📚 Year 10 WJEC Law: Summer Preparation & Bridging Course | Year 10 WJEC

Welcome to your WJEC GCSE Law journey. This summer bridging course is designed to give you a solid head start before you officially begin Year 10. We will explore how laws are made, how courts work, and what it really means when someone breaks a law. Rather than memorising endless facts, you will learn to think like a lawyer: asking critical questions, applying rules to real situations, and building balanced arguments.

1. What Is Law and Why Does It Matter? |

In its simplest sense, law is a set of rules created by the state to regulate behaviour. Without law, society would struggle to resolve disputes fairly, protect individual rights, and maintain public order. In WJEC Law, you will discover that law is not just about punishment, it is about balancing competing interests and upholding justice.

Every legal system rests on the principle of the rule of law. This means no one is above the law, including government officials. It also demands that laws are clear, publicised, and applied evenly. As a Year 10 student, you will begin to spot the rule of law in everyday news stories, whether it is a high-profile criminal trial or a challenge to a government decision through judicial review.

2. The English Legal System: An Overview |

Although the United Kingdom does not have a single written constitution, its legal system is highly structured. The English legal system is the foundation for the WJEC specification and includes both criminal and civil law. Criminal law deals with offences against the state, such as theft or assault, where the state prosecutes the defendant. Civil law resolves disputes between individuals or organisations, for example, a claim for negligence after a car accident.

It is helpful to think of the system as a pyramid of courts. At the bottom are the Magistrates' Court and County Court, where most cases start. Above them sit the High Court, Court of Appeal, and finally the Supreme Court. Each court has its own jurisdiction and follows the doctrine of precedent, meaning lower courts must follow the decisions of higher courts in similar cases.

3. Sources of Law: Parliament and Judges |

Law in England and Wales comes from two main sources: Acts of Parliament (statute law) and case law (common law). Parliament is sovereign, meaning it can make or unmake any law. A Bill must pass through the House of Commons, the House of Lords, and receive Royal Assent before it becomes an Act. Statute law covers everything from the Theft Act 1968 to the Human Rights Act 1998.

Judges also make law through the decisions they reach in individual cases. When a judge decides a novel point of law, that decision becomes a precedent that future courts must follow if the facts are sufficiently similar. This body of cases is called common law, and it is particularly important in areas like negligence, contract law, and murder.

4. Criminal Law: Actus Reus and Mens Rea |

To establish criminal liability, the prosecution must usually prove two elements beyond reasonable doubt: actus reus (the guilty act) and mens rea (the guilty mind). Actus reus can be a voluntary act, an omission where there is a duty to act, or a state of affairs. For example, in theft, the actus reus is appropriating property belonging to another.

Mens rea refers to the mental state required for the offence. Different crimes require different levels of fault, from intention (the highest level) through recklessness to negligence. In murder, the mens rea is 'malice aforethought', meaning an intention to kill or cause grievous bodily harm. If either actus reus or mens rea is missing, the defendant cannot be convicted of that offence.

5. Non-Fatal Offences Against the Person |

The WJEC course examines a ladder of non-fatal offences, starting with assault and battery. Assault is causing another person to apprehend immediate unlawful force, and no physical contact is needed. Battery is the actual application of unlawful force, such as a punch or even an unwanted touch. Both are summary offences with relatively low maximum sentences.

Above that sits actual bodily harm (ABH) under section 47 of the Offences Against the Person Act 1861. This requires the defendant to commit an assault or battery which causes harm that is more than merely transient or trifling. Psychiatric harm can also qualify as ABH. More serious are grievous bodily harm (GBH) under section 20 and section 18, where the injury is really serious. The distinction often rests on the mens rea: section 20 requires recklessness, but section 18 requires a specific intention to cause grievous bodily harm or to resist arrest.

6. Theft and Property Offences |

Theft is defined in the Theft Act 1968 as the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. Each element must be satisfied: appropriation means assuming the rights of the owner; property includes money and most physical items; and dishonesty is tested against the ordinary standards of reasonable people.

Robbery is essentially theft aggravated by the use or threat of force immediately before or at the time of stealing. It is a much more serious offence and is triable only in the Crown Court. Burglary, on the other hand, involves entering a building as a trespasser with intent to steal, inflict GBH, or do unlawful damage. Understanding the overlap between these offences helps you to apply the law accurately in problem scenarios.

7. Introduction to Tort Law: The Tort of Negligence |

Civil law aims to compensate individuals who have suffered loss or injury. One of the most important torts you will study is negligence. To succeed in a negligence claim, a claimant must prove three things: that the defendant owed them a duty of care, that the defendant breached that duty, and that the breach caused foreseeable damage which is not too remote.

The duty of care was famously established in Donoghue v Stevenson, the 'snail in the ginger beer' case, where Lord Atkin formulated the neighbour principle: you must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. Breach is judged by the standard of the reasonable person, and causation is often tested using the 'but for' test.

8. The Criminal Process: From Arrest to Trial |

The criminal justice process begins with an arrest, often made by the police on reasonable grounds to suspect an offence. The suspect is taken to a police station, where a custody officer ensures their rights are respected. The suspect can consult a solicitor and have someone informed of their detention. The police may then question the suspect under caution, and any statement made may be used as evidence.

After investigation, the Crown Prosecution Service (CPS) decides whether to charge. The CPS applies the Full Code Test: first, is there sufficient evidence for a realistic prospect of conviction? Second, is a prosecution in the public interest? If charged, the defendant appears before a magistrates' court for a first hearing. More serious offences are sent to the Crown Court for trial by jury.

9. Sentencing and Punishment |

If a defendant is found guilty, the court must decide on an appropriate sentence. The purposes of sentencing are set out in section 142 of the Criminal Justice Act 2003 and include punishment, reduction of crime (by deterrence), reform and rehabilitation, protection of the public, and reparation by offenders to victims. Magistrates and judges have a range of sentencing options at their disposal.

Sentences range from a conditional discharge, where no further punishment is imposed so long as the offender stays out of trouble, through fines and community orders to custodial sentences. Custodial sentences are reserved for serious offences. When passing a custodial sentence, the court must consider the seriousness of the offence and any aggravating or mitigating factors, such as previous convictions or a guilty plea.

10. Key Skills in Legal Study: Reading Statutes and Cases |

Success in WJEC Law demands more than knowledge; you must be able to handle legal sources. When reading a statute, look for its structure: the short title, the long title, sections, and subsections. Statutes often contain interpretation sections that define key words. For example, the Theft Act 1968 section 2 gives guidance on 'dishonesty'. Always read the exact wording because a single word can change the legal outcome.

Case reading is equally vital. Start by summarising the material facts, then identify the legal issue and the ratio decidendi (the legal reason for the decision). Everything else is obiter dicta, which is persuasive but not binding. Practise with classic cases like R v Dudley and Stephens for necessity or Caparo v Dickman for duty of care. Building this skill now will save you hours of confusion later.

11. How to Approach Source-Based Questions |

WJEC assessment often presents you with a short scenario or legal source, then asks you to identify the relevant law and apply it. A reliable framework is IRAC: Issue, Rule, Application, and Conclusion. First, spot the legal issue the question raises. Then state the legal rule, citing the relevant statute or case. Next, apply the rule to the facts, pointing out where facts meet or miss the legal test. Finally, reach a clear, justified conclusion.

Practice is everything. During your summer work, try writing short IRAC answers to simple scenarios, such as 'Ahmed pushes Ben, who falls and breaks his wrist.' Think through: what offences could be charged? What is the actus reus and mens rea? Is there a defence? The more you practise, the more natural the legal reasoning process will become when you start Year 10.

12. Looking Ahead: Your Legal Journey |

As you embark on your GCSE Law course, remember that law is a living subject. It changes with new legislation and landmark rulings. Keep a legal news diary over the summer, noting any stories about criminal trials, court decisions, or parliamentary bills. This will sharpen your contextual awareness and provide excellent examples for your written answers.

Your summer bridging course has introduced you to the core concepts, from actus reus and mens rea to negligence and sentencing. The purpose was not to learn everything, but to build a mental framework onto which your Year 10 lessons can easily attach. Approach the year ahead with curiosity and confidence. Law rewards those who ask 'why' and who never stop refining their reasoning.
