1. The Nature and Purpose of Law |
Law is a set of rules created by the state to regulate the behaviour of individuals and organisations within society. Its primary purposes are to maintain order, protect rights, resolve disputes and provide a framework for acceptable conduct. Without law, society would descend into chaos because there would be no agreed standard for resolving conflicts.
The law differs from moral rules or customs because it is enforceable through the courts. While many laws are based on moral principles, not all immoral acts are illegal, and not all illegal acts are, in everyone's view, immoral. For example, lying is often immoral but only becomes illegal in specific contexts such as fraud or perjury.
2. The Rule of Law |
The rule of law is a constitutional principle that no one is above the law, and everyone – including the government – must act within the law. It ensures that laws are made openly, applied equally and enforced fairly. Key elements include: legal certainty, equality before the law, access to justice, and an independent judiciary.
For Year 10 students, the rule of law is a thread that runs through many topics. For example, the doctrine of judicial precedent relies on the principle that like cases should be treated alike, which reinforces consistency and fairness. The right to a fair trial under Article 6 of the European Convention on Human Rights also reflects the rule of law.
3. Acts of Parliament |
An Act of Parliament, also known as primary legislation or a statute, is the highest form of law in England and Wales. A Bill must pass through both the House of Commons and the House of Lords and receive Royal Assent before becoming an Act. The legislative process includes several stages: first reading, second reading, committee stage, report stage and third reading in each House.
Parliament can create, amend or repeal any law, which reflects the doctrine of parliamentary sovereignty. However, parliamentary sovereignty has been affected by membership in the European Union (historically) and by the Human Rights Act 1998, which requires courts to interpret legislation compatibly with Convention rights wherever possible.
4. Delegated Legislation |
Delegated legislation is law made by a person or body to whom Parliament has delegated authority through a parent Act. There are three main types: statutory instruments, by-laws, and Orders in Council. Statutory instruments are made by government ministers and are used for detailed rules, such as road traffic regulations. By-laws are created by local authorities or public corporations for matters within their jurisdiction, such as parking restrictions. Orders in Council are made by the Privy Council, often in emergencies.
Controls on delegated legislation are both parliamentary and judicial. Parliamentary controls include the negative resolution procedure (the instrument becomes law unless either House objects) and the affirmative resolution procedure (it must be approved by both Houses). Judicial controls operate through judicial review, where courts can declare delegated legislation ultra vires (beyond the powers granted) or declare it void on other grounds such as unreasonableness.
5. Statutory Interpretation |
Statutory interpretation refers to how judges work out the meaning of words in an Act of Parliament when a case comes before them. Words in statutes can be ambiguous, outdated or too broad, so judges rely on a range of rules and aids. The three main rules of interpretation are the literal rule, the golden rule and the mischief rule.
The literal rule gives words their ordinary, everyday meaning even if it leads to an absurd result, as seen in Whitely v. Chappell (1868). The golden rule modifies the literal rule to avoid an absurdity, with the narrow approach used where a word has more than one meaning and the wider approach applied where the plain meaning leads to a repugnant result (Re Sigsworth 1935). The mischief rule looks at the gap in the law that the Act was designed to fill, established in Heydon's Case (1584).
Judges also use internal aids (the statute itself, such as the long title and headings) and external aids (e.g., dictionaries, Hansard, Law Commission reports). The purposive approach, influenced by EU law, looks at the overall purpose of the Act rather than sticking to the precise words, as the UK courts do when applying the Human Rights Act 1998.
6. Judicial Precedent |
Judicial precedent, also known as case law or stare decisis (stand by what has been decided), is a source of law where past decisions of judges create law for future judges to follow. The doctrine requires a court hierarchy, reliable law reporting and the identification of the ratio decidendi (the legal reason for the decision) as opposed to obiter dicta (remarks made in passing that are not binding).
In the modern court hierarchy, the Supreme Court binds all courts below it, but has the power to depart from its own previous decisions using the Practice Statement 1966. The Court of Appeal is bound by the Supreme Court and generally by its own previous decisions, subject to exceptions set out in Young v. Bristol Aeroplane Co Ltd (1944). The High Court binds lower courts and is bound by the Court of Appeal and Supreme Court. This system brings consistency, fairness and predictability to the law, although it can also be rigid and complex.
7. The Court System |
The court structure in England and Wales is split between criminal and civil courts. Criminal courts deal with conduct prohibited by the state, and the main courts of first instance are the Magistrates' Court and the Crown Court. Civil courts resolve disputes between individuals or organisations, with the County Court hearing most low-value claims and the High Court handling more complex or high-value cases.
Appeals move up through the system: from the Magistrates' Court to the Crown Court, or by way of case stated to the King's Bench Division; from the Crown Court to the Court of Appeal (Criminal Division); and from the County Court or High Court to the Court of Appeal (Civil Division). The final court of appeal for most cases is the Supreme Court, which deals with points of law of general public importance.
8. Legal Personnel |
Key legal professionals include solicitors, barristers and judges. Solicitors are the first point of contact for most clients; they give legal advice, draft documents and may represent clients in lower courts. Barristers are specialist advocates who have rights of audience in all courts and offer expert opinions on complex legal issues. Most barristers are self-employed and work from chambers.
Judges preside over courts, make decisions on points of law, sum up evidence for juries and pass sentences. In the Magistrates' Court, cases are usually heard by lay magistrates (Justices of the Peace) who are unpaid volunteers advised by a legally qualified clerk. District judges are paid, legally qualified judges who sit in the Magistrates' Court and county courts.
9. The Jury |
A jury is a panel of 12 randomly selected members of the public who decide the facts in a criminal trial and return a verdict of guilty or not guilty. Juries are used in the Crown Court for indictable offences and in a small number of civil cases, such as defamation. The role of the jury is to weigh the evidence presented and apply the law as explained by the trial judge solely to the facts.
Advantages of the jury system include public participation, which enhances democracy and confidence in the justice system; the 'perverse verdict' power, which allows juries to acquit a defendant according to conscience; and impartiality achieved through random selection. Disadvantages include jury tampering, lack of understanding of complex cases, and the absence of reasons for verdicts, which can make appeals difficult.
10. Criminal Liability: Actus Reus and Mens Rea |
To secure a conviction in most criminal offences, the prosecution must prove beyond reasonable doubt both the actus reus and the mens rea. Actus reus is the guilty act: the external element of the crime. It can consist of an act, an omission (where a legal duty exists), or a state of affairs. For result crimes, causation must also be established – both factual causation ('but for' test) and legal causation (the defendant's act must be the substantial and operating cause of the result).
Mens rea is the guilty mind, the mental element. The main forms are intention (direct or oblique) and recklessness. Direct intention means the defendant desired the outcome; oblique intention applies where the outcome was a virtually certain consequence of the defendant's actions and the defendant appreciated this (R v. Woollin 1999). Recklessness involves taking an unjustified risk and is judged subjectively – the defendant must have foreseen the risk and gone on to take it (R v. Cunningham 1957).
Cunningham 1957)。
11. Strict Liability |
Strict liability offences are exceptional because they do not require mens rea to be proven for at least one element of the actus reus. The prosecution only needs to prove the defendant committed the prohibited act. Common examples are regulatory offences such as selling food beyond its use-by date, speeding or causing pollution. The justification is often the protection of public health or safety, and the relatively minor nature of the penalties.
Strict liability can be unjust because a defendant who took all reasonable precautions may still be convicted. The courts presume that mens rea is required for a criminal offence unless Parliament clearly indicates otherwise. This presumption was set out in Sweet v. Parsley (1970). When interpreting a statute, judges consider factors such as the wording of the Act, the mischief it aims to prevent, and whether imposing strict liability would help enforce the law.
12. Human Rights in the Legal System |
The Human Rights Act 1998 incorporated the European Convention on Human Rights into UK law. It does not allow judges to strike down primary legislation, but it gives them power to make a declaration of incompatibility under section 4 if a statute cannot be read compatibly with Convention rights. Under section 3, courts must, so far as it is possible, interpret all legislation in a way that upholds Convention rights.
Key rights relevant to GCSE Law include the right to life (Article 2), the right to a fair trial (Article 6), the right to respect for private and family life (Article 8), and freedom of expression (Article 10). These rights are not absolute; some are qualified and must be balanced against the rights of others or the public interest. Understanding these rights helps students see how the law serves individuals and how courts protect fundamental freedoms.
