1. What is Law? |
Law is a system of rules created and enforced by social or governmental institutions to regulate behaviour. It maintains order, protects individual rights, and provides a peaceful mechanism for resolving disputes. Without law, society would struggle with uncertainty and conflict.
Legal rules differ from moral or religious rules because they carry formal sanctions, such as fines or imprisonment, imposed by the state. The rule of law means that everyone, including government officials, is subject to the law.
2. Sources of Law |
In the English legal system, the main sources of law are statutes (Acts of Parliament), common law (judge-made law), and, to some extent, European Union law and international treaties. Statutes are created by the legislature and override common law when there is a conflict.
Common law develops through judicial decisions in courts, where precedents set by higher courts bind lower courts – this is the doctrine of judicial precedent. Equity also supplements common law by providing remedies like injunctions when monetary damages are inadequate.
3. The Court Hierarchy |
The English court system has a clear hierarchy. At the bottom are Magistrates' Courts and County Courts, then the Crown Court and High Court, followed by the Court of Appeal, and finally the Supreme Court, which is the highest domestic court.
Criminal cases typically start in the Magistrates' Court for less serious offences (summary offences), while serious crimes (indictable offences) are tried in the Crown Court before a judge and jury. Civil cases, such as contract or tort disputes, are heard in the County Court or High Court depending on the claim value and complexity.
| Court Level | Criminal Jurisdiction | Civil Jurisdiction |
|---|---|---|
| Magistrates' Court | Summary offences, some either-way | Limited (e.g., family proceedings) |
| Crown Court | Indictable offences, appeals | None |
| High Court | Appeals on points of law | Complex civil claims |
| Court of Appeal | Appeals from Crown Court | Appeals from High Court |
| Supreme Court | Final appeals on law | Final civil appeals |
4. Criminal Law: Actus Reus and Mens Rea |
For most crimes, the prosecution must prove two elements: the actus reus (the guilty act) and the mens rea (the guilty mind). The actus reus is the physical element – an action, omission, or a state of affairs prohibited by law. The mens rea is the mental element, such as intention, recklessness, or negligence.
An example is theft: the actus reus is the appropriation of property belonging to another, and the mens rea is the intention to permanently deprive the owner of it. Some crimes, known as strict liability offences, do not require proof of mens rea – simply committing the act is enough, such as speeding.
Actus reus must be voluntary and can include omissions if there is a legal duty to act.
Mens rea levels: direct intent, oblique intent, recklessness (subjective).
5. Tort Law: Negligence |
Tort law deals with civil wrongs where one person suffers harm due to another's breach of a legal duty. Negligence is the most common tort. To prove negligence, a claimant must establish that the defendant owed them a duty of care, breached that duty, and caused damage that was not too remote.
The modern duty of care was established in Donoghue v Stevenson (1932), where the “neighbour principle” was introduced: you must take reasonable care to avoid acts or omissions that could foreseeably injure your neighbour. A breach occurs when the defendant fails to meet the standard of the reasonable person.
Causation requires both factual causation (‘but for’ test) and legal causation (the damage must be a foreseeable consequence). The damage must not be too remote. Typical remedies include compensation (damages) to put the claimant back in their pre-tort position.
6. Contract Law: Formation – Offer, Acceptance, and Consideration |
A legally binding contract usually requires an offer, acceptance, and consideration, along with an intention to create legal relations. An offer is a clear statement of willingness to be bound on certain terms, made with the intention that it will become binding upon acceptance.
Acceptance must be a positive act mirroring the offer, communicated to the offeror. The postal rule is an exception: acceptance takes effect when the letter is posted, not when received. Consideration is the ‘price’ each party pays for the other’s promise – it must be sufficient but need not be adequate. For example, a peppercorn rent in a lease can be valid consideration.
In addition, the parties must intend to create legal relations; social and domestic arrangements are presumed not to create legal relations, while commercial agreements are presumed to do so.
7. Human Rights and the Rule of Law |
Human rights are basic rights and freedoms that belong to every person. In the UK, the Human Rights Act 1998 incorporated the European Convention on Human Rights (ECHR) into domestic law, allowing individuals to argue their Convention rights in UK courts. Key rights include the right to life (Article 2), the prohibition of torture (Article 3), the right to a fair trial (Article 6), and freedom of expression (Article 10).
The rule of law is a constitutional principle requiring that law governs a nation, as opposed to arbitrary decisions by individual government officials. It requires laws to be clear, publicised, applied equally, and adjudicated by independent courts. No one is above the law.
Balancing human rights with national security or public order is a key judicial function. For example, freedom of expression may be limited to protect the rights of others or for public safety, but any restriction must be proportionate.
8. Legal Personnel: Judges, Juries, and Lawyers |
The legal system relies on various personnel. Judges preside over court proceedings, decide questions of law, and give rulings. In the Crown Court, a judge also determines the sentence after a guilty verdict. Judges are appointed from experienced lawyers and are expected to be independent and impartial.
Juries are used in Crown Court trials for indictable offences and in some civil cases, such as defamation. The jury (usually 12 members) decides questions of fact and delivers a verdict based on the evidence. Jury service is a civic duty, and members are randomly selected from the electoral register.
Solicitors and barristers are the two main types of practising lawyers. Solicitors typically give legal advice to clients and prepare cases, while barristers specialise in advocacy and represent clients in higher courts. However, the traditional distinction has blurred, with some solicitors now obtaining rights of audience in higher courts.
