1. Introduction to the WJEC GCSE Law Course | WJEC GCSE
The WJEC GCSE Law specification is divided into three core units, each assessed through a written examination. Unit 1 focuses on the English Legal System, covering the structure of courts, legal personnel, and sources of law. Unit 2 examines Criminal Law, exploring the elements of crimes, offences against the person, property offences, and key defences. Unit 3 is dedicated to Civil Law, including the law of tort and contract law. Each paper lasts between 1 hour 15 minutes and 1 hour 30 minutes, featuring a mix of short-answer questions, scenario-based problem questions, and extended evaluation essays. The course places a strong emphasis on applying legal rules to fictional cases, so you must be comfortable using the law as a tool to solve disputes. Understanding the assessment objectives is crucial: AO1 tests knowledge, AO2 tests application, and AO3 tests evaluation and analysis.
2. The English Legal System: Courts and ADR |
The court hierarchy in England and Wales is a fundamental topic in Unit 1. The Supreme Court sits at the apex, hearing final appeals on points of law of general public importance. Below it, the Court of Appeal is divided into the Civil Division and the Criminal Division. The High Court has three divisions: King's Bench, Chancery, and Family. Most criminal cases begin in the Magistrates' Court, while more serious indictable offences are tried in the Crown Court before a judge and jury. You must memorise which court hears which type of case and understand the routes of appeal. Alongside formal courts, alternative dispute resolution (ADR) methods such as negotiation, mediation, conciliation, and arbitration offer parties cheaper and faster ways to resolve disagreements without going to trial. Tribunals also form part of the system, dealing with specialised areas like employment and immigration disputes. The syllabus requires you to evaluate the advantages and disadvantages of each method, weighing factors such as cost, speed, formality, and the binding nature of decisions.
3. Sources of Law: Parliament and Precedent |
Laws in England and Wales come primarily from two sources: Parliament and the courts. Parliamentary law-making produces Acts of Parliament, also known as statutes, which are the highest form of domestic law due to the doctrine of parliamentary sovereignty. You need to understand the legislative process, from a Green Paper and White Paper through the various readings and stages in both the House of Commons and the House of Lords, ending with Royal Assent. Delegated legislation, made by government ministers under powers given by a parent Act, is another key topic. Types include statutory instruments, by-laws, and Orders in Council. Judicial precedent, the second major source, operates through the doctrine of stare decisis, meaning 'to stand by decisions'. Courts are bound by the decisions of higher courts in cases with similar material facts. The ratio decidendi of a case is the binding legal principle, while obiter dicta are persuasive comments made by the way. A key skill is being able to explain how the Supreme Court departed from its own precedent using the Practice Statement 1966, and how the Court of Appeal is generally bound by its own decisions subject to the exceptions in Young v Bristol Aeroplane Co Ltd (1944).
4. Legal Personnel: Solicitors, Barristers, and Judges |
The legal profession is traditionally split into solicitors and barristers, although reforms have blurred the lines between them. Solicitors are the first point of contact for most clients, providing legal advice and handling day-to-day legal matters. They may also have rights of audience in the lower courts. Barristers are specialist advocates who present cases in court and provide expert opinions on complex legal issues. They are typically instructed by solicitors on behalf of clients. To become either, you must complete an academic stage (a law degree or conversion course) followed by the vocational stage (the Solicitors Qualifying Examination or the Bar Course) and a period of work-based training. Judges are drawn from experienced lawyers. You are expected to know the selection process, the role of the Judicial Appointments Commission, and the qualifications required for different judicial offices. The syllabus encourages you to evaluate issues such as the diversity of the judiciary, the cost of accessing barristers, and whether the split profession serves the public interest effectively.
5. Criminal Law: Actus Reus and Mens Rea |
Every criminal offence requires proof of two fundamental elements: the actus reus (the guilty act) and the mens rea (the guilty mind). The actus reus can be a positive act, an omission where a legal duty to act exists, or a state of affairs. The key legal duties that turn an omission into an actus reus include duties arising from a contract, a relationship, an official position, or the voluntary assumption of care, as established in cases like R v Pittwood (1902) and R v Gibbins and Proctor (1918). Factual causation uses the 'but for' test, asking whether the harm would have occurred but for the defendant's actions. Legal causation requires the defendant's conduct to be the substantial and operating cause of the harm, and the chain of causation can be broken by an intervening act such as medical negligence or an unforeseeable natural event. Mens rea refers to the mental element of the crime. The highest form is intention (direct or oblique), where oblique intention applies when a consequence is a virtually certain result of the defendant's actions and the defendant appreciates this, as held in R v Woollin (1999). Recklessness involves the defendant foreseeing a risk and going on to take it unreasonably. Negligence, used in a few offences, involves a failure to meet the standard of a reasonable person.
6. Non-Fatal Offences Against the Person |
Non-fatal offences against the person are examined in detail in Unit 2. The hierarchy of these offences, from least to most serious, is assault, battery, assault occasioning actual bodily harm (ABH), malicious wounding or inflicting grievous bodily harm (GBH) under section 20 of the Offences Against the Person Act 1861, and wounding or causing GBH with intent under section 18. Assault is causing the victim to apprehend immediate unlawful force; no physical contact is required. Battery is the actual application of unlawful force. ABH under section 47 requires proof of assault or battery that causes actual bodily harm, defined in R v Miller (1954) as any hurt or injury calculated to interfere with the health or comfort of the victim. Section 20 requires a wound or GBH inflicted maliciously, meaning the defendant intended the act or was reckless as to whether some harm would be caused. Section 18 is the most serious, requiring a wound or GBH caused with intent to do grievous bodily harm or to resist or prevent arrest. You must be able to match the correct mens rea to each offence and apply the legal rules to scenarios where victims suffer a range of injuries, from a push to a stabbing. The meaning of grievous bodily harm was clarified in DPP v Smith (1961) as really serious harm, and a wound requires a break in both layers of the skin, as confirmed in JJC v Eisenhower (1984).
7. Property Offences: Theft and Robbery |
Theft is defined under section 1 of the Theft Act 1968 as the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. You must break this definition into its five elements, each fleshed out by statute and case law. Appropriation includes assuming any of the rights of the owner, and can occur even with the owner's consent, as decided in R v Gomez (1993). Property includes money, personal items, intangible property, and even things like electricity. Belonging to another is a broad concept that includes situations where property has been abandoned or where the owner has been deprived of it. The Ghosh test for dishonesty, long established by R v Ghosh (1982), was replaced by the Supreme Court in Ivey v Genting Casinos (2017). The new test asks: what was the defendant's actual state of knowledge or belief as to the facts? And was their conduct dishonest by the standards of ordinary decent people? Intention to permanently deprive includes treating the property as one's own to dispose of it, such as selling it or using it in a way that it loses its value. Robbery is theft aggravated by the use or threat of force immediately before or at the time of the theft. The force must be used in order to steal, as clarified in R v Dawson and James (1976).
8. Defences in Criminal Law |
A defendant who successfully raises a complete defence is acquitted. The syllabus covers several key defences, starting with insanity, which is a legal rather than medical concept. The M'Naghten Rules (1843) require the defendant to prove, on the balance of probabilities, that at the time of the act they were suffering from a defect of reason caused by a disease of the mind, and as a result they did not know the nature and quality of the act, or did not know what they were doing was wrong. Automatism is the defence of acting involuntarily due to an external cause, such as being hit on the head, taking a drug without knowing it, or suffering from a reflex action. Intoxication divides into voluntary and involuntary. The crucial principle from DPP v Majewski (1977) is that voluntary intoxication is no defence to a crime of basic intent, such as section 20 GBH or assault, but may be a defence to a crime of specific intent, such as murder or section 18 GBH. Self-defence, governed by both common law and section 76 of the Criminal Justice and Immigration Act 2008, allows a person to use reasonable force to protect themselves or another, or to prevent crime. The force used must be necessary and proportionate to the threat as the defendant honestly perceived it, even if their perception was mistaken due to circumstances not caused by voluntary intoxication.
9. Civil Law: Tort and the Law of Negligence |
Unit 3 introduces civil law, where the claimant sues the defendant seeking a remedy, usually damages. The tort of negligence is the centrepiece of this unit. To succeed in a negligence claim, the claimant must prove three things: the defendant owed them a duty of care, the defendant breached that duty, and the breach caused damage that was not too remote. The modern test for duty of care comes from Caparo Industries plc v Dickman (1990). It asks: was the damage foreseeable? Was there a relationship of sufficient proximity between the claimant and defendant? And is it fair, just, and reasonable to impose a duty? Breach of duty is judged against the standard of the reasonable person. Factors such as the likelihood of harm, the potential seriousness of the harm, the social value of the defendant's conduct, and the cost of taking precautions are all factored in. Professional defendants are held to the standard of the ordinary competent professional, as set out in Bolam v Friern Hospital Management Committee (1957). Causation requires both factual causation using the 'but for' test and legal causation, where the damage must not be too remote. The case of The Wagon Mound (No 1) (1961) established that damage is too remote if it was not reasonably foreseeable in type, even if its extent was unforeseeable.
The Wagon Mound (No 1)
10. The Law of Contract: Formation of a Binding Contract |
The law of contract is the second major civil topic. A binding contract requires an offer, acceptance, consideration, and an intention to create legal relations. An offer is a definite promise to be bound on specific terms, distinguished from an invitation to treat, which is merely an invitation to negotiate or make an offer. Goods on display in a shop are generally invitations to treat, as in Pharmaceutical Society of Great Britain v Boots Cash Chemists (1953), while an advertisement can be an offer if it is a unilateral offer, like in Carlill v Carbolic Smoke Ball Co (1893). Acceptance must be communicated to the offeror and must exactly mirror the terms of the offer. The postal rule provides an exception: acceptance by post takes effect when the letter is posted, not when it is received, as confirmed in Adams v Lindsell (1818). Consideration is the price for the promise and must move from the promisee, though it need not be adequate. Past consideration is not valid consideration, a principle illustrated in Re McArdle (1951). Intention to create legal relations is presumed in commercial agreements but must be proved in social and domestic arrangements. In Balfour v Balfour (1919), it was held that an agreement between a husband and wife was not intended to create legal relations. Understanding these building blocks is essential, as you will be asked to identify the moment a contract was formed in scenario-based questions.
Pharmaceutical Society of Great Britain v Boots Cash Chemists
11. Exam Technique and Maximising Your Grade |
Scoring highly in WJEC GCSE Law requires more than knowing the law; you must demonstrate your knowledge and your ability to use it. For AO1 knowledge questions, aim for clear, accurate definitions and case names with correct outcomes. Avoid simply naming a case without explaining its principle. For AO2 application scenarios, adopt a structured approach: identify the legal issue, state the relevant legal rule with supporting authority, apply the rule to the precise facts given, and reach a tentative conclusion. Use the language of the scenario. For example, instead of saying 'the defendant may be liable', explain why based on the particular words or injuries described in the question. For AO3 evaluation questions, consider arguments for and against the current law. Discuss how accessible, fair, and coherent the law is. Suggest potential reforms and reference up-to-date reports or criticisms from bodies like the Law Commission. Compare criminal and civil outcomes where relevant. Always link your evaluation to the specific context provided in the question rather than offering generic comments. Excellent time management in the exam is essential. Practise with past papers under timed conditions so you build the stamina to write precise answers within the allotted minutes.
