📚 Year 10 Cambridge Law: Common Misconceptions and Corrections | Year
As you begin studying Law in Year 10, you will encounter many new concepts that challenge your everyday understanding of rules and justice. It is easy to form misunderstandings based on TV dramas, news headlines or personal opinions. This article identifies ten of the most common misconceptions held by Cambridge Law students and explains exactly how to correct them. Clearing up these points early will give you a stronger foundation for both the written examination and your development of legal reasoning.
1. Law and Morality Are the Same | 法律与道德是一样的
A very common starting point is to think that whatever is immoral must be illegal, and whatever is legal must be moral. Many students bring this assumption from their personal sense of fairness.
In reality, law and morality are distinct though often overlapping. Law is a body of rules made and enforced by the state, with legal consequences such as fines or imprisonment for breach. Morality is a set of beliefs, values and principles about right and wrong, often shaped by religion, culture or individual conscience. Something can be immoral but not illegal – for instance, telling a lie to a friend is generally not against the law. Conversely, a legal rule might be considered immoral by some people; for example, paying low wages may be perfectly legal in some places yet seen as morally wrong. In your Cambridge Law course, you should always keep in mind that law is not the same as ethics.
2. Judges Simply Apply Law and Never Create It | 法官只是适用法律,从不创造法律
You may have been told that Parliament makes the law and judges merely apply it. This oversimplification leads to the misconception that judges have no law-making role at all.
Under the doctrine of separation of powers, it is true that primary legislation is the job of the legislature. However, in the English legal system, which is a common law system, judges do develop the law through judicial precedent. When a judge decides a case where the law is unclear or no statute covers the point, the decision – the ratio decidendi – becomes a binding precedent that lower courts must follow. In addition, judges interpret statutes, and this interpretation can effectively shape the law. So, while judges cannot strike down primary legislation, they do create law in the sense of refining and developing common law rules. For Cambridge assessments, it is accurate to say that judges make law through the doctrine of precedent, not in the same way as Parliament.
3. Every Criminal Offence Requires Mens Rea |
It is tempting to think that a person can be convicted only if they intended or were reckless about the prohibited conduct. Students often assume mens rea is always needed.
While most crimes require both actus reus (guilty act) and mens rea (guilty mind), there is an important category of offences known as strict liability offences. For these, the prosecution only needs to prove the actus reus – no mens rea is required. Examples include many regulatory offences, such as selling food beyond its use-by date or certain traffic offences like speeding. It does not matter whether the defendant acted intentionally, recklessly or even with all possible care; the offence is committed simply by doing the prohibited act. In Year 10 Law, you must recognise that strict liability is an exception to the general principle, and you should be able to give examples.
4. Self-defence Is Always a Complete Defence to Murder |
Many students believe that if you kill someone while defending yourself, you will automatically not be guilty of any crime. This is a dangerous oversimplification.
Self-defence is indeed a defence, but it must be both necessary and proportionate in the circumstances as the defendant honestly believed them to be. The law does not permit unlimited retaliation. If you use more force than is reasonably necessary, the defence fails and you can be convicted of murder or manslaughter. For instance, if someone slaps you and you respond by stabbing them, that would almost certainly be disproportionate. Moreover, self-defence can reduce murder to manslaughter only in limited situations, such as where the force was excessive but genuinely intended for self-defence (loss of control might also apply). So, it is not an automatic 'get out of jail free' card. In Cambridge examination scenarios, always discuss whether the force was reasonable.
5. The Police Can Arrest Anyone at Any Time | 警察可以随时逮捕任何人
Television crime dramas often show officers arresting people simply because they are 'acting suspiciously' or 'look guilty'. This can create the misconception that arrest powers are unlimited.
Under the Police and Criminal Evidence Act 1984 (PACE), an arrest is lawful only if there is reasonable suspicion that a person has committed, is committing or is about to commit an offence, and it must be necessary on one of the specified grounds (e.g. to verify the person's identity, to prevent harm, to investigate). 'Reasonable suspicion' requires objective grounds, not just a hunch. Furthermore, arrests can also be made under a warrant issued by a court. A person arrested must be told the grounds for the arrest. Unlawful arrest can lead to the exclusion of evidence and damages claims against the police. Therefore, arrest power is far from absolute.
6. A Contract Must Be in Writing to Be Valid |
Many Year 10 students believe that a deal is not legally binding unless a written document is signed. This is one of the most persistent myths about contract law.
In English law, most contracts can be formed orally, by conduct or even by a handshake – no writing is required. The essential elements of a valid contract are offer, acceptance, consideration, intention to create legal relations and certainty of terms. The form does not matter as long as these elements are present. There are a few statutory exceptions where a contract must be in writing, such as contracts for the sale of land (Law of Property Act 1925) and guarantees under the Statute of Frauds. But for everyday purchases, a verbal agreement is enough. Understanding this will help you correctly analyse scenario questions in your Cambridge assessment.
7. Tort and Crime Are the Same Thing |
Students frequently confuse tort law with criminal law because both involve wrongdoing that causes harm. The language can be confusing, as we talk about 'suing' someone and 'punishing' someone.
The key distinction is that a crime is a wrong against the state, prosecuted by public authorities in criminal courts, with the aim of punishment (imprisonment, fines, community orders). A tort, on the other hand, is a civil wrong committed against an individual or business, leading to a private lawsuit in civil courts, with the objective of compensating the victim (damages). An act can be both a crime and a tort. For example, assault is both a criminal offence and the tort of trespass to the person. The same event can give rise to a criminal prosecution and a civil claim simultaneously. In your course, always separate the legal consequences accordingly.
8. Children Under 10 Can Never Take Responsibility for Harm | 10
It is common knowledge that children under the age of 10 cannot be prosecuted for a criminal offence. Students sometimes extend this to mean they have no legal responsibility whatsoever.
In criminal law, the age of criminal responsibility in England and Wales is indeed 10 years old (doli incapax). A child aged 9 cannot be convicted of theft, for instance. However, this does not mean they escape all legal consequences. In tort law, children can be liable for the damage they cause if they have the necessary mental capacity to understand the nature of their actions, and their age is taken into account when assessing the standard of care. Moreover, parents or guardians can be held vicariously liable in certain situations, or face parenting orders. So, while there is no criminal record for a young child, civil liability can still arise.
9. The Right to Remain Silent Is Absolute |
The phrase 'you have the right to remain silent' is ingrained in popular culture, leading many to believe that a suspect can say nothing at all without any negative consequences.
In the English legal system, a suspect does have the right to remain silent, but under sections 34–37 of the Criminal Justice and Public Order Act 1994, the court may draw 'adverse inferences' from a suspect’s silence in certain circumstances. This means that if a suspect fails to mention a fact later relied on in their defence, or fails to account for objects, marks or presence at a place, the jury or magistrates may hold this against them. The right must be exercised with caution because silence could weaken the defence. The caution given by the police now warns: 'You do not have to say anything. But it may harm your defence if you do not mention when questioned something you later rely on in court.' Thus, the right is qualified, not absolute.
10. EU Law Still Has Supreme Authority in the UK |
With all the discussion about Brexit, many Year 10 students assume that European Union law still overrides UK law, or that the UK courts can still strike down Acts of Parliament in conflict with EU law.
Since the UK left the EU on 31 January 2020, the supremacy of EU law ended. The European Union (Withdrawal) Act 2018 converted much existing EU law into domestic UK law – known as 'retained EU law'. This retained law can be amended or repealed by the UK Parliament, so it no longer enjoys supremacy. Additionally, UK courts no longer refer questions to the European Court of Justice (ECJ) for binding rulings; they may only have regard to post-Brexit ECJ decisions if they consider it appropriate. The UK Parliament is once again the supreme law-maker. This is a crucial point for understanding the current constitutional position of the English legal system.
