1. The Criminal Liability Equation |
Most criminal offences require proof of both the physical element and the mental element. The fundamental formula for establishing criminal liability is:
Actus Reus + Mens Rea + (No Defence) = Criminal Liability
Actus reus can be a positive act, an omission where a duty exists, or a state of affairs. The prosecution must link every element of the actus reus to the defendant's voluntary conduct.
Mens rea varies with the offence: intention (direct or oblique), recklessness, or negligence. For strict liability offences, the mens rea requirement is removed for at least one element, creating an 'Actus Reus Only' exception.
2. The Causation Theorem |
Where a result crime is charged, the prosecution must prove causation between the defendant's conduct and the prohibited consequence. Causation has two limbs:
Causation = Factual Causation + Legal Causation
Factual causation is established by the 'but for' test (R v White): but for the defendant's conduct, would the result have occurred?
Legal causation requires the defendant's act to be a substantial and operating cause of the harm (R v Smith), and more than a minimal cause (R v Pagett).
An intervening act (novus actus interveniens) may break the chain of causation, but only if it is a free, voluntary and informed act of a third party, or an unforeseeable natural event.
3. The Caparo Test: Duty Formula for Negligence |
In the tort of negligence, a duty of care is the first element to prove. The Caparo v Dickman test sets out a three-part formula applicable to novel duty situations:
Duty of Care = Foreseeability of Damage + Proximity + Fair, Just and Reasonable
Foreseeability: Would a reasonable person have foreseen that the claimant might be injured by the defendant's conduct?
Proximity: Is there a close and direct relationship between the claimant and the defendant (in time, space, or relationship)?
Fair, just and reasonable: Even if the first two limbs are satisfied, would imposing a duty be unfair, unjust or unreasonable as a matter of public policy?
In established categories (e.g. driver to pedestrian, doctor to patient), duty is automatically recognised without the Caparo test.
4. Breach of Duty: The Reasonable Person Theorem |
Once a duty of care exists, the defendant must meet the standard of care expected of a reasonable person. Breach occurs when conduct falls below that standard. The formula for assessing breach considers four key factors:
ach = Risk Factors Analysis → (Likelihood × Magnitude) vs (Precaution Cost + Social Value)
| Factor | Explanation |
| Likelihood of harm | The more likely the harm, the more care required (Bolton v Stone). |
| Magnitude of harm | Greater potential seriousness demands higher precautions (Paris v Stepney BC). |
| Cost of precautions | If the cost of avoiding harm is low, failure to do so is likely a breach (Latimer v AEC). |
| Social usefulness | Actions serving a vital social purpose may justify higher risks (Watt v Hertfordshire CC). |
Professionals are judged by the standard of a reasonably competent member of their profession (Bolam test, modified by Bolitho). Learners are held to the standard of the reasonably competent experienced person (Nettleship v Weston).
5. Damage and Remoteness: The Wagon Mound Theorem |
Breach of duty must cause legally recognised damage that is not too remote. The test for remoteness in negligence was set out in The Wagon Mound (No 1):
Remoteness Rule: Damage is recoverable if the type of damage was reasonably foreseeable.
The exact extent of the damage or the precise manner in which it occurs need not be foreseen, only the type (Hughes v Lord Advocate). The 'thin skull rule' also applies: defendants must take their victims as they find them, meaning unforeseeable pre-existing vulnerabilities do not break the chain of causation for the extent of harm.
6. Murder and Voluntary Manslaughter: The Homicide Equation |
The offence of murder provides a classic illustration of how actus reus and mens rea combine. The definition is rooted in common law, later refined by statute:
Murder = Unlawful Killing of a Human Being + Under the Queen's Peace + Malice Aforethought
Actus reus: Unlawful killing of a human being under the Queen's peace. The victim must be a person capable of breathing independently (R v Malcherek).
Mens rea: Malice aforethought means intention to kill or intention to cause grievous bodily harm (R v Cunningham).
If the defendant satisfies the actus reus and mens rea of murder but successfully raises a partial defence (e.g. loss of control, diminished responsibility), the conviction is reduced to voluntary manslaughter. This can be expressed as:
Voluntary Manslaughter = Murder - (Partial Defence)
7. Theft Act Formula: The Equation of Dishonest Appropriation |
Theft is defined under s.1 of the Theft Act 1968. All five elements must coexist for a conviction. Memorising the full formula helps to structure problem-solving answers:
priation + Property + Belonging to Another + Dishonesty + Intention to Permanently Deprive
Appropriation (s.3): Any assumption of the rights of an owner, including keeping or dealing with property as owner.
Property (s.4): Money and all other property, real or personal, including things in action and other intangible property.
Belonging to another (s.5): Property is regarded as belonging to any person having possession or control of it, or a proprietary interest.
Dishonesty (s.2): The defendant is not dishonest if they hold an honest belief in a legal right, consent, or that the owner cannot be discovered. The Ivey test (Ivey v Genting Casinos) now applies: would the ordinary person consider the conduct dishonest, and did the defendant realise this?
Intention to permanently deprive (s.6): Borrowing is not theft unless it amounts to an outright taking or disposal.
8. Contract Formation: The 'Offer + Acceptance' Equation |
A legally binding contract requires four key ingredients. When a problem question asks whether a contract exists, apply this sequential formula:
inding Contract = Offer + Acceptance + Consideration + Intention to Create Legal Relations
Offer: A clear statement of willingness to contract on specified terms (Carlill v Carbolic Smoke Ball). An invitation to treat is not an offer.
Acceptance: Unconditional agreement to all terms of the offer. Acceptance must be communicated; the postal rule is an exception where acceptance by post takes effect on posting (Adams v Lindsell).
Consideration: Something of value exchanged between the parties. Must be sufficient but need not be adequate. Past consideration is not valid consideration.
Intention to create legal relations: Social and domestic agreements are presumed not to have such intention, while commercial agreements are presumed to have it. These presumptions can be rebutted by evidence.
9. Statutory Interpretation: The Construction Rule Theorem |
When judges interpret Acts of Parliament, they draw upon established 'rules' or 'approaches'. Each rule serves as a theorem for extracting meaning from statutory words:
Literal Rule → (if absurd) Golden Rule → (if ambiguity) Mischief Rule → Purposive Approach
Literal rule: Give words their ordinary, plain, dictionary meaning, even if the outcome seems harsh (Fisher v Bell).
Golden rule: If the literal rule produces an absurdity, the court can modify the meaning to avoid that absurdity (R v Allen).
Mischief rule: Examine what 'mischief' Parliament intended to remedy and interpret the Act to suppress that mischief (Smith v Hughes).
Purposive approach: Interpret the legislation so as to give effect to its underlying purpose, going beyond the exact words where necessary (Pepper v Hart).
Internal aids (the statute itself) and external aids (Hansard, dictionaries) assist in applying these theorems.
10. Judicial Precedent: The Ratio Decidendi Theorem |
The doctrine of stare decisis (to stand by decisions) ensures consistency in English law. The binding element of a precedent is its ratio decidendi, and its reach depends on the court hierarchy:
Binding Precedent = Ratio Decidendi × Court Hierarchy
Ratio decidendi: The legal principle or reason necessary for the decision, not merely an observation. Obiter dicta (remarks made 'by the way') are persuasive but not binding.
Court Hierarchy: Supreme Court binds all lower courts and is normally bound by its own decisions (Practice Statement 1966 allows departure). Court of Appeal binds itself subject to Young exceptions. High Court binds lower courts but not itself. Decisions of the Privy Council are persuasive only.
Judges avoid precedent through distinguishing (showing material differences in facts), overruling, or reversing. The ratio should be extracted carefully from the material facts and the decision.
11. Strict Liability: The No-Mens-Rea Theorem |
For certain regulatory or public welfare offences, the prosecution is not required to prove mens rea for at least one element of the actus reus. The governing equation is:
eus + (No Requirement of Mens Rea for One Element) + Availability of Due Diligence Defence
The presumption is that mens rea is required, but this can be displaced if the offence is regulatory in nature, involves social concern, or the wording of the Act clearly implies strict liability (Gammon Ltd v Attorney-General of Hong Kong; Sweet v Parsley).
Strict liability offences do not strip the defendant of all defences. The defendant can argue that they took all reasonable steps (due diligence) where the statute allows, or that the actus reus was not voluntary.
12. Defences: Capacity and Negating Formulae |
Defences operate either by negating an element of the offence or by excusing the defendant's conduct. They can be expressed as conditional theorems that, if satisfied, reduce or eliminate liability:
Insanity (M' es) = Defect of Reason + Not Knowing the Nature/Quality of Act OR Not Knowing It Was Wrong
Automatism = Total Loss of Voluntary Control + External Cause (for sane automatism)
Honest Belief in Need for Force + Reasonable Force in the Circumstances (s.76 Criminal Justice and Immigration Act 2008)
Intoxication: Involuntary intoxication may negate mens rea or provide a defence to specific and basic intent crimes. Voluntary intoxication is no defence to basic intent crimes but can negative mens rea for specific intent offences. Consent can operate as a defence to non-fatal offences, provided the harm is not beyond a level to which one can lawfully consent (R v Brown).
