📚 Year 10 CAIE Law: Essay Writing Framework & Model Answer | 十年级CAIE法律:论文写作框架与范文
Writing a high-scoring law essay for CAIE IGCSE Law is not about memorising a textbook — it is about showing the examiner that you can identify the legal issue, state the relevant rule, apply it to the facts, and reach a reasoned conclusion. Many Year 10 students lose marks simply because their essay lacks a clear framework. This guide breaks down the essay-writing process step by step and provides a full model answer so you can see exactly how to put every element together.
1. Understanding the Question |
Every law essay starts with a command word such as ‘discuss’, ‘evaluate’, ‘compare’ or ‘advise’. Before you write a single word, underline the key legal term (e.g. ‘offer’, ‘duty of care’, ‘murder’) and circle the command word. This tells you whether to describe the law, apply it to a scenario, or argue both sides.
For ‘discuss’ questions, you need to present the law and consider differing viewpoints or weaknesses. For ‘advise’ questions, you must apply the law to a party and give legal advice. Take 30 seconds to decide what the examiner really wants.
2. Planning and Structuring Your Answer |
A rushed, unplanned essay is easy for an examiner to spot. Use the first 3–5 minutes of the exam to make a brief plan. Write down the key legal tests, case names and statutory sections you will use. A simple bullet list is enough — never write full sentences in your plan.
Your plan for a problem question might look like: (1) Identify the claimant and defendant; (2) Consider duty of care – Caparo test; (3) Breach of duty – reasonable man; (4) Causation – ‘but for’ test; (5) Remoteness of damage – Wagon Mound; (6) Defences – contributory negligence; (7) Remedy – damages. This skeleton will guide every paragraph you write.
3. Crafting a Strong Introduction |
An introduction should be short — two to three sentences — and must directly address the question. Start by naming the area of law, then state the main rule or issue, and briefly indicate your overall conclusion.
For example: ‘This question concerns the tort of negligence. To establish liability, the claimant must prove that the defendant owed a duty of care, breached that duty, and caused reasonably foreseeable damage. I will advise whether Carl is likely to succeed in his claim against Dina.’ This immediately shows the examiner you are on the right track.
4. Using the IRAC Method in Body Paragraphs | 在主体段落中运用IRAC方法
The most reliable framework for law essays is IRAC: Issue, Rule, Application, Conclusion. Each main body paragraph should follow this pattern. Start by stating the sub-issue (Issue), then quote the relevant legal principle and case (Rule), apply that rule to the facts in the question (Application), and finish with a mini-conclusion on that point.
Do not fall into the trap of just listing case names. The Application section is where marks are won. For instance, do not simply write ‘Donoghue v Stevenson established the neighbour principle’. Go further: ‘Applying Caparo v Dickman, it was reasonably foreseeable that leaving a slippery floor unattended in a shop could injure a customer; there was sufficient proximity between the shop owner and the customer; and it is fair, just and reasonable to impose a duty of care.’
5. Making Effective Use of Legal Authorities |
Statutory references and case names are the evidence that supports your argument. For CAIE IGCSE Law, you should know key statutes such as the Offences Against the Person Act 1861, the Theft Act 1968, and the Consumer Rights Act 2015, as well as leading cases like R v Cunningham (recklessness), Fisher v Bell (invitation to treat), and Caparo v Dickman (duty of care).
Always write the full case name and at least a one-line description of the principle. For example: ‘In Caparo Industries plc v Dickman [1990], the House of Lords laid down the three-stage test for imposing a duty of care: foreseeability of damage, proximity, and whether it is fair, just and reasonable.’
6. Demonstrating Legal Reasoning |
Merely stating the correct rule is not enough. You must show the examiner how you reason with the law. This means linking the facts of the given scenario to each element of the legal test. Use linking phrases such as ‘This is similar to...’, ‘Unlike in that case, here...’, ‘The defendant would argue that... however the court is likely to find...’.
Good reasoning also acknowledges uncertainty. If the law is unclear or there are two possible outcomes, say so. For example: ‘It is arguable whether shouting “get lost” constitutes an assault, as words alone are generally insufficient; however, if accompanied by a threatening gesture, an assault may be established as in Read v Coker.’
7. Incorporating Counter-Arguments and Balance |
For higher marks, especially in ‘discuss’ or ‘evaluate’ questions, you must show you can see both sides. After presenting your main argument, add a short paragraph that considers a counter-argument. Then explain why the law favours one view over the other, or state that the outcome is uncertain.
For example: ‘Some might argue that the defendant should not be liable because the claimant was trespassing. However, under the Occupiers’ Liability Act 1984, a duty may still be owed to trespassers if the risk is one the occupier is aware of and it is reasonable to offer protection.’
8. Writing a Persuasive Conclusion |
A conclusion should wrap up your argument without introducing new material. For problem questions, state the likely outcome: ‘Therefore, Carl is likely to succeed in his claim for negligence, but his damages may be reduced by 25% for contributory negligence.’ For essay questions, summarise the strengths and weaknesses you have discussed and offer a final view.
Never end with just ‘In conclusion, the law is complicated.’ Be decisive but realistic. If the law is unclear, say: ‘The law in this area remains uncertain, and a definitive answer would require the court to weigh factors X and Y.’
9. Full Model Answer (Tort of Negligence) |
Question: 'Alex was shopping in a supermarket when he slipped on a spilt yoghurt that had been left on the floor for over an hour. As a result, Alex broke his arm. Advise Alex whether he can claim compensation from the supermarket for his injury.'
This problem question concerns the tort of negligence. For Alex to succeed, he must prove that the supermarket owed him a duty of care, breached that duty, and the breach caused his injury which was not too remote.
Duty of care: The supermarket, as occupier, owes a duty to lawful visitors under the Occupiers' Liability Act 1957. Alex was a customer, so he is owed the common duty of care. Using the three-part test from Caparo v Dickman, it was reasonably foreseeable that a slipping hazard could injure a customer, there was a relationship of proximity between shop and shopper, and imposing liability is fair, just and reasonable.
Breach of duty: The standard expected is that of a reasonable supermarket. In deciding whether there was a breach, the court will consider the factors from Bolton v Stone (magnitude of risk) and Latimer v AEC (practicability of precautions). The spilt yoghurt was on the floor for over an hour, yet no staff cleaned it or put up a warning sign. A reasonable supermarket would have a system of regular floor checks, so leaving a hazard for an hour is likely to fall below the standard.
Causation: Factual causation requires the 'but for' test from Barnett v Chelsea Hospital: but for the supermarket's failure to clean up, Alex would not have fallen and broken his arm. This is clearly satisfied.
Remoteness of damage: The type of damage (physical injury from slipping) is reasonably foreseeable as in The Wagon Mound (No 1). A broken arm is not too remote.
Defences: The supermarket may argue Alex was partly to blame if he was not looking where he was going (Froom v Butcher). If contributory negligence is found, damages may be reduced by a percentage, say 20%.
Conclusion: Alex is likely to succeed in a claim for negligence. He will be awarded damages for his broken arm and related losses, although the sum could be reduced slightly if the court finds he was contributorily negligent.
10. Common Pitfalls to Avoid |
One frequent mistake is writing everything you know about a topic rather than answering the specific question. Another is missing the Application step — stating rules without linking them to the scenario. Also, avoid using the wrong terminology (e.g. confusing assault with battery) or failing to mention defences when the facts suggest them.
Time management is crucial. Allocate roughly 1 minute per mark. For a 15-mark essay, plan for 5 minutes, write for 20 minutes, and leave 2–3 minutes to proofread. Practise writing under timed conditions so you develop a feel for the pace.
