1. The Nature of Law |

Law is a set of rules created by the state that are enforceable through the courts. It differs from moral rules or customs, although there is often overlap. Legal rules carry formal sanctions such as fines, imprisonment or compensation, whereas moral rules rely on social pressure and conscience.

The rule of law is a fundamental principle in the English legal system. It requires that no one is above the law, that all individuals and government bodies are subject to the same legal rules, and that suspects have fair trial rights. This concept, associated with the writings of A.V. Dicey, underpins justice and equality before the law.

Justice in the legal sense means achieving fair outcomes through impartial courts, proper procedures and reasoned judgments. It does not necessarily mean that every outcome is morally right, but that decisions are reached lawfully and without bias.

2. Classification of Law |

English law is broadly divided into criminal law and civil law. Criminal law deals with offences against the state and society. The main aim is to punish offenders and protect the public. Examples include theft, assault and murder. The state brings prosecutions through the Crown Prosecution Service, and a defendant may be fined, imprisoned or given a community sentence if found guilty.

Civil law governs disputes between individuals or organisations. Its purpose is to uphold rights and provide remedies, usually financial compensation. Typical civil claims include breach of contract, negligence and property disputes. The standard of proof in civil cases is 'on the balance of probabilities', a lower threshold than the criminal standard of 'beyond reasonable doubt'.

Another important distinction is between public law and private law. Public law concerns the relationship between individuals and the state, covering areas such as judicial review and human rights. Private law governs relationships between private individuals, including contract, tort and family law. However, at GCSE level the focus remains on criminal and civil liability.

3. Criminal Law: Actus Reus and Mens Rea |

To secure a conviction for almost every criminal offence, the prosecution must prove two key elements beyond reasonable doubt: the actus reus (guilty act) and the mens rea (guilty mind). These two must generally coincide in time – the mens rea must exist at the moment the actus reus is committed.

Actus reus describes the external element of the crime. It can be a positive voluntary act, such as punching someone; an omission (failure to act) where the defendant is under a legal duty to act, for example a parent who fails to feed their child; or a state of affairs, as in being found in a prohibited place. The actus reus is not concerned with what the defendant was thinking.

Mens rea is the mental element, usually captured by terms such as intention, recklessness, negligence or knowledge. Intention means the defendant desired a particular result or foresaw it as virtually certain. In recklessness, the defendant foresaw an unreasonable risk and went on to take it, as defined in R v Cunningham. Negligence refers to a failure to meet the standard of a reasonable person, although it more commonly appears in civil law.

4. Defences in Criminal Law |

Even when the actus reus and mens rea are present, a defendant may escape liability by raising a valid defence. Common defences examined at GCSE include self-defence, duress, insanity, automatism and, in limited circumstances, intoxication.

Self-defence permits a person to use reasonable force to protect themselves, another person or their property. The force must be necessary and proportionate to the threat as the defendant honestly believed it to be. This defence also covers the prevention of crime. If the force used is excessive, the defence fails and the defendant may be convicted.

Duress occurs when a defendant is forced to commit a crime by threats of death or serious injury, leaving them with no realistic choice but to comply. This defence is not available for murder. Similarly, insanity and automatism relate to the defendant's mental state. Insanity, governed by the M'Naghten Rules, involves a defect of reason arising from a disease of the mind, resulting in the defendant not knowing what they were doing or that it was wrong. Automatism covers involuntary acts caused by external factors such as a blow or a medical condition where the mind is not in control.

5. Tort Law: Negligence |

The law of tort provides remedies for civil wrongs. The tort of negligence is one of the most significant areas. It allows a claimant to claim compensation when they suffer injury or loss because someone failed to take reasonable care. The modern law stems from the neighbour principle established in Donoghue v Stevenson.

To prove negligence, the claimant must establish three elements: a duty of care, a breach of that duty, and damage caused by the breach. Duty of care is owed to persons who are closely and directly affected by the defendant's actions, based on the Caparo test of foreseeability, proximity and fairness. Once a duty exists, the claimant must show that the defendant fell below the standard of the reasonable person.

Breach is measured objectively: the court asks what a reasonable person would have done in the defendant's position, taking into account factors such as the likelihood of harm, the seriousness of potential injury, the cost of taking precautions and the social value of the activity. Finally, the claimant must prove that the breach caused the loss, both in fact and in law. Factual causation uses the 'but for' test, while legal causation asks whether the damage was a reasonably foreseeable consequence of the breach.

6. Parliamentary Law Making |

Parliament is the supreme law-making body in the UK. It creates Acts of Parliament, also known as statutes or primary legislation. A Bill must pass through several stages in both the House of Commons and the House of Lords before receiving Royal Assent and becoming law. Most government Bills are introduced by the executive, but private members' Bills also exist.

Once an Act is in force, courts must interpret and apply it. Sometimes Parliament gives ministers the power to create secondary legislation, such as statutory instruments, to fill in details on practical or technical matters. This delegated legislation can be introduced more quickly than an Act of Parliament but is subject to judicial review to ensure it does not exceed the powers granted by the parent Act.

The doctrine of parliamentary sovereignty means that Parliament can make or unmake any law whatsoever, and no person or body can override or set aside an Act of Parliament. However, EU law and human rights considerations have placed some practical limits on this traditional view, though Parliament remains legally supreme.

7. Judicial Precedent |

Judicial precedent, or case law, is a central source of law in the common law system. Under the doctrine of stare decisis, decisions made in higher courts bind lower courts in future similar cases. The ratio decidendi – the legal reasoning essential to the decision – creates the binding precedent, while obiter dicta are other judicial remarks which are persuasive but not binding.

The Supreme Court stands at the apex. Its decisions bind all courts below. The Court of Appeal is bound by its own previous decisions and by the Supreme Court; its decisions bind the High Court and lower courts. The High Court binds the County Court and Magistrates' Court but is itself bound by the Court of Appeal and Supreme Court. This hierarchy ensures consistency and predictability in legal development.

The Supreme Court and Court of Appeal have the power to depart from their own previous decisions using the Practice Statement 1966 and the exceptions set out in Young v Bristol Aeroplane Co Ltd respectively. This enables the law to adapt to changing social conditions without abandoning the certainty provided by precedent.

8. Statutory Interpretation |

When judges apply statutes, they must interpret the words of Parliament. Over time, courts have developed several rules of interpretation to discover the true meaning of legislation. The literal rule gives words their ordinary, everyday meaning, even if this leads to an absurd or harsh result, as in R v Harris where biting was held not to be 'wounding'.

The golden rule is a modification of the literal rule. It allows the court to avoid an absurd outcome by choosing an alternative meaning when the literal interpretation would produce a repugnant or nonsensical result. For example, in R v Allen, the court avoided the absurdity of allowing bigamy charges to be defeated by a literal reading of 'marry'. The mischief rule, in contrast, looks at the gap or 'mischief' in the common law that the statute was designed to remedy, examining the law before the Act to understand what Parliament intended to change.

The purposive approach is broader still. It seeks to give effect to the overall purpose of the legislation, often looking beyond the plain words to the wider intent of Parliament. European and human rights legislation have encouraged the use of this method, especially where a literal approach would produce injustice. Today judges regularly consult Hansard and other extrinsic aids to assist interpretation.

9. The Court System |

The English court structure is divided into criminal and civil jurisdictions. Criminal cases start in the Magistrates' Court for summary offences and either-way offences where the defendant elects summary trial. The Crown Court deals with more serious indictable offences, such as robbery and murder, with a judge and jury. Appeals from the Magistrates' Court go to the Crown Court or to the High Court on a point of law, while Crown Court appeals are heard in the Court of Appeal (Criminal Division) and ultimately the Supreme Court.

Civil cases typically begin in the County Court for claims of lower value, or the High Court for more complex or high-value disputes. The High Court has three divisions: Queen's Bench Division (contract and tort), Chancery Division (property, trusts, corporate matters) and Family Division. Appeals from the County Court generally go to the High Court, and further appeals lie to the Court of Appeal (Civil Division) and the Supreme Court.

The Supreme Court is the final court of appeal for all matters. It hears cases of great public importance and its rulings have far-reaching effects. Below the Supreme Court, the Court of Appeal plays a vital role in clarifying the law and ensuring consistency, while the High Court also has original jurisdiction and hears judicial review claims against public bodies.

10. Legal Personnel |

Solicitors and barristers are the two main branches of the legal profession. Solicitors typically work in law firms and deal directly with clients, providing advice, drafting documents and preparing cases. In civil matters they can represent clients in lower courts. Many solicitors now also gain rights of audience in higher courts as solicitor-advocates.

Barristers are specialist advocates who are instructed by solicitors to represent clients in court, particularly in the higher courts. They provide expert opinions on complex legal points and conduct advocacy before judges and juries. Barristers are regulated by the Bar Standards Board and traditionally operate from chambers. The cab-rank rule obliges them to accept instructions in their area of practice provided they are available and the fee is proper.

Judges preside over court proceedings and make rulings on law and procedure. Senior judges are usually appointed from among experienced barristers and, increasingly, solicitor-advocates. Magistrates, by contrast, are lay volunteers who handle most summary criminal cases in the Magistrates' Court with the support of a legally qualified clerk. Legal executives have also become a recognised route into legal careers through the Chartered Institute of Legal Executives.
