1. Sources of Scots Law |
The Scottish legal system is mixed, drawing on both civil law traditions and common law. Its primary sources include legislation, judicial precedent, institutional writings and European law. Understanding where law comes from is fundamental to all other topics.
Legislation (statute law) is created by the UK Parliament at Westminster and the Scottish Parliament at Holyrood. The Scotland Act 1998 devolved powers over areas such as education, health and criminal justice to the Scottish Parliament, while reserved matters like defence and immigration remain with Westminster. Acts of the Scottish Parliament can only be passed within devolved competence.
Judicial precedent (case law) is based on the doctrine of stare decisis – 'let the decision stand'. Decisions of higher courts bind lower courts within the same hierarchy. In Scotland, the Supreme Court of the United Kingdom hears final civil appeals but its decisions in Scottish criminal cases are not binding on Scottish criminal courts, preserving the distinct character of Scots criminal law.
Institutional writings, such as those by Stair, Erskine and Bell, are works by respected legal authors that carry persuasive authority and can fill gaps where statute and precedent are silent. European Union law and the European Convention on Human Rights also influence Scots law, although the UK's exit from the EU has changed the status of EU law.
2. The Scottish Court System |
The structure of courts in Scotland is separate from that of England and Wales. It is essential to distinguish between civil and criminal courts, as they have different jurisdictions and procedures. The court in which a case is heard depends on the nature and seriousness of the dispute or offence.
In criminal law, the lowest court is the Justice of the Peace Court, which deals with minor offences such as breach of the peace and road traffic violations. The next level is the Sheriff Court, which can hear cases under both summary procedure (without a jury, for less serious crimes) and solemn procedure (with a jury, for more serious crimes). The High Court of Justiciary is the supreme criminal court, handling the most serious cases like murder and rape, and it also hears appeals.
For civil matters, the Sheriff Court is the main court for cases such as debt recovery, family disputes and personal injury claims up to a certain value. The Court of Session is the supreme civil court, divided into the Outer House (first instance) and the Inner House (appeals). The UK Supreme Court sits at the apex for civil appeals from the Inner House, but only on points of law of general public importance.
3. Criminal Law: Actus Reus and Mens Rea |
In Scots criminal law, most crimes require proof of two elements: the actus reus (the guilty act) and the mens rea (the guilty mind). Both must coincide in time for a crime to be committed. This principle, articulated in the maxim 'actus non facit reum nisi mens sit rea', underpins many criminal defences.
Actus reus can take the form of a positive act, an omission where there is a legal duty to act, or a state of affairs. For example, the actus reus of assault is the physical attack; for theft it is the appropriation of property. In some statutory offences, such as driving with excess alcohol, a person can be liable simply for being in a prohibited condition, often called a 'state of affairs' crime.
Mens rea refers to the mental element required for a particular crime. In Scotland, the main types are intention (deliberate purpose), recklessness (conscious disregard of a substantial and unjustifiable risk) and, for some statutory offences, negligence. Murder requires either an intention to kill or wicked recklessness, whereas culpable homicide can be committed with a lesser mens rea.
4. Homicide: Murder and Culpable Homicide |
Homicide is the killing of a human being by another. Scots law distinguishes between murder and culpable homicide, a distinction that carries profound implications for sentencing. The mandatory penalty for murder is life imprisonment, whereas culpable homicide carries a discretionary sentence.
Murder is committed when the accused kills with either the intention to kill or with 'wicked recklessness' – acting with total indifference to whether the victim lives or dies. This state of mind was defined in the case of Cawthorne v HM Advocate as a 'wicked and criminal intention' falling short of an intent to kill but demonstrating a depraved disregard for life.
Culpable homicide covers all killings that are not murder but are still unlawful. It can arise from an intentional act that causes death under provocation, from diminished responsibility, or from an assault where death was not intended but resulted from an act that was inherently dangerous. It may also be committed through gross negligence, such as a doctor's serious error.
5. Defences in Criminal Law |
An accused person may raise a defence to avoid criminal liability, either by arguing that the prosecution has not proved its case or by establishing a special defence. Scottish law recognises several specific defences, many of which are rooted in statute or developed through the common law.
The special defences in solemn procedure must be lodged in advance and include alibi (the accused was not present at the scene), self-defence (reasonable force used to protect oneself or others), insanity (mental disorder preventing the understanding of the nature and wrongfulness of the act), coercion and automatism. In summary procedure, a special defence is not required but similar defences can still be argued.
Provocation is a partial defence to a charge of murder, reducing it to culpable homicide. It requires that the accused was provoked by the victim's conduct to such an extent that a reasonable person in the same position would have lost self-control. However, mere words, without physical assault, are generally insufficient to constitute provocation unless they constitute severe sexual or racial abuse.
6. Law of Contract: Formation |
Scots contract law differs from English law in several important respects. The essential elements for the formation of a contract are agreement (consensus in idem), capacity, and legality of purpose. Unlike English law, Scots law does not require 'consideration' – a promise is binding even if nothing is given in return, provided it is intended to create legal relations.
Agreement is usually reached through offer and acceptance. An offer must be clear and communicated to the offeree. Acceptance must be unqualified and correspond exactly to the terms of the offer – the so-called 'mirror image' rule. A purported acceptance that introduces new terms is a counter-offer, which destroys the original offer. In the case of the postal rule, an acceptance sent by post is effective when it is posted, not when it is received, unless the offer specifies otherwise.
Formal validity is rarely required; most contracts can be made orally or in writing. However, contracts relating to the transfer of land (called 'disposition' or 'standard security') must comply with the Requirements of Writing (Scotland) Act 1995. Minors (under 16) and adults with incapacity have limited contractual capacity, and contracts entered into by them may be void or voidable.
7. Law of Delict: Negligence |
Delict is the area of Scots law that concerns civil wrongs, such as negligence, defamation and nuisance. The most commonly litigated delict is negligence, which arises when a person breaches a duty of care owed to another, causing loss or injury that is not too remote. The principles are largely developed from the famous case Donoghue v Stevenson.
The test for establishing a duty of care was formulated in the 'neighbour principle': you must take reasonable care to avoid acts or omissions that you can reasonably foresee would be likely to injure your neighbour – persons who are so closely and directly affected by your conduct. The tripartite test from Caparo Industries v Dickman is also used: foreseeability of damage, proximity of relationship, and whether it is fair, just and reasonable to impose a duty.
A breach of duty occurs when the defender's conduct falls below the standard of the reasonable person in the same circumstances. Professional persons are held to the standard of an ordinarily competent member of their profession. The defender's act must also have caused the pursuer's loss, both in fact ('but for' test) and in law (not too remote). Remoteness is usually assessed by whether the type of damage was reasonably foreseeable.
8. Human Rights and the Law |
The protection of human rights is a vital part of the Scottish legal landscape. The Human Rights Act 1998 incorporates most rights contained in the European Convention on Human Rights (ECHR) into UK law. Public authorities, including the Scottish Government and courts, must act compatibly with Convention rights unless primary legislation explicitly prevents it.
Key rights include Article 2 (right to life), Article 3 (prohibition of torture and inhuman or degrading treatment), Article 5 (right to liberty and security), Article 6 (right to a fair trial), Article 8 (right to respect for private and family life), Article 10 (freedom of expression), and Article 14 (prohibition of discrimination). For students of SQA law, Article 6 is particularly relevant as it guarantees the right to a fair and public hearing within a reasonable time by an independent and impartial tribunal.
Under the Scotland Act 1998, any Act of the Scottish Parliament that is incompatible with Convention rights is 'not law' to the extent of the incompatibility. Courts can also make a 'declaration of incompatibility' regarding UK legislation, which does not strike down the law but triggers a fast-track procedure for Parliament to amend it. The ECHR also impacts the law of evidence, police powers and the treatment of vulnerable witnesses.
9. The Legal Profession and Access to Justice |
An effective legal system depends on a well-regulated profession and meaningful access to justice. In Scotland, the two main branches of the legal profession are solicitors and advocates. Solicitors are the first point of contact for clients and handle most legal work, while advocates specialise in presenting cases in the higher courts.
To become a solicitor, one must complete an LLB degree in Scots law, the Diploma in Professional Legal Practice, and a two-year traineeship with a law firm. Advocates are admitted to the Faculty of Advocates after a period of devilling (pupillage) under the supervision of an experienced advocate. Some solicitors gain rights of audience in the higher courts, known as solicitor advocates.
Access to justice is supported through legal aid, which covers advice and assistance (for initial advice) and civil or criminal legal aid (for court proceedings). Eligibility depends on means (income and capital) and the merits of the case. The Scottish Legal Aid Board administers the system, ensuring those who cannot afford legal representation are not denied their rights.
10. Alternative Dispute Resolution |
Not every dispute needs to be resolved in court. Alternative Dispute Resolution (ADR) refers to methods of resolving conflicts outside the formal judicial system. ADR is often cheaper, quicker and less adversarial than litigation, and is increasingly encouraged by the Scottish courts.
The main forms of ADR are negotiation, mediation, conciliation, and arbitration. Mediation involves a neutral third party who helps the parties reach a mutually acceptable agreement but does not impose a decision. It is widely used in family law disputes and community conflicts. Conciliation is similar but the conciliator plays a more active role in suggesting solutions.
Arbitration is more formal: an arbitrator (or a panel) hears evidence and makes a binding decision called an 'award'. The Arbitration (Scotland) Act 2010 provides a modern statutory framework, making arbitration an attractive option for commercial disputes. The Scottish courts generally uphold arbitration awards and will only set them aside on narrow grounds such as serious irregularity or lack of jurisdiction.
The benefits of ADR include confidentiality, flexibility, preservation of relationships and the opportunity for creative remedies that a court cannot always provide. The simple procedure rules in the Sheriff Court also encourage early settlement and can require parties to consider ADR before proceeding to a full hearing.
