1. Why Case Study Skills Are Essential |
OCR assessment relies heavily on application questions. You will not simply be asked to recall definitions but to solve legal problems using the principles you have learned. A case study tests your ability to spot the relevant area of law, identify the key facts that trigger legal issues, and then apply the rules precisely. Without structured practice, even students with strong knowledge can lose direction and present answers that are descriptive rather than analytical.
Examiners look for logical reasoning that connects the facts of the case to the specific elements of a crime or tort. When you drill case studies regularly, you internalise this process. You begin to see patterns: an omission in a criminal scenario, a breach of duty in a negligence claim, or a clear act of parliament that imposes strict liability. This automatic recognition saves time and raises the quality of your response under exam pressure.
2. The IRAC Framework Explained | IRAC
IRAC stands for Issue, Rule, Application, and Conclusion. This is the most widely recommended structure for legal problem-solving as it keeps your answer coherent and ensures you do not miss essential steps. Begin by identifying the legal issues hidden in the scenario. Then state the relevant legal rules, including statutory provisions and case law principles. After that, apply those rules thoroughly to the given facts, explaining why each element is or is not satisfied. Finally, reach a clear conclusion on liability or outcome.
For OCR Year 11, you can simplify this slightly while keeping the logic intact. Start with a short sentence identifying the area of law, for example, 'This concerns non-fatal offences against the person under the Offences Against the Person Act 1861.' Then briefly lay out the actus reus and mens rea requirements before moving to the deep application. Many top-scoring students also add a mini-evaluation at the end if the question demands discussion of reform or fairness.
Remember that IRAC is not a rigid template but a thinking tool. As you become more fluent, your answers will naturally flow through these stages without labouring the headings, but the examiner should be able to trace your reasoning from issue to conclusion.
3. Drill One: Assault and Battery |
Scenario: During a heated argument in a school corridor, Tia raises her fist and moves sharply towards Omar, shouting, 'I'm going to punch you right now!' Omar flinches and steps back, genuinely afraid. Before Tia can do anything more, a teacher intervenes. In this drill, identify any criminal liability for Tia's actions.
Issue: The area of law is non-fatal offences, specifically assault. Assault is defined as intentionally or recklessly causing another person to apprehend immediate, unlawful personal violence. No physical contact is required. Battery, on the other hand, involves the actual infliction of unlawful force. Since Tia did not touch Omar, the focus is on whether an assault occurred.
Rule: From case law such as Smith v Chief Superintendent of Woking Police Station (1983), the victim must apprehend an immediate threat. The actus reus of assault is any act causing the victim to anticipate immediate unlawful force. Words alone can sometimes suffice, especially when accompanied by a menacing gesture, as shown in Read v Coker (1853). The mens rea is intention or recklessness as to causing the apprehension.
Application: Tia raised her fist and moved towards Omar while shouting a direct threat. A reasonable person in Omar's position would certainly apprehend immediate violence; the threat was not conditional or distant. Her actions were deliberate, satisfying the mens rea of intent. Even if she genuinely did not mean to carry out the punch, her behaviour was reckless. All elements of assault are satisfied.
Conclusion: Tia is likely guilty of assault. No battery occurred because there was no application of force, but the facts clearly establish an apprehension of immediate unlawful violence.
4. Drill Two: Actual Bodily Harm Under Section 47 |
Scenario: Continuing from the previous example, imagine that after the teacher lets go, Tia pushes Omar against a locker. Omar hits his head and suffers a cut that requires two stitches. How does the legal picture change?
Issue: The push constitutes a battery because there is an intentional application of unlawful force. The injury then triggers section 47 of the Offences Against the Person Act 1861: assault occasioning actual bodily harm. We must assess whether the harm is 'actual bodily harm' and whether the defendant had the required mens rea for the base offence.
Rule: Section 47 requires proof of either an assault or a battery that causes actual bodily harm. ABH includes any hurt or injury calculated to interfere with the health or comfort of the victim, as defined in Miller (1954). It can be physical or psychiatric, though a cut requiring stitches undoubtedly qualifies. The mens rea for s.47 is the same as for the basic assault or battery; no additional intent to cause the harm is needed, following Roberts (1971).
Application: Tia committed a deliberate battery by pushing Omar. The battery directly caused Omar's head to strike the locker, producing a cut that required stitches. This clearly amounts to actual bodily harm. Tia's intention to apply force is enough to establish the mens rea for s.47, as the courts do not require her to have foreseen the exact harm. The chain of causation is unbroken.
Conclusion: Tia is liable for assault occasioning actual bodily harm contrary to s.47. Her initial assault merged into the battery and subsequent injury, attracting more serious consequences.
5. Drill Three: Criminal Damage with Lawful Excuse |
Scenario: Leo believes his neighbour's shed is being used to store dangerous chemicals that might explode. One night, Leo breaks the shed window to enter and check, causing £300 worth of damage. He genuinely intended to prevent an explosion and protect his family. Analyse his liability.
Issue: Criminal damage is defined under s.1 Criminal Damage Act 1971. The potential defence here is lawful excuse, particularly under s.5(2), which allows a person to rely on a belief that the property owner would have consented to the damage if they had known of the circumstances, or that the damage was necessary to protect other property from immediate danger.
Rule: The actus reus is the destruction or damage of property belonging to another without lawful excuse. Mens rea is intention or recklessness as to that damage. For the lawful excuse under s.5(2)(b), the defendant must honestly believe that the property was in immediate need of protection and that the means used were reasonable in all the circumstances. The test is subjective, as confirmed in R v Hill (1989).
Application: Leo damaged the window intentionally, satisfying actus reus and mens rea. However, he honestly believed the shed contained explosive chemicals and that breaking in was necessary to avert an explosion threatening his home and family. The key questions are: was the danger immediate? If Leo truly thought so, his belief, even if mistaken, can still support the defence under s.5(3). The damage was caused to safeguard other property, and the level of damage was relatively moderate. A court would consider whether a reasonable person would see the action as disproportionate, but the focus is on Leo's genuine belief.
Conclusion: If the court accepts Leo's subjective belief as honest, he may be found not guilty by reason of lawful excuse. However, if the belief is seen as irrational or the danger was clearly not immediate, the defence will fail. This case illustrates how criminal law balances property rights with the instinct to protect others.
6. Drill Four: Negligence in Tort |
Scenario: A supermarket employee mops the floor and places a yellow warning sign near the wet area. A customer, engrossed in a phone call, does not see the sign, slips, and breaks an ankle. Advise the customer on a potential negligence claim.
Issue: The tort of negligence requires the claimant to prove that the defendant owed a duty of care, breached that duty, and that the breach caused the damage. The Occupiers' Liability Act 1957 may also apply, but in OCR, basic negligence principles under Caparo v Dickman (1990) are central. The main question is whether the supermarket did enough to discharge its duty.
Rule: Under the neighbour principle from Donoghue v Stevenson (1932), an occupier owes a duty to lawful visitors to take reasonable care for their safety. The standard is that of a reasonable person in the circumstances. A warning sign is a common way to discharge the duty, but it must be sufficient to alert a reasonably attentive visitor. Causation is established using the 'but for' test, and the damage must not be too remote.
Application: The supermarket owed a duty of care to customers. Mopping a floor creates a foreseeable risk of slipping. By placing a yellow warning sign, the employee took steps to reduce that risk. However, a court will ask whether the sign was clearly visible and whether it covered the entire wet area. The customer's failure to see it because she was absorbed in her phone may constitute contributory negligence under the Law Reform (Contributory Negligence) Act 1945, reducing any damages awarded. The 'but for' test is satisfied: had the floor not been wet, she would not have slipped. The damage, a broken ankle, is a recognised physical injury.
Conclusion: The supermarket may have discharged its duty by providing a warning sign, but the visibility and placement will be scrutinised. If the court finds the sign adequate, the claim might fail. Even if a breach is found, the customer's own carelessness could substantially reduce her compensation.
7. Drill Five: Strict Liability in a Regulatory Offence |
Scenario: A food manufacturer sells a sealed packet of sliced ham labelled 'gluten-free'. A sample tested by trading standards officers reveals a trace of wheat flour. The company had rigorous quality checks in place and had no idea the contamination occurred. Evaluate the company's liability.
Issue: Many food safety regulations impose strict liability, meaning the prosecution does not need to prove fault or a guilty mind. The offence arises from the act of selling food that does not meet the prescribed standard. This drill examines the defence of due diligence available under the Food Safety Act 1990.
Rule: Under s.14 of the Food Safety Act 1990, it is an offence to sell food which is not of the nature, substance or quality demanded by the purchaser. This is an offence of strict liability, so the actus reus alone establishes liability unless the defendant can raise the statutory defence of due diligence under s.21. The defence requires proving that the defendant took all reasonable precautions and exercised all due diligence to avoid the commission of the offence.
Application: The company sold ham that contained wheat, which a purchaser buying a gluten-free product would not expect. The actus reus is satisfied. Since this is a strict liability offence, the prosecution does not need to prove any mens rea. The company will seek to rely on due diligence, pointing to its rigorous quality checks and training programmes. A court will examine whether those checks were reasonable and whether the contamination was an isolated incident that could not have been prevented by any practical measures. If the company can show a comprehensive system that was operating effectively at the time, the defence may succeed.
Conclusion: The company is prima facie liable, but a well-documented due diligence system provides a realistic chance of acquittal. This drill highlights how strict liability shifts the burden onto defendants while still allowing a fairness safeguard through the statutory defence.
8. Identifying the Correct Crime or Tort |
A common mistake in Year 11 case analysis is mislabelling the offence. For non-fatal offences, structure your thinking around the degree of harm and the defendant's intention. Assault and battery sit at the base, followed by s.47 ABH, s.20 malicious wounding or inflicting grievous bodily harm, and s.18 wounding or causing GBH with intent. Each requires careful matching of the actus reus and mens rea to the facts.
Use a checklist: what physical or psychiatric harm actually occurred? Did the defendant intend that harm, or were they merely reckless? Was a weapon used? Did the victim suffer a wound (a break in the continuity of the whole skin) or really serious harm? The answers to these questions guide you to the correct charge. If you rush, you might apply s.20 where s.18 is more appropriate, losing valuable marks.
In tort law, similarly distinguish negligence from the rule in Rylands v Fletcher or from occupiers' liability. Always ask: is the damage physical injury, property damage, or psychiatric? Is the claimant a visitor or a trespasser? This preliminary sorting ensures you begin with the correct legal framework.
9. Common Pitfalls When Applying the Law |
One pitfall is treating the application section as a mere restatement of facts. You must weave the facts and the law together, using precise language: 'Because the defendant struck the claimant with closed fists, this constitutes a battery because there was direct intentional application of unlawful force.' Another is neglecting causation. Even if a breach of duty or an unlawful act is established, you must link it directly to the harm. The 'but for' test and novus actus interveniens principles are essential tools.
Students also sometimes forget the subjective elements. In criminal law, a defendant's honest but unreasonably held belief can sometimes negate mens rea, as seen in self-defence scenarios. Always evaluate whether a defence is available, even if the main offence seems proven. In negligence, failing to discuss contributory negligence or consent can leave an answer incomplete.
Lastly, avoid conclusory statements without reasoning. Instead of writing 'The defendant is guilty of assault,' explain, step by step, how each element is satisfied. This demonstration of analytical skill is what distinguishes a Level 3 answer from a Level 2 answer under OCR mark schemes.
10. Structuring Your Ultimate Case Study Answer |
Begin with a crisp heading in your mind: area of law, likely parties, and the broad question. Then write a short introductory paragraph that sets the scene without repeating the story. Follow with clearly organised paragraphs for each element, seamlessly moving from issue to rule to application. Use signposting phrases such as 'The actus reus of assault requires... Applying this to the facts, Tia's raised fist and threatening words...'
When citing cases, integrate them naturally. Do not write long case narrations; one or two lines maximising relevance are enough. For example, 'As in R v Ireland, words alone, when coupled with a menacing context, can found an assault.' This proves you understand the principle, not just the name of the case.
Conclude with a clear answer to the question asked. If the scenario asks 'Discuss liability,' cover both sides and then state your overall view. If it asks 'Advise X,' present the most likely outcome but acknowledge alternative arguments. A well-structured conclusion leaves the examiner with a sense of completeness.
Finally, build in a short reflection time. After finishing a practice case, compare your answer with a model. Identify one paragraph where your application was vague and rewrite it with tighter analysis. These drills are not about quantity but about deepening the quality of your legal reasoning, case by case.
