1. Understanding the Essay Question |
Before you start writing, read the question at least twice and underline the command word. Common command words in CCEA Law essays are 'explain', 'discuss', 'describe', 'evaluate' and 'analyse'. 'Explain' asks you to set out the law clearly, using cases and examples. 'Discuss' or 'evaluate' requires you to present both sides of an argument and to reach a reasoned conclusion. Identifying the scope of the question helps you avoid writing irrelevant information.
2. Types of CCEA Law Essays | CCEA
In Year 10, you will encounter three main types of law essays. The table below summarises them so you can quickly recognise what each question demands.
| Essay Type | Essay Type | Key Requirement |
|---|---|---|
| Descriptive / Explanatory | 描述说明型 | State the law accurately, define key terms, use relevant cases |
| Application / Problem‑solving | 应用/案例分析型 | Apply legal rules to a given scenario, predict the likely outcome |
| Evaluative | 评价型 | Weigh up arguments for and against, express a justified opinion |
Recognising the type of essay immediately tells you how to balance description, application and evaluation. A descriptive essay still needs a brief conclusion, while an evaluative essay must show you can criticise the law.
3. The Standard Essay Structure |
Every strong law essay follows the same three‑part structure: introduction, body and conclusion. The introduction should be about 10 % of the word count and must set out the area of law, define the central concept and briefly signpost your main points. The body paragraphs each tackle one key idea — for example, one element of a crime or tort. The conclusion summarises your arguments and gives a final, clear answer to the question. Stick to this structure even under time pressure.
4. The IRAC Method for Legal Analysis | 法律分析的 IRAC 方法
The IRAC method — Issue, Rule, Application, Conclusion — is the most reliable tool for legal reasoning. First, state the legal Issue: 'The issue is whether the defendant owed a duty of care.' Second, set out the Rule: define the legal test and cite the authority. Third, Apply the rule to the facts of the scenario. Finally, state your Conclusion on that issue. Practise IRAC with every practice question until it becomes automatic.
5. Using Cases and Precedent Effectively |
Merely dropping a case name into your answer is not enough. You must show why the case matters. For each case, give the key facts in one sentence, state the legal principle that was established, and then explain how that principle applies to the current question. For example, 'In Donoghue v Stevenson [1932], the House of Lords established the neighbour principle, which created a general duty of care. Here, the manufacturer owed a duty to the ultimate consumer, just as in the scenario…' This technique demonstrates deep understanding.
6. Crafting a Strong Introduction |
An outstanding introduction contains three elements: a clear statement of the area of law, a definition of the core legal term, and a roadmap of the essay. A model template is: 'This essay will explain the law on [topic]. [Topic] is defined as … The discussion will first examine …, then consider …, and finally evaluate whether the current law is satisfactory.' Never write a long introduction — two or three sentences are enough for a 20‑mark question.
7. Developing Body Paragraphs |
Each body paragraph should follow the PEEEL structure: Point, Explanation, Evidence, Evaluation, Link. Start with a topic sentence that states the element or principle you are discussing. Then explain the legal rule in your own words. Back it up with a case that serves as evidence. Where the question requires evaluation, briefly point out a strength or weakness of the law. End the paragraph by linking back to the question or to the next point. This creates a logical flow that examiners appreciate.
8. Writing a Convincing Conclusion |
The conclusion is your final chance to impress the reader. Summarise the main rules you have discussed, state whether the law achieves its purpose, and offer a final opinion if the question asks for evaluation. Never introduce new cases or arguments in the conclusion. A single sentence such as 'Overall, while the law on causation is generally fair, the thin skull rule demonstrates a tension between principle and policy' shows synthesis and analytical thinking. Keep the conclusion brief and authoritative.
9. Model Answer: Negligence |
Question: 'Explain the elements of the tort of negligence.' Below is a model answer that illustrates the framework above. Study how each element is introduced, explained with a case, and connected to the next element.
To establish liability in the tort of negligence, a claimant must prove three key elements: that the defendant owed them a duty of care, that the defendant breached that duty, and that the breach caused damage which is not too remote.
The modern duty of care stems from the neighbour principle laid down in Donoghue v Stevenson [1932], where Lord Atkin said you must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. A 'neighbour' is anyone who is so closely and directly affected by your act that you ought reasonably to have them in contemplation. In Caparo Industries v Dickman [1990], the House of Lords refined the test into three stages: foreseeability of harm, proximity between the parties, and whether it is fair, just and reasonable to impose a duty. In a typical road traffic scenario, a driver automatically owes a duty to other road users because harm is foreseeable and they share a relationship of proximity.
Once a duty is established, the court asks whether the defendant has fallen below the standard of the reasonable person. The classic statement of the standard is found in Blyth v Birmingham Waterworks Co. [1856], where Baron Alderson defined negligence as the omission to do something which a reasonable person, guided by those considerations which ordinarily regulate human affairs, would do, or doing something which a prudent and reasonable person would not do. The standard is objective; the defendant’s personal characteristics are generally ignored. However, where the defendant holds himself out as possessing a special skill, such as a surgeon, the standard is raised to that of a reasonably competent professional in that field, as confirmed in Bolam v Friern Hospital Management Committee [1957]. Failure to meet the standard constitutes a breach.
The claimant must then prove that the breach was both a factual and a legal cause of the damage. For factual causation, the courts apply the 'but for' test: but for the defendant’s breach, would the claimant have suffered the harm? This is illustrated in Barnett v Chelsea and Kensington Hospital Management Committee [1969], where the hospital’s failure to examine a patient was a breach of duty, but the claim failed because the patient would have died from arsenic poisoning even if he had been treated. Legal causation requires that the damage be of a type that was reasonably foreseeable at the time of the breach, following The Wagon Mound (No. 1) [1961]. If an intervening act breaks the chain of causation, the defendant may not be held liable. Provided the damage is not too remote and no break in the chain occurs, causation is satisfied.
Barnett v Chelsea and Kensington Hospital Management Committee
In conclusion, negligence is made up of three interconnected elements: duty, breach and causation, each supported by well‑known cases. Together they ensure that a defendant is only made to pay compensation where it is just and reasonable to do so.
10. Time Management in the Exam |
Effective time management can transform your grade. Read the question and plan for about 5 minutes; write the essay for the majority of the allocated time; leave 3‑5 minutes to review. For a 20‑mark essay which you have 25 minutes to complete, aim to spend 2 minutes planning, 20 minutes writing and 3 minutes checking for missing cases or unclear reasoning. Use a simple plan: list the three or four main points you will cover, with a case beside each point.
11. Common Mistakes to Avoid |
Avoid these common pitfalls in your law essays. Listing cases without explanation: simply writing 'as in Donoghue v Stevenson' without explaining the principle loses marks. Ignoring the question type: answering a 'discuss' question with pure description will limit your grade. Skipping evaluation: if the question says 'evaluate', you must include at least one or two evaluative sentences. Weak introductions and conclusions: these are the first and last things the examiner sees; make them sharp and relevant. Failing to link paragraphs: a disjointed essay is hard to follow; use linking phrases like 'Building on the duty of care, the next question is whether…'
12. Practice and Revision Tips |
Turn your revision into active practice. Write essay plans for past paper questions rather than just reading notes. Time yourself writing full essays under exam conditions at least once a week. Swap essays with a study partner and give each other feedback using the marking criteria. Create flashcards with a case name on one side and the key principle on the reverse. Finally, always keep a copy of the CCEA mark scheme handy so you know exactly what the examiner rewards.
