1. Understanding Case Questions |
Cambridge law exam papers typically present you with a short factual story and ask you to 'advise the parties' or 'discuss the legal position'. You are not expected to retell the facts; instead, you must use the facts as triggers to identify legal issues, state the relevant rules and apply them to reach a reasoned conclusion. Reading the question twice and underlining key material facts is an essential first habit.
Understanding the question also means noticing what the examiner is not telling you. If a detail sounds odd or out of place, it is probably there to trigger a particular legal rule. For example, a mention of 'texting while driving' immediately signals a possible breach of duty in negligence. Train yourself to read with a lawyer's eye.
2. Identifying Legal Issues |
Before you can apply the law, you must pinpoint the precise legal questions hidden in the scenario. Ask yourself: what area of law does this belong to – criminal, tort or contract? Then narrow it down: theft or robbery? negligence or nuisance? offer or invitation to treat? Wording like 'dishonestly', 'carelessly', 'promised', or 'accepted' are clues that help you frame the issue.
Write the issue down as a short question, for example: 'Did Dave commit theft when he took the laptop?' This keeps your answer focused and shows the examiner you are thinking structurally. One scenario often contains two or three issues – make sure you address each one separately.
3. Stating Relevant Legal Rules |
For each issue you identify, set out the legal rule clearly and accurately. This is where you demonstrate knowledge of statutes and key cases. For theft, you would quote the definition from the Theft Act 1968: 'A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it.' For negligence, you might cite the neighbour principle from Donoghue v Stevenson [1932].
Do not simply name cases – explain the principle they established. Saying 'Caparo v Dickman is the test for duty of care' is good, but adding the three‑stage test (foreseeability, proximity, fair, just and reasonable) shows deeper understanding. Also be sure to mention any recent developments or relevant exceptions your syllabus requires.
4. Applying Law to Facts |
Application is where most marks are gained or lost. Take each element of the legal rule and knit it to a specific fact from the scenario. If the rule for theft requires 'appropriation', point out the exact act that amounts to taking, using or assuming the rights of the owner. If negligence requires a 'breach of duty', explain exactly how the defendant fell below the standard of a reasonable person in the circumstances described.
Avoid list‑like statements that are separate from the facts. Instead, blend them: 'When Dave placed the phone in his backpack without paying, he assumed the rights of the owner, which satisfies the appropriation element.' The examiner wants to see your ability to argue, not just to recite rules.
5. Reaching a Conclusion |
A well‑supported conclusion is the natural end of a strong analysis. State clearly whether you think the defendant is liable or the contract is enforceable, and briefly summarise why. If the outcome is borderline, acknowledge the ambiguity and explain which way a court is likely to lean. Never leave the examiner wondering what your final view is.
In Cambridge exams, a conclusion does not have to be dramatic or overly long. Two or three sentences that directly answer the question as posed are enough. For example: 'Therefore, it is likely that Jenny will succeed in her claim for negligence because the driver breached his duty of care and that breach directly caused her injury.'
6. Case 1: Criminal Law – Theft |
Scenario: Max is shopping in a supermarket. He puts a bottle of expensive perfume, which he intends to pay for, into his own bag rather than a basket so that he can keep his hands free. Before he reaches the checkout, he receives an urgent phone call and, distracted, walks out of the shop without paying. He only realises the perfume is still in his bag when he arrives home. Max immediately decides to keep it.
Issues identified: 1. Did Max commit theft? The actus reus elements of appropriation and property belonging to another appear present. The key question is whether Max had the mens rea for theft – dishonesty and intention to permanently deprive – at the time of appropriation.
Rule: Under the Theft Act 1968, appropriation occurs when a person assumes the rights of an owner. Putting perfume into one's own bag clearly amounts to an assumption of the owner's rights. The property belonged to the supermarket. Dishonesty is assessed by the standard of ordinary decent people (Ivey v Genting Casinos [2017]), and intent to permanently deprive means treating the thing as one's own to dispose of regardless of the owner's rights.
Application: At the point Max put the perfume in his bag, he intended to pay, so he was not then dishonest. However, on realising his mistake at home and deciding to keep it, he formed the necessary intention. The problem is that the act of appropriation (assuming rights) arguably continued. According to the case of R v Gobir [2021], appropriation can be a continuing act. Therefore, when Max made the decision to keep the perfume, he was still in the process of appropriating it, and at that moment he was dishonest and intended to permanently deprive the shop of the perfume.
Conclusion: Max is likely guilty of theft because the continuing appropriation coincided with the later formation of dishonesty and intention to permanently deprive. A court would look at the whole sequence of events and find the required coincidence of actus reus and mens rea.
7. Case 2: Tort Law – Negligence |
Scenario: Priya is driving in a school zone at 3:30 pm. She glances at her phone to read a text message and does not notice a child, Liam, running into the road. Priya brakes hard but still hits Liam, who suffers a broken leg. Liam's mother wants to sue Priya for negligence.
Issue: Has Priya been negligent towards Liam? The three elements must be established: duty of care, breach of that duty, and damage caused by the breach.
Rule: A driver owes a duty of care to all other road users, including pedestrians (Nettleship v Weston [1971]). The standard of care is that of an ordinary reasonable driver. Breach occurs when the conduct falls below that standard. The court considers factors such as the probability of harm, seriousness of potential harm, burden of taking precautions, and any social value of the defendant's activity (Bolton v Stone [1951]). Causation requires the breach to be both a factual and legal cause of the damage (Barnett v Chelsea & Kensington Hospital).
Application: Priya owed Liam a duty of care as a road user. In a school zone at a time when children are often about, the probability of harm was high. The seriousness of hitting a child with a car is obviously great. The burden of precaution was minimal – just ignore the phone. Using a phone while driving is a clear breach of the reasonable driver standard. Factually, but for Priya glancing at her phone, she would have seen Liam and stopped. Legally, the injury is the type of harm the duty was meant to prevent, and no new intervening act broke the chain of causation.
Conclusion: Priya is very likely to be found negligent. All three elements – duty, breach and causation – are straightforwardly satisfied, and there are no strong defences available.
8. Case 3: Contract Law – Postal Rule |
Scenario: On Monday, Tom sends an offer by letter to Jane to sell his car for £5,000. Jane receives the offer on Tuesday and immediately posts a letter of acceptance that same afternoon. On Wednesday, Tom changes his mind and telephones Jane to revoke his offer before Jane's acceptance letter arrives. The acceptance letter does not reach Tom until Thursday. Tom argues no contract exists.
Issue: Is there a binding contract between Tom and Jane? This turns on whether acceptance was effective before the revocation.
Rule: The general rule is that an acceptance must be communicated to the offeror (Entores v Miles Far East Corp [1955]). However, the postal rule creates an exception: where acceptance by post is a reasonable mode of communication, acceptance takes effect at the moment the letter is properly posted, not when it is received (Adams v Lindsell [1818]). Revocation of an offer must be communicated before acceptance; once acceptance is effective, a contract is formed and an offer can no longer be revoked.
Application: Tom's offer was made by post, so it was reasonable for Jane to accept by the same method. Jane posted her acceptance letter on Tuesday, before Tom's telephone revocation on Wednesday. Under the postal rule, acceptance became effective on Tuesday when Jane posted the letter, even though Tom did not receive it until later. Therefore, a contract came into existence on Tuesday. Tom's attempted revocation on Wednesday was too late.
Conclusion: A binding contract exists between Tom and Jane. Jane can enforce the agreement to purchase the car for £5,000. The postal rule operates to place the risk of a lost or delayed acceptance on the offeror, since Tom chose to begin negotiations by post.
9. Common Mistakes and High‑Scoring Tips |
One of the most frequent exam errors is mixing up criminal and civil terminology. Remember: in criminal law you are looking for 'guilt', while in civil law the question is about 'liability'. Saying 'the defendant is guilty of negligence' immediately signals confusion. Another big mistake is failing to name cases or statutes where the syllabus expects them. Even if you describe the rule perfectly, an examiner is looking for explicit references to show you have learned the material.
On the other hand, high‑scoring students always structure their answers with the IRAC framework (Issue, Rule, Application, Conclusion). They also show balanced thinking by acknowledging counter‑arguments where appropriate – for example, discussing possible defences even when the main conclusion points to liability. Use a highlighter in reading time to map the facts directly onto the legal elements you plan to discuss.
Time management is essential. Allocate roughly one minute per mark and leave a few minutes for checking. If a question is worth 10 marks and you have three issues, spend about three minutes on each, making sure every element of the rule receives its own application sentence.
10. Putting It All Together |
Case‑study questions are your opportunity to show you can think like a lawyer. The method is logical and repeatable: read with care, spot the issues, state the rule with authority, apply methodically element by element, and summarise your verdict. The more you practise this drill on past paper scenarios, the more automatic it becomes in the exam hall.
Remember that Cambridge examiners reward clarity and precision, not fancy language. Stick to plain English and plain Chinese, use short paragraphs, and always keep your eyes on the facts you have been given. If you have followed the drills in this article, you are already on your way to a top‑band score.
