1. Criminal Liability Formula |
Actus Reus + Mens Rea − Defence = Guilt
For almost all offences, the prosecution must prove the defendant committed the guilty act (actus reus) and had the guilty mind (mens rea) at the same time. If a full defence (e.g. self-defence) applies, the equation fails and the defendant is not guilty.
Actus reus covers all elements of the crime except the mental state — it can be an act, omission, or state of affairs. Mens rea is the mental element, usually intention or recklessness. For many statutory crimes, the actus reus must also be voluntary.
2. Strict Liability Formula |
Actus Reus Alone = Liability (No Mens Rea Needed)
With strict liability offences, it is enough that the defendant performed the prohibited act; no guilty mind needs to be proved. These are typically regulatory crimes, such as selling alcohol to an underage person or speeding, where Parliament has chosen to dispense with mens rea for at least one element.
The key defence is 'due diligence' — if the defendant can show they took all reasonable steps to avoid committing the offence, they may be acquitted. Common examples include 'no fault' or 'third party act' arguments.
3. Causation Principle |
Factual Causation + Legal Causation = Chain of Causation
To link the defendant's act to the result, the prosecution must establish both factual causation (the 'but for' test: but for the defendant's conduct, would the result have occurred?) and legal causation (the act was the substantial and operating cause, with no intervening act breaking the chain).
An intervening act (novus actus interveniens) must be unforeseeable, voluntary, and sufficiently independent to break the chain. Medical negligence is rarely enough; the defendant must take the victim as they find them (thin skull rule).
4. Murder Definition |
Unlawful Killing + Malice Aforethought = Murder
Murder is the common law offence of unlawfully killing a reasonable person in being under the Queen's peace, with malice aforethought. Malice aforethought means intention to kill or intention to cause really serious harm (grievous bodily harm).
A defendant charged with murder may use a partial defence (diminished responsibility, loss of control, or suicide pact) to reduce the conviction to voluntary manslaughter, thus avoiding the mandatory life sentence.
5. Diminished Responsibility Formula |
pairment + Recognised Medical Condition + Provides Explanation = Diminished Responsibility
Under the Coroners and Justice Act 2009, diminished responsibility requires: the defendant had an abnormality of mental functioning arising from a recognised medical condition; this substantially impaired their ability to understand their conduct, form a rational judgment, or exercise self-control; and it provides an explanation for the killing.
The burden of proof is on the defendant, on the balance of probabilities. If successful, the verdict becomes voluntary manslaughter and the judge has discretion in sentencing.
6. Unlawful Act Manslaughter Formula |
Unlawful Act + Dangerousness + Causes Death = Unlawful Act Manslaughter
To secure a conviction for involuntary manslaughter by an unlawful act, the prosecution must prove the defendant committed an intentional, unlawful act; that the act was dangerous in the sense that a reasonable person would foresee some physical harm; and that the act caused death.
The unlawful act must be a crime in itself and must be the direct cause of death. The defendant does not need to foresee the risk of death, only the risk of some harm. Classic examples include a punch that leads to the victim hitting their head.
7. Non-Fatal Offence Progression |
Assault + Battery → ABH → GBH (s.20) → GBH (s.18)
Non-fatal offences against the person form a hierarchy based on harm and mens rea. Assault (causing another to apprehend immediate unlawful force) and battery (applying unlawful force) are the base offences. Assault occasioning actual bodily harm (ABH) requires assault or battery that causes more than transient harm. Grievous bodily harm (GBH) under s.20 OAPA 1861 requires a wound or very serious harm, with intention or recklessness as to some harm. Under s.18, the defendant must intend GBH or resist arrest.
Using this ladder, you can map the mens rea and level of injury to the appropriate charge. The maximum sentences rise from six months for battery to life imprisonment for s.18 GBH.
8. Theft Formula |
Appropriation + Property + Belonging to Another + Intention to Permanently Deprive = Theft
Defined in s.1 of the Theft Act 1968, theft has five elements that must all be satisfied. 'Appropriation' covers assuming any of the rights of an owner. 'Property' includes money and all other property, real or personal, including things in action. The 'dishonesty' test now follows Ivey v Genting Casinos (2017): what was the defendant's actual state of knowledge and belief, and was their conduct dishonest by the standards of ordinary decent people?
The intention to permanently deprive does not require a permanent taking; it is enough if the defendant treats the property as their own regardless of the owner's rights. Conditional return does not remove intent if the property is taken as mere 'pawn' in an already lost condition.
9. Negligence Formula (Tort) |
Duty of Care + Breach + Damage = Negligence
Claimants must prove three elements to succeed in a negligence claim. A duty of care arises if there is proximity between the parties and it is fair, just and reasonable to impose a duty (Caparo v Dickman three-part test). Breach is judged by the standard of the reasonable person, with factors like reasonable foreseeability, probability of harm, and the social utility of the conduct.
Damage must be caused by the breach, both factually and legally, and must not be too remote. The type of damage must be reasonably foreseeable (Wagon Mound). Pure economic loss and psychiatric harm carry special rules limiting recovery.
10. Contract Formation Formula |
ffer + Acceptance + Consideration + Intention to Create Legal Relations = Binding Contract
An offer is a definite promise to be bound on specified terms. It must be distinguished from an invitation to treat. Acceptance must be unconditional, communicated to the offeror (unless postal rule applies), and must mirror the offer. Consideration means something of value given by each party — it must be sufficient but need not be adequate.
In social or domestic arrangements, there is a presumption of no intention to create legal relations, while in commercial contexts the presumption is the opposite. Both presumptions can be rebutted by evidence.
11. Contract Terms Theorem |
Condition → Termination + Damages ; Warranty → Damages Only
Contract terms are classified by their importance. A condition is a term that goes to the root of the contract; if breached, the innocent party can both terminate the contract and claim damages. A warranty is a less essential term; its breach entitles the party to damages only. The test is the proportionality of the remedy: would the breach deprive the innocent party of substantially the whole benefit of the contract?
Innominate (intermediate) terms allow the court to assess the seriousness of the breach before deciding the remedy. The Consumer Rights Act 2015 also implies terms into consumer contracts, such as satisfactory quality and fitness for purpose.
12. Precedent 'Theorem' |
Like Cases Decided Alike = Stare Decisis
The doctrine of precedent (stare decisis) is the judicial 'formula' for consistency. A court is bound by decisions of a higher court in the hierarchy. The Supreme Court (formerly the House of Lords) binds all lower courts and is itself bound by its own past decisions only where it considers it right to do so (Practice Statement 1966). The Court of Appeal (Civil and Criminal Divisions) is generally bound by its own previous decisions, subject to Young v Bristol Aeroplane exceptions.
The ratio decidendi of a case is the legal principle that must be followed; the rest is obiter dicta (persuasive but not binding). Distinguishing cases on their facts allows lower courts to avoid awkward precedents.
