📚 Year 11 AQA Law: Quick Reference Handbook of Formulas and Theorems | Year 11 AQA
In AQA GCSE Law, you are not asked to memorise mathematical equations, but rather a series of legal 'formulas' that help you deconstruct criminal and civil liability. Each legal rule can be expressed as a combination of essential elements (actus reus, mens rea, duty, breach, causation, and defences). This quick reference handbook transforms key legal principles into structured formulas and theorems, giving you a powerful toolkit for exam success. Keep these formulas at your fingertips as you revise for Paper 1 and Paper 2, and remember that each component must be fully defined and supported by case law.
1. The Murder Formula |
Murder is the most serious homicide offence. The basic formula is: Murder = Unlawful Killing + Intent to Kill or Cause GBH – Valid Defence. The actus reus requires the unlawful killing of a reasonable creature in being under the King's Peace. The victim must be a human being who was alive and breathing independently (AG's Reference No. 3 of 1994). The mens rea is an intention to kill or cause grievous bodily harm (GBH). Direct intent (aim or purpose) and oblique intent (virtual certainty as in R v Woollin) both satisfy this element. Partial defences such as diminished responsibility or loss of control may reduce murder to voluntary manslaughter.
(AG's Reference No. 3 of 1994)。
Actus Reus (unlawful killing of a human) + Mens Rea (intention to kill or cause GBH) – Diminished Responsibility/Loss of Control = Voluntary Manslaughter
2. The Theft Formula |
The Theft Act 1968, s.1 defines theft. The formula can be written as: priation + Property + Belonging to Another + Dishonesty + Intention to Permanently Deprive. Appropriation means any assumption of the rights of an owner (R v Morris). Property includes money, personal items, and intangible property. The property must belong to another; you cannot steal your own property unless another has a proprietary interest (R v Turner No.2). Dishonesty is judged by the common standard of ordinary decent people (Ivey v Genting Casinos), and the defendant must intend never to return the property (permanent deprivation). If any element is missing, no theft.
roperty + Belonging to Another) + s.2(1) Dishonesty + s.6 Intention to Permanently Deprive
3. The Assault and Battery Formulas |
Assault and battery are separate common law offences. The formula for assault is: Assault = Act Causing Apprehension of Immediate Unlawful Force + Intention or Recklessness. No physical contact is required; words or silent phone calls can suffice (R v Ireland). Battery requires unlawful physical contact: Battery = Application of Unlawful Force + Intention or Recklessness. The force need not be hostile; any unwanted touching may qualify (Collins v Wilcock). For both, recklessness means the defendant foresaw the risk of the prohibited result and took it (R v Cunningham subjective test). Assault occasioning actual bodily harm (ABH) under s.47 OAPA 1861 uses the formula: Assault + Battery + Occasioning + ABH.
s.47 ABH = Common Assault + Battery + 'Occasioning' + Actual Bodily Harm (Miller)
4. The Negligence Formula |
The tort of negligence is built on a neat formula: Negligence = Duty of Care + Breach of Duty + Damage + Causation. First, establish a duty of care using the Caparo three-part test: foreseeable harm, proximity, and whether it is fair, just and reasonable to impose a duty (Caparo Industries v Dickman). Next, breach of duty is measured by the objective standard of the reasonable person (Blyth v Birmingham Waterworks); special standards apply for professionals (Bolam test) and children (Mullin v Richards). The claimant must then prove that the breach caused the damage, both in fact ('but for' test, Barnett v Chelsea & Kensington Hospital) and in law (damage not too remote, The Wagon Mound). Finally, the type of damage must be recognised (personal injury, property damage, psychiatric harm in some cases).
Negligence Liability = (Duty: Caparo) + (Breach: Reasonable Person) + (Factual Causation: 'But for') + (Legal Causation: Not Too Remote) + Recognised Damage
5. The Occupiers' Liability Formula |
Under the Occupiers' Liability Act 1957, lawful visitors are owed a common duty of care. The formula is: Occupier's Liability = Occupier + Premises + Visitor + Common Duty Breach + Damage. An occupier is anyone with sufficient control over the premises (Wheat v E Lacon). The common duty of care requires the occupier to take reasonable steps to see that the visitor is reasonably safe (OLA 1957, s.2(2)). Special care is owed to children (Glasgow Corp v Taylor) and persons exercising their trade (roles v Nathan). Warning signs may discharge the duty if adequate. Under the OLA 1984, reduced protection applies to trespassers, with a triple test: awareness of danger, knowledge of likely presence, and a failure to take reasonable steps.
itor Safety; OLA 1984: Duty = (Awareness of Danger + Likely Presence + No Reasonable Care)
6. The Contract Formation Formula |
A contract is formed when the core elements align: Contract = Offer + Acceptance + Consideration + Intention to Create Legal Relations. An offer is a definite promise to be bound on specific terms, distinguished from an invitation to treat (Fisher v Bell). Acceptance must mirror the offer exactly, be communicated (except for postal rule, Adams v Lindsell), and be made while the offer is still alive. Consideration is the 'price of the promise'; it must be sufficient but need not be adequate (Thomas v Thomas), and past consideration is not valid (Re McArdle). The parties must intend legal consequences; for social and domestic arrangements there is a presumption against legal intent (Balfour v Balfour), while commercial agreements carry a strong presumption for intent (Esso Petroleum v Commissioners of Customs and Excise).
(Esso Petroleum v Commissioners of Customs and Excise)。
s) + Acceptance (unconditional mirror) + Consideration (sufficient, not past) + Intention (rebuttable presumptions)
7. The Criminal Defences: Self-Defence and Insanity Formulas |
Even if the actus reus and mens rea are present, a defendant may escape liability through a valid defence. Self-defence (including defence of property) uses a two-part formula: Self-Defence = Honest Belief of Need + Reasonable Force. The force must be necessary (subjective test, R v Gladstone Williams) and proportionate (objective test, Palmer v The Queen). Excessive force can defeat the defence. Insanity is governed by the M'Naghten Rules: ct of Reason + Caused by Disease of the Mind + Did Not Know Nature/Quality or Wrongfulness. If successful, the verdict is 'not guilty by reason of insanity'. Automatism is a related defence where external factors cause involuntary action (Hill v Baxter).
Full Defence = (Subjective Belief + Objective Proportionality) OR (M'Naghten Defect + Disease + Cognition Failure)
8. The Non-Fatal Offences Formula Map |
Section 47, 20, and 18 offences under the Offences Against the Person Act 1861 build upward from common assault. Use the table to memorise:
| Offence | Formula | Mens Rea |
|---|---|---|
| s.47 ABH | Assault + Occasioning + ABH | Intention or recklessness as to common assault (Savage) |
| s.20 GBH | Wounding or Inflicting GBH | Intention or recklessness as to some harm (Mowatt) |
| s.18 GBH with Intent | Wounding or Causing GBH + Ulterior Intent | Specific intent to seriously harm (or resist arrest) |
For s.47 the formula is simpler: assault or battery causing ABH, with the mens rea of the underlying common assault. For s.20, inflict grievous bodily harm or wound; recklessness as to some harm suffices. s.18 requires proof of a specific intention to cause serious harm. GBH means 'really serious harm' (DPP v Smith). A wound requires a break in the continuity of the whole skin (Moriarty v Brookes).
s.20 = Malicious Wounding/GBH + MR as to some harm; s.18 = Wounding/GBH + Specific Intent
9. The Sentencing and Remedies Theorems |
In criminal law, sentencing factors follow a logical theorem: Sentence = Harm Culpability × Aggravating Factors – Mitigating Factors. Aggravating factors include previous convictions, use of a weapon, vulnerability of the victim. Mitigating factors include age, remorse, early guilty plea. In civil law, remedies are primarily damages, calculated as: Damages = Loss (Pecuniary + Non-Pecuniary) – Contributory Negligence %. Special damages cover quantifiable financial losses up to trial; general damages cover future losses and non-financial harm (pain and suffering). Injunctions are discretionary equitable remedies granted where damages are inadequate. The theorem for contributory negligence reduces damages by the percentage the claimant is at fault (Law Reform (Contributory Negligence) Act 1945, Sayers v Harlow UDC).
Final Sentence ∝ (Culpability × Harm) + Aggravators – Mitigators; Final Damages = Full Loss – (Loss × Claimant's Fault %)
10. The Statutory Interpretation Rules |
Judges apply 'formulas' when interpreting statutes. The Literal Rule: Literal Meaning = Ordinary Dictionary Meaning + Parliament's Intention Irrelevant (Whitely v Chappell). The Golden Rule: Golden Meaning = Literal Meaning (unless absurd) → Modified Meaning (R v Allen, Re Sigsworth). The Mischief Rule: Mischief Meaning = Gap in Law + Parliament's Intended Remedy (Smith v Hughes). Purposive approach goes further, asking what Parliament intended to achieve (Pepper v Hart). These interpretative theorems allow the courts to resolve ambiguity, though they often lead to contradictory results depending on the approach adopted.
void Absurdity) → (Mischief: Identify Defect + Remedy) → (Purposive: Parliamentary Intent)
11. The Doctrine of Precedent Stare Decisis |
The hierarchical theorem of case law can be expressed as: g as: Binding Precedent = (Higher Court Decision × Material Facts Identical) → Lower Court Must Follow. For a precedent to bind, the ratio decidendi (the legal reasoning) must be identified and the material facts must be sufficiently similar. Obiter dicta are persuasive but not binding. The Supreme Court (formerly House of Lords) binds all lower courts, though it can depart from its own previous decisions under the 1966 Practice Statement. The Court of Appeal is bound by its own decisions subject to exceptions in Young v Bristol Aeroplane Co Ltd. The High Court binds inferior courts but not itself. This hierarchical formula ensures consistency and predictability in the common law.
Stare Decisis: Ratio Decidendi (Material Facts) × Court Hierarchy = Binding Precedent
12. The Rylands v Fletcher Strict Liability Formula | Rylands v Fletcher
The tort of private nuisance is fault-based, but Rylands v Fletcher (1868) introduces a strict liability formula: ity = Bringing onto Land + Thing Likely to Do Mischief + Escape + Non-Natural Use + Damage. The defendant must accumulate on his land a thing that, if it escapes, is likely to cause damage. There must be an actual escape (Read v J Lyons & Co Ltd). The use of the land must be non-natural, judged at the time (Rickards v Lothian). Defences to Rylands include act of a stranger, default of the claimant, statutory authority, and act of God. If all elements are proved without a defence, the defendant is liable even without proof of fault.
ation + Dangerous Thing + Escape + Non-Natural Use) → Strict Liability, Defences Permitted
