📚 SQA Law Formulas & Theorems Quick-Reference Handbook | SQA
Law is often seen as a sea of cases and statutes, but at its heart lies a structure of recurring tests, elements, and logical rules—much like formulas in science. This handbook distils the key principles of the SQA Law course (National 5 and beyond) into memorable ‘formulas’ that allow you to approach problem questions with confidence. Each section pairs a legal concept with its essential ‘equation’, followed by clear explanation and application within Scots law.
1. Sources and Hierarchy of Scots Law |
Scots law is a mixed legal system drawing on civil and common law traditions. To apply any legal rule correctly, you must know where it comes from and which source prevails. The binding strength of authorities follows a clear hierarchy.
UK Legislation (Acts of UK Parliament) > Scottish Parliament Legislation > Common Law (Judicial Precedent) > Institutional Writings > Custom
Legislation passed by the UK Parliament on reserved matters (e.g., immigration, defence) is the supreme source. Acts of the Scottish Parliament govern devolved areas such as health, education, and criminal law. Judicial precedent from the Supreme Court binds all lower Scottish courts, while decisions of the High Court of Justiciary shape criminal law. Institutional writers like Stair and Erskine carry persuasive authority. Custom is only relevant where clearly established and consistent.
2. The Criminal Liability Equation |
In Scots criminal law, establishing guilt is not a matter of guesswork. It requires proving specific components beyond reasonable doubt. The fundamental equation summarises what the Crown must demonstrate.
Criminal Liability = Actus Reus (Guilty Act) + Mens Rea (Guilty Mind) - Defence
If any element is missing, the accused must be acquitted. For example, a person who causes harm while sleepwalking lacks the voluntary actus reus and cannot be convicted. Similarly, an honest but unreasonable mistake may negate mens rea for certain crimes. Defences like self-defence or insanity, if successfully pleaded, provide a complete defence. The burden of proving the actus reus and mens rea lies on the prosecution; the defence must only raise the defence on a balance of probabilities.
3. Elements of a Crime: Actus Reus |
The actus reus is the physical element of the crime—everything except the mental state. It can consist of a voluntary act, an omission in limited circumstances, or a ‘state of affairs’. Its precise nature depends on the definition of the offence.
ct / Omission / State of Affairs) + Any Required Circumstances + Causation (Result Crimes)
A voluntary act means the accused was in control of their actions. Omissions can generate liability only where a legal duty exists—such as a parent’s duty to protect a child or a statutory duty to report an accident. ‘State of affairs’ offences include being found drunk in charge of a vehicle. For result crimes like murder, the prosecution must prove causation: that the accused’s conduct was both a factual and a legal cause of the harm. The ‘thin skull’ rule confirms that the accused must take their victim as they find them.
4. Elements of a Crime: Mens Rea |
Mens rea is the mental element required for a particular crime. Scots law recognises several distinct levels of culpable mental state, and the prosecution must match the correct level to the charge. Absence of mens rea normally means no conviction.
Mens Rea = Intention OR Recklessness OR (Exceptionally) Negligence
Intention requires that the accused acted purposefully to bring about the prohibited consequence. For murder, this means either an intention to kill or ‘wicked recklessness’—a complete disregard for the likely fatal outcome. Recklessness involves conscious risk-taking, where the accused foresaw the risk but proceeded regardless. Transferred malice operates where an accused intends to harm one victim but incidentally harms another: the mens rea transfers with the act, as in striking at A but hitting B. Negligence alone rarely suffices in criminal law except for certain statutory offences such as careless driving.
5. Strict Liability Offences |
Not all crimes require proof of mens rea. Strict liability offences are those where Parliament has decided that public protection demands conviction even without fault. These are usually regulatory or licensing offences.
Strict Liability Offence = Actus Reus Only (No Mens Rea Needed)
Examples in Scots law include selling alcohol to a person under 18, possession of certain weapons, and many road traffic offences such as speeding. The Crown only needs to prove the prohibited act occurred. It is no defence that the accused took all reasonable care or was unaware of the facts. Courts presume mens rea is required unless the statute clearly indicates otherwise, but social concern can rebut this presumption, as shown in the leading Scottish appeal case of Mitchell v Morrison (1949) on the licensing of ices.
6. Defences to Criminal Charges |
Even when actus reus and mens rea appear present, an accused may escape liability by raising a valid defence. Scots law classifies defences as either justifications (the act was right) or excuses (the actor is not blameworthy).
g., Automatism) OR Negation of Mens Rea (e.g., Error) OR Special Plea (e.g., Self-Defence, Insanity)
Automatism covers unconscious, involuntary actions such as a hypoglycaemic episode. Self-defence requires a reasonable belief in imminent danger and proportionate force. Mental disorder (insanity) is a statutory defence under the Criminal Procedure (Scotland) Act 1995, which may result in an acquittal or a mental health disposal. Coercion, necessity, and consent may operate in limited circumstances. The burden lies on the defence to raise these issues, after which the Crown must disprove them beyond reasonable doubt.
7. Homicide Offences: Murder and Culpable Homicide |
The law distinguishes between the most heinous killings and those involving lesser blameworthiness. Scotland uses ‘murder’ for intentional or wicked killings and ‘culpable homicide’ for killings without that extreme mental element or where a partial defence reduces the charge.
Murder = Unlawful Killing + Intention to Kill / Wicked Recklessness
Homicide = Unlawful Killing + (Lesser Mens Rea OR Provocation / Diminished Responsibility)
Murder is always a serious, solemn case, attracting a mandatory life sentence. Wicked recklessness requires proof that the accused displayed complete indifference to whether the victim lived or died. Culpable homicide, on the other hand, covers killings caused by recklessness short of wicked recklessness, gross negligence, or an unlawful act that results in death. The partial defences of provocation (recognised but narrow) and diminished responsibility (a recognisable mental abnormality that substantially impaired responsibility) reduce what would otherwise be murder to culpable homicide.
8. Crimes Against the Person and Property |
Beyond homicide, the criminal law protects individuals from physical violation and safeguards property rights. Theft, assault, robbery, and fraud each contain distinct formulas that must be satisfied for conviction.
t Formula = Intentional Attack + Evil Intent + Physical Contact / Menace (Without Consent)
Assault in Scots law is a common law crime requiring an intentional attack upon the person of another with evil intent. The slightest touching, if hostile, can amount to assault. Aggravated assault involves greater injury or use of a weapon.
Theft = Dishonest Appropriation of Another's Property + Without Consent + Intention to Deprive
Theft covers the taking and carrying away of any corporeal moveable property that belongs to another. The mental element requires both dishonesty and the intention to deprive the owner permanently. Robbery is theft accomplished by violence or the threat of violence. Fraud involves false representations that induce someone to act to their prejudice. Vandalism criminalises the wilful or reckless destruction of property.
9. The Negligence Formula in Delict |
Delict is the Scots law of civil wrongs. The most frequently litigated delict is negligence, which compensates a pursuer for injury or damage caused by another’s failure to take reasonable care. The classic formulation comes from the Scottish case Donoghue v Stevenson (1932).
经典表述源自苏格兰案件Donoghue v Stevenson(1932年)。
Negligence = Duty of Care + Breach of Duty + Causation (Factual & Legal) + Loss/Harm
Duty of care is founded on the ‘neighbour principle’: you must take reasonable care to avoid acts or omissions that you can reasonably foresee would be likely to injure your neighbour—persons closely and directly affected by your conduct. Breach occurs where conduct falls below the standard of the ordinary reasonable person. Causation requires the ‘but for’ test and that the damage was within the scope of the risk; a novus actus interveniens may break the chain. The pursuer must prove all elements on the balance of probabilities.
10. Contract Formation Equation |
Contracts are legally enforceable agreements. Scots law, unlike English law, does not generally require consideration (a reciprocal price), but it insists on a clear intention to create legal relations and distinct formalities for gratuitous undertakings.
fer + Acceptance + Intention to Create Legal Relations [+ Writing for Gratuitous Promises]
An offer is a clear statement of terms on which the offeror is prepared to be bound. Acceptance must be unconditional and communicated effectively (the postal rule applies to posted acceptances if specified). Intention to create legal relations distinguishes a contract from a social arrangement; commercial agreements are presumed to have such intent, while domestic arrangements are not. Under the Requirements of Writing (Scotland) Act 1995, a gratuitous unilateral promise—such as a pledge to gift money—must be in writing and signed to be binding, which replaces the English doctrine of consideration.
11. Statutory Interpretation Rules |
When courts must interpret legislation, they deploy a set of recognised approaches (often called ‘canons of construction’). These can drastically alter the outcome of a criminal trial or civil dispute. The main rules apply across the UK but are deployed in Scottish courts as aids.
nterpretation Decision = Literal Rule OR Golden Rule OR Mischief Rule + Purposive Approach
The literal rule gives words their plain, ordinary meaning even if the result is harsh. The golden rule modifies the literal meaning to avoid absurdity but no further. The mischief rule, traced back to Heydon’s Case (1584), examines the defect in the old law that the statute intended to remedy and interprets the words to suppress that mischief. A modern purposive approach, influenced by European and human rights law, seeks to give effect to Parliament’s overall purpose, reading words in their widest context.
12. Human Rights and the Scotland Act |
No legal formula in modern Scotland is complete without a human rights dimension. The European Convention on Human Rights (ECHR) is incorporated into Scots law by the Human Rights Act 1998 and the Scotland Act 1998, which imposes constraints on the Scottish Parliament and public authorities.
tcome = Interpretation Under Section 3 HRA + Declarations of Incompatibility If Impossible
UK courts must read and give effect to primary legislation in a way that is compatible with Convention rights, insofar as it is possible to do so. If a Scottish Parliament Act is beyond the legislative competence because it breaches ECHR rights, it is ‘not law’ and can be struck down. Public authorities, including police and prosecutors, act unlawfully if they breach a Convention right unless primary legislation forces their hand. The key rights most relevant to SQA Law include Article 2 (right to life), Article 5 (liberty), Article 6 (fair trial), Article 8 (respect for private and family life), and Article 10 (freedom of expression). Proportionality serves as the overarching ‘test’ when courts balance individual rights against public interests.
