crucial: any restriction must be no more than is necessary. The UK courts and Human Rights Act 1998 require a balancing exercise.
Application: The school's policy is prescribed in its written uniform rules and pursues the legitimate aim of maintaining a cohesive and non-discriminatory environment. The key question is whether the blanket ban is proportionate. Mariam's hijab in school colours would not cause disruption or safety concerns. A blanket ban that allows no accommodation for religious symbols may be seen as disproportionate, especially if other forms of religious accommodation (e.g., dietary requirements) are allowed. A less restrictive alternative – permitting plain, school-coloured headscarves – could achieve the school's aims without interfering with religious rights. Thus, the ban might fail the proportionality test.
Conclusion: A court would likely find the absolute ban disproportionate and a violation of Article 9, unless the school can provide very strong evidence that any religious headwear undermines its educational mission.
9. Using the 'Ratio Decidendi' Skillfully |
In every case, the binding part is the ratio decidendi – the legal principle on which the decision is based. When you analyse a scenario, don't just drop the case name; extract the ratio and explain why it applies. For example, the ratio of R v Cunningham [1957] is that 'maliciously' means intention or subjective recklessness. Use that to assess mens rea.
Distinguish the obiter dicta – remarks made in passing that are not binding but can be persuasive. In R v Howe [1987], the obiter comments on duress as a defence to attempted murder later influenced other cases. Showing you understand this distinction will impress examiners.
10. Analysing a Complex Scenario: Mixed Legal Areas |
Facts: Ed and Fran are neighbours. Ed's dog, known to be aggressive, escapes through a broken gate and bites Fran in her garden. Fran shouts 'I'll sue you!' and Ed screams back, 'I'll burn your shed down!' That night, Fran is so anxious she cannot sleep and develops a recognised psychiatric condition.
Analysis approach: Break this into separate legal claims: (1) the dog bite – likely liability under the Animals Act 1971 as well as possible negligence; (2) the shouted threat – consider whether it constitutes an assault (intentionally causing apprehension of immediate unlawful force) under criminal law and potentially also the tort of trespass to the person; (3) the psychiatric harm – this could be a claim in negligence for pure psychiatric injury, applying the test from Alcock v Chief Constable of South Yorkshire Police [1992]. Link each claim to a clear IRAC chain.
