1. Sources of Law |
English law derives from several key sources. The most significant is legislation created by Parliament, known as statute law or Acts of Parliament. Judicial precedent, where judges make law through decisions in higher courts, is another major source. In addition, delegated legislation made by government ministers and local authorities under powers granted by Parliament also forms part of our law.
Historically, the United Kingdom's membership of the European Union meant that EU law was a supreme source. Since Brexit, retained EU law remains part of domestic law unless specifically repealed, and international treaties like the European Convention on Human Rights influence our law through the Human Rights Act 1998.
2. Parliamentary and Delegated Legislation |
An Act of Parliament begins as a Bill introduced in either the House of Commons or the House of Lords. It passes through several stages – first reading, second reading, committee stage, report stage and third reading – in both Houses before receiving royal assent and becoming law. This process ensures thorough scrutiny of proposed legislation.
Delegated legislation allows Parliament to grant law-making powers to other bodies. The three main types are statutory instruments made by government ministers, by-laws created by local authorities and public corporations, and Orders in Council issued by the Privy Council. Delegated legislation is controlled by the courts through judicial review and by Parliament through affirmative and negative resolution procedures.
3. Judicial Precedent |
The doctrine of judicial precedent, or stare decisis, means that courts must follow the decisions of higher courts in previous cases when the material facts are similar. This promotes consistency, fairness and predictability in the law. The ratio decidendi – the legal reasoning essential to the decision – creates a binding precedent for future cases.
Judges may on occasion avoid following a binding precedent by distinguishing the case, overruling a decision in a higher court, or reversing it on appeal. The hierarchy of courts is crucial: the Supreme Court binds all lower courts, the Court of Appeal binds the High Court and lower courts, while the High Court normally binds itself and lower courts but does not bind the Court of Appeal.
4. The Court System and Legal Personnel |
The English court system is split into criminal and civil jurisdiction. Criminal cases start in the Magistrates' Court for summary offences and either-way offences, while serious indictable offences are heard in the Crown Court before a judge and jury. Civil disputes such as contract and tort claims begin in the County Court or, for larger claims, the High Court.
Appellate courts include the Crown Court (for appeals from magistrates), the High Court (which also hears some first-instance cases), the Court of Appeal (Civil and Criminal Divisions), and the Supreme Court, which is the final court of appeal for all UK cases. Legal professionals comprise solicitors, who mainly advise clients and prepare documents, and barristers, who predominantly represent clients in higher courts.
5. Criminal Law: Actus Reus and Mens Rea |
Most crimes require proof of two elements: the actus reus (guilty act) and the mens rea (guilty mind). The actus reus is the external element of the offence – a voluntary act, an omission where a duty exists, or a state of affairs. A person is generally not liable for failing to act unless there is a statutory, contractual or common law duty to do so.
Mens rea refers to the mental state required for the crime, such as intention, recklessness or negligence. Intention means the defendant desired the consequence or knew it was virtually certain. Recklessness involves taking an unjustified risk that the reasonable person would not take. Some offences are strict liability crimes, meaning no mens rea is needed – the act alone suffices for guilt.
6. Non-Fatal Offences Against the Person |
The main non-fatal offences are set out in the Offences Against the Person Act 1861 and in common law. Assault and battery are the least serious: an assault is causing the victim to apprehend immediate unlawful force, while battery is the actual infliction of that unlawful force. Both are summary offences.
Section 47 of the 1861 Act creates the offence of assault occasioning actual bodily harm (ABH). Any hurt or injury calculated to interfere with the health or comfort of the victim can amount to ABH. Mans rea for s.47 is the same as for common assault or battery – there is no requirement to intend or foresee harm above battery level.
More serious are causing grievous bodily harm (GBH) with intent under s.18, which requires proof of a specific intent to cause serious injury, and maliciously wounding or inflicting GBH under s.20, where the mens rea is recklessness or intention to cause some harm. GBH means really serious bodily harm.
7. Property Offences: Theft, Robbery and Burglary |
Theft is defined in s.1 of the Theft Act 1968 as the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. All five elements – dishonest, appropriation, property, belonging to another, and intention to permanently deprive – must be proved simultaneously.
Robbery is theft committed with the use or threat of force immediately before or at the time of stealing, in order to steal (s.8 Theft Act 1968). The force must be against a person, and the theft must be complete for robbery to apply. Burglary involves entering a building or part of a building as a trespasser with intent to steal, inflict grievous bodily harm or cause criminal damage (s.9(1)(a)), or having entered and then stealing or attempting to steal (s.9(1)(b)).
8. Tort Law: Negligence |
Tort law deals with civil wrongs, and negligence is the most common tort. To succeed in a negligence claim, the claimant must prove that the defendant owed them a duty of care, that the duty was breached, and that the breach caused foreseeable damage which is not too remote a consequence.
Duty of care is established through the 'neighbour principle' from Donoghue v Stevenson: one must take reasonable care to avoid acts or omissions that could foreseeably injure a neighbour. Breach occurs when the defendant fails to act as a reasonable person would in the circumstances. The damage must be caused both in fact (the 'but for' test) and in law (the kind of damage was foreseeable). Common defences include contributory negligence and voluntary assumption of risk (consent).
9. Family Law: Marriage, Civil Partnership and Divorce |
Family law governs the creation and dissolution of legally recognised relationships. A valid marriage requires that both parties are of age, not already married or in a civil partnership, and not within prohibited degrees of relationship. The marriage must be conducted by an authorised person and properly registered. Same-sex couples can marry under the Marriage (Same Sex Couples) Act 2013, and civil partnerships are available to both same-sex and opposite-sex couples.
For divorce, the law in England and Wales was fundamentally reformed by the Divorce, Dissolution and Separation Act 2020, which came into effect in April 2022. The sole ground for divorce is that the marriage has broken down irretrievably. A statement to that effect by one or both parties is conclusive evidence, removing the need to allege fault or to live apart for extended periods. Civil partnerships are dissolved on the same basis.
When making arrangements for children, the child's welfare is the court's paramount consideration under the Children Act 1989. Orders such as child arrangements orders set out where the child lives and with whom they have contact.
10. Human Rights and the Human Rights Act 1998 |
The Human Rights Act 1998 incorporates the rights set out in the European Convention on Human Rights (ECHR) into domestic UK law. Public authorities must act compatibly with Convention rights, and individuals can bring claims in UK courts if their rights are violated, rather than having to take their case to the European Court of Human Rights in Strasbourg.
Convention rights include absolute rights such as the right to freedom from torture (Article 3), limited rights like the right to life (Article 2) which can be restricted in specific defined circumstances, and qualified rights such as the right to respect for private and family life (Article 8), which may be interfered with when necessary and proportionate in a democratic society. Courts must interpret legislation in a way compatible with Convention rights whenever possible, and higher courts can issue a declaration of incompatibility if primary legislation cannot be interpreted compatibly.
