📚 Case Analysis Practice Drill |
Case analysis is the beating heart of legal study. Whether you encounter a scenario about a dodgy contract, a negligent driver, or an assault outside a football ground, your task is always the same: read the facts, spot the legal issues, state the relevant rules, apply them logically, and reach a conclusion. This drill is designed to sharpen exactly those skills for Year 10 OCR Law students, walking you through a structured method and then testing you with realistic scenarios drawn from criminal law, tort law, and contract law.
1. The IRAC Framework | IRAC框架
Every successful case analysis begins with a clear structure. The IRAC method—Issue, Rule, Application, Conclusion—is the gold standard. First, you identify the legal question hidden in the facts. Next, you recite the relevant legal principle, including any case or statute authority. Then, you apply that rule to the given facts, step by step. Finally, you state the likely outcome in a firm, short sentence. Using IRAC ensures your answer is logical, complete, and examiner-friendly.
2. Spotting the Issue in Criminal Law |
In a criminal scenario, the issue usually revolves around whether the defendant is liable for a specific offence. Ask yourself: what actus reus elements are present? Is the act voluntary? Did the defendant cause the result? Is there a relevant omission? Then turn to mens rea: did the defendant intend the outcome, or were they merely reckless? For example, if Daniel pushes Liam, who falls backwards and fractures his skull, the issue is 'Did Daniel commit a non-fatal offence, and if so at what level—assault, battery, ABH, or GBH?'
3. Stating the Rule with Authority |
Never state a rule without backing it up. In OCR Law, you must refer to key cases and, where relevant, statutes. For a battery, cite Collins v Wilcock [1984]: 'any unlawful touching of another person without lawful excuse.' For ABH, rely on section 47 of the Offences Against the Person Act 1861 and the definition in R v Miller [1954] that the harm need not be permanent but must be 'more than transient and trifling.' A strong rule statement shows the examiner you know the law as it stands, not just a vague memory of it.
4. Applying the Law to Facts Methodically |
This is where the magic happens in a case analysis drill. Take each element of the offence and match it to a specific fact. If the actus reus of battery requires unlawful touching, highlight the fact: 'Daniel's hand made contact with Liam's chest.' If mens rea requires intention or recklessness, use the fact: 'Daniel shouted "watch this" before pushing, which indicates intention.' Avoid leaping to the conclusion; walk through every link in the chain. Examiners reward analytical bite, not storytelling.
5. Reaching a Confident Conclusion |
Your conclusion should flow naturally from your application. It is not a guess; it is a prediction based on legal reasoning. For the Daniel and Liam scenario, you might conclude: 'Daniel is likely to be found guilty of ABH under s47 OAPA 1861, as his intentional push caused a fractured skull, which amounts to actual bodily harm.' A weak conclusion sounds like 'maybe' or 'it depends' without reasoning. A strong one uses words like 'liable,' 'guilty,' or 'not liable', supported by the logic you have already built.
6. Drill Scenario One – The Broken Contract |
Facts: Amira offers to sell her vintage bicycle to Ben for £200. Ben says, 'I'll give you £150.' Amira refuses. Later that day, Ben posts a letter saying, 'I accept your offer of £200.' Before the letter arrives, Amira sells the bike to Chris. Ben is furious and wants to sue Amira for breach of contract.
7. Analysing the Contract Scenario |
Issue: Was there a binding contract between Amira and Ben for the sale of the bicycle? Rule: A valid acceptance must be communicated to the offeror. Under the postal rule (Adams v Lindsell [1818]), acceptance takes effect when the letter is posted, not when it is received. However, a counter-offer destroys the original offer (Hyde v Wrench [1840]). Application: Ben's reply of £150 was a counter-offer, which killed Amira's original £200 offer. Therefore, when Ben later tried to accept the original £200, that offer no longer existed. Ben's posted acceptance was ineffective because there was no standing offer to accept. Conclusion: No contract was formed. Ben is unlikely to succeed in a claim for breach of contract.
8. Drill Scenario Two – The Slippery Floor |
Facts: Maya runs a corner shop. One rainy afternoon, a customer, Jake, walks in with wet shoes and slips on the floor, breaking his arm. There was a yellow warning sign near the door, but it had fallen over and was not visible. Maya had checked the floor 20 minutes earlier. Jake sues Maya in the tort of negligence.
9. Walking Through Negligence – Duty, Breach, Damage |
Issue: Is Maya liable in negligence for Jake's injury? Rule: For negligence, the claimant must prove duty of care, breach of that duty, and damage caused by the breach. The neighbour principle from Donoghue v Stevenson [1932] establishes that occupiers owe a duty to lawful visitors. Under the Occupiers' Liability Act 1957, an occupier must take reasonable care to see that visitors are reasonably safe. Application: Maya owed Jake a duty. She breached it because a fallen sign is as good as no sign; a reasonable shopkeeper would ensure warnings remain visible. The floor was wet, a foreseeable risk on a rainy day. Jake's broken arm is a direct physical injury caused by the slip. Conclusion: Maya is likely liable in negligence or under the 1957 Act.
10. Drill Scenario Three – The Borrowed Jacket |
Facts: Tariq asks his neighbour, Sasha, if he can borrow her expensive leather jacket for a party. Sasha says, 'Fine, but you must return it by Sunday.' Tariq takes the jacket. On Saturday, he sells it to a stranger for cash. When Sunday comes, he tells Sasha the jacket was stolen. Sasha later finds out the truth and calls the police.
11. Theft Act 1968 – Intention to Permanently Deprive | 1968
Issue: Has Tariq committed theft? Rule: Under s1 Theft Act 1968, theft is the dishonest appropriation of property belonging to another with intention to permanently deprive. 'Appropriation' includes assuming the rights of an owner (s3). Selling the item clearly does this. Dishonesty is judged by the standards of ordinary people, subject to the Ivey v Genting Casinos [2017] test. Intention to permanently deprive is satisfied if Tariq treats the jacket as his own to dispose of regardless of Sasha’s rights. Application: Tariq appropriated the jacket by selling it. Selling is a dishonest act by ordinary standards; taking cash for a borrowed item is clearly dishonest. By selling it to a stranger, he showed intention to permanently deprive Sasha of it. The fact he lied about the theft reinforces this. Conclusion: Tariq is likely guilty of theft contrary to s1 Theft Act 1968.
12. Mastering the Drill – Tips for Exam Success |
Practice under timed conditions. Give yourself 12 minutes per scenario. Always write out IRAC headers even if the exam doesn't require them—this disciplines your thinking. Build a mental bank of key case names and the legal principle each one stands for. When you read a scenario, actively highlight or underline facts that match actus reus, mens rea, or contractual elements. Finally, remember that the stronger your application, the more inevitable your conclusion appears. A well-drilled case analysis is the difference between a grade 4 and a grade 8.
