📚 Year 10 SQA Law: Formula & Theorem Quick Reference Handbook | SQA
Law may not look like a subject of numbers, but it has its own logical 'formulae' – legal principles, tests and doctrines that must be satisfied for a result to follow. Just as a scientist balances an equation, a lawyer must check whether each essential element is present. This quick reference handbook sets out the key 'legal equations' for crime, negligence, contract and evidence that every SQA Law student needs to master. Learning these structures will help you solve problem questions with confidence and precision.
1. The Basic Criminal Liability Equation |
In Scots criminal law, an accused can only be convicted if the prosecution proves three core ingredients beyond a reasonable doubt. Think of it as the fundamental formula of guilt.
ACTUS REUS (guilty act) + MENS REA (guilty mind) + CAUSATION → CRIMINAL LIABILITY
The actus reus is the physical element of the crime – the act, omission or state of affairs prohibited by law. Mens rea is the mental element, such as intention or recklessness. Causation links the accused's conduct to the harm. If any one element is absent, the equation does not balance and the accused is entitled to an acquittal.
2. Actus Reus in Detail |
The actus reus can take three main forms, and identifying the correct type is the first step in applying the liability formula.
- Conduct: a positive physical act, e.g. striking another person (assault).
- Omission: a failure to act where the law imposes a duty, e.g. a parent failing to feed a child.
- State of affairs: being found in a particular situation, even without a voluntary act, e.g. being drunk in charge of a vehicle. Scots law requires that the actus reus must be voluntary, but state-of-affairs offences create an exception.
Once the actus reus is identified, the next step is to prove it was caused by the accused – this brings us to causation, which is treated as a separate element in the formula above.
3. Mens Rea Types |
Mens rea is the mental attitude of the accused at the time of the act. Scots law recognises several distinct forms, each of which slots into the liability equation differently.
INTENTION (highest level) ⇌ RECKLESSNESS ⇌ NEGLIGENCE (lowest fault)
Intention means the accused acts purposefully to bring about the result. In murder, for example, the mens rea is ‘wicked intention to kill’ or ‘wicked recklessness’. Recklessness involves conscious disregard of an obvious and serious risk. A person who speeds through a crowded street showing utter disregard for life may be guilty of culpable homicide based on wicked recklessness. Negligence is a lower level of fault where a reasonable person would have foreseen the risk and taken care, but the accused did not. Some statutory offences require only negligence as the mens rea element.
4. Causation: Factual and Legal |
Causation is the invisible thread that ties the accused's conduct to the prohibited result. Without it, the equation remains incomplete. The prosecution must prove two aspects: factual causation and legal causation.
FACTUAL CAUSATION (‘but for’ test) + LEGAL CAUSATION (no novus actus interveniens) → RESPONSIBILITY FOR RESULT
Factual causation asks: but for the accused's act, would the harm have occurred? If the answer is ‘no’, the chain is established. Legal causation checks whether the accused's act was a substantial and operating cause at the time of the harm. The chain may be broken by a novus actus interveniens – an unforeseeable, independent event or third-party act that overtakes the original cause. For example, if a victim is negligently injured by the accused and then receives grossly negligent medical treatment that causes death, the medical negligence may break the causal chain if it is held to be a new and independent cause. However, if the original injury remains a significant contributing factor, the accused may still be held liable.
5. The Negligence Formula |
Delict is the Scots law of civil wrongs, and negligence is the most important head of liability. To establish a successful claim, the pursuer must prove each element in the following equation.
DUTY OF CARE + BREACH OF DUTY + CAUSATION + LOSS (damages) → DELICTUAL LIABILITY
Duty of care is established by the neighbour principle from Donoghue v Stevenson: one must take reasonable care to avoid acts or omissions that can reasonably be foreseen as likely to injure one's neighbour – anyone so closely and directly affected by the act. Breach of duty occurs when the defender's conduct falls below the standard of the reasonable person. The court asks: what would a reasonable person in the defender's position have done? If the defender did less, there is breach. Causation applies the same ‘but for’ test, and the loss must be of a kind that the law recognises, such as personal injury, property damage or economic loss in certain circumstances. All four elements must be present on the balance of probabilities.
6. Duty of Care: The Neighbour Principle |
The neighbour principle remains the cornerstone of the duty-of-care analysis. It transforms a moral idea into a legal test.
FORESEEABILITY OF HARM + PROXIMITY → DUTY OF CARE
Lord Atkin in Donoghue v Stevenson [1932] stated: 'You must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. Who then in law is my neighbour? Persons who are so closely and directly affected by my act that I ought reasonably to have them in contemplation.' The modern law refines this into a three-part test from Caparo Industries v Dickman: (1) was the harm reasonably foreseeable? (2) was there a relationship of sufficient proximity between pursuer and defender? (3) is it fair, just and reasonable to impose a duty? In Scotland, the approach is broadly similar, though the courts often return directly to the neighbour principle in straightforward personal-injury cases.
7. Contract Formation Equation |
A legally binding contract does not appear out of thin air; it requires the simultaneous presence of several essential elements. The following formula applies to most simple contracts in Scots law.
OFFER + ACCEPTANCE + CONSIDERATION (or a 'undertaking' in Scotland) + INTENTION TO CREATE LEGAL RELATIONS + CAPACITY → VALID CONTRACT
Offer: a clear statement of terms on which the offeror is willing to be bound. Acceptance: unconditional agreement to all the terms of the offer. In Scots law, a contract is normally formed at the moment acceptance is communicated. Consideration (English law) or in some Scots contexts a 'mutual obligation' each party must give something of value, though Scotland does not require consideration in the strict English sense; the idea of a mutual promise or 'undertaking' may suffice. Intention to create legal relations: the parties must intend their agreement to be legally enforceable. Social and domestic arrangements are presumed not to create legal relations, while commercial agreements are presumed to do so. Capacity: the parties must be legally capable of contracting, e.g. not under age or lacking mental capacity. If any element is missing, the contract may be void or voidable.
8. Burden and Standard of Proof |
Every legal equation is meaningless without rules about who must prove what and to what degree of certainty. The burden and standard of proof allocate the risk of failure.
PROSECUTION/PURSUER BEARS BURDEN → MUST REACH STANDARD → LIABILITY ESTABLISHED
In criminal cases, the presumption of innocence places the legal burden squarely on the prosecution. The standard is proof beyond a reasonable doubt. That means the evidence must be so strong that the only rational conclusion is guilt. In civil cases, the pursuer bears the legal burden on the facts necessary to establish the claim, and the standard is on the balance of probabilities – more likely than not. Sometimes an evidential burden shifts to the accused or defender to raise certain defences, but the ultimate legal burden remains on the party making the allegation. Memorising this distinction prevents confusion when you move between criminal and civil problem questions.
9. Strict Liability Exceptions |
Not all liability equations require proof of mens rea. Strict liability offences represent a deliberate departure from the standard formula, and the SQA course expects you to recognise them.
S REUS ONLY (no mens rea needed) + SPECIFIC STATUTORY PROVISION → STRICT LIABILITY OFFENCE
Strict liability is typically reserved for regulatory or public-welfare offences, such as health and safety breaches, food hygiene offences, or selling alcohol to a minor. In these cases, the prosecution need only prove that the prohibited act occurred; the accused's state of mind is irrelevant. The justification is that society requires high standards of care in certain activities and placing the burden of inquiry on the person carrying them out serves the public interest. However, strict liability is an exception and can only be created by Parliament through clear words in the statute. In an exam answer, you must always check whether an offence is one of strict liability before assuming that mens rea must be proven.
10. Key Legal Maxims as 'Theorems' |
Certain Latin maxims act as compact legal theorems that guide interpretation across branches of law. They are not equations in themselves, but they provide the theoretical underpinning for the rules above.
| Maxim (Theorem) | Meaning | Application |
|---|---|---|
| Actus non facit reum nisi mens sit rea | The act does not make a person guilty unless the mind is also guilty. | Foundation of the criminal liability equation. |
| Res ipsa loquitur | The thing speaks for itself. | In negligence, used to infer breach where the accident would not normally occur without negligence. |
| Volenti non fit injuria | To a willing person, no injury is done. | A defence to negligence where the pursuer freely and voluntarily accepted the risk. |
| Ignorantia juris non excusat | Ignorance of the law is no excuse. | Applies generally; a mistake of law does not provide a defence. |
These maxims capture centuries of judicial wisdom in a few words. Familiarity with them will help you explain the rationale behind the legal formulas you apply in problem-solving.
