📚 Year 10 CCEA Law: Quick Reference Guide to Key Principles | Year 10 CCEA

This quick reference handbook brings together the essential legal principles, rules, and definitions that every Year 10 student following the CCEA Law specification needs to know. Think of it as your 'formula book' for law — a collection of structured summaries designed to make revision easier and to help you apply legal concepts with confidence. Each entry is presented as a concise pair: an English explanation immediately followed by a Chinese translation, so you can grasp both the language of the law and its meaning.

1. The Rule of Law |

The rule of law means that no one is above the law, and everyone must follow the same legal rules. It ensures that power is exercised within a legal framework and that individuals' rights are protected against arbitrary government action. Key features include equality before the law, an independent judiciary, and access to justice for all.

The principle is traditionally traced to A.V. Dicey, who identified three core elements: the absence of arbitrary power, equality under the ordinary law, and the protection of fundamental rights through the common law.

2. Sources of Law |

English law comes from several sources. Primary legislation refers to Acts of Parliament, while secondary legislation consists of regulations made by government ministers using powers given by an Act. Judge-made law, known as common law, develops through decided cases and the doctrine of precedent. European Union law was historically significant, and although the UK has left the EU, retained EU law remains relevant under the Withdrawal Agreement.

Equity is another source, originally developed by the Court of Chancery to provide remedies where the common law was too rigid, such as injunctions and specific performance.

3. The Doctrine of Precedent (Stare Decisis) |

The doctrine of precedent means that courts must follow decisions made in higher courts in previous cases with similar facts. This promotes consistency and fairness. The Latin term 'stare decisis' translates to 'stand by things decided'.

When a decision is binding, the lower court must apply the rule. When it is merely persuasive, a court may consider it but is not obliged to follow it. Decisions from the Privy Council or courts in other common law jurisdictions often serve as persuasive authority.

4. Statutory Interpretation Rules |

When courts interpret the words of an Act of Parliament, they apply certain rules. The literal rule requires the judge to give words their plain, ordinary meaning, even if the outcome seems harsh. The golden rule allows the court to avoid an absurd result that would arise from the literal meaning. The mischief rule examines what problem the Act was intended to fix, and interprets words to suppress that mischief.

The purposive approach goes further: judges look at the overall purpose of the Act and interpret words to best achieve that purpose. This is influenced by European methods and is widely used in cases involving human rights or EU-retained law.

Literal → Golden → Mischief → Purposive (increasing judicial discretion)

5. The Hierarchy of Courts |

Understanding the court structure is essential for determining which decisions are binding on which courts. The Supreme Court is the highest court in the United Kingdom; its decisions bind all lower courts. The Court of Appeal has two divisions — Civil and Criminal — and its decisions are binding on the High Court and below, and are usually followed by the Court of Appeal itself.

The High Court is divided into three divisions: King's Bench, Chancery, and Family. High Court decisions are binding on County Courts and Magistrates' Courts, but the High Court is not bound by its own previous decisions, although they are highly persuasive. The Crown Court mainly handles indictable criminal cases and appeals from Magistrates' Courts.

6. Elements of a Crime: Actus Reus and Mens Rea |

For most criminal offences, two things must be proved: the actus reus (guilty act) and the mens rea (guilty mind). Actus reus refers to the physical element of the crime — the conduct, the consequence, or the circumstances that make the act illegal. Mens rea is the mental element, such as intention, recklessness, or negligence.

Intention means the defendant had it as his purpose to bring about the prohibited result. Recklessness is the conscious taking of an unjustified risk. Negligence is a failure to meet the standard of a reasonable person, and in criminal law it usually requires a high degree of carelessness.

Actus non facit reum nisi mens sit rea — An act does not make a person guilty unless the mind is also guilty.

7. The Law of Negligence |

Negligence is a tort that allows a person to claim compensation when they have suffered injury or loss due to someone else's failure to take reasonable care. To succeed, the claimant must establish three elements: a duty of care, a breach of that duty, and damage caused by the breach (causation).

The 'neighbour principle' from Donoghue v Stevenson [1932] established that you must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. Today, the three-part test in Caparo v Dickman [1990] is used: foreseeability of damage, proximity between the parties, and whether it is fair, just and reasonable to impose a duty.

Breach of duty compares the defendant's conduct with the standard of the reasonable person. Causation requires both factual causation (the 'but for' test) and legal causation (the damage must not be too remote).

8. Basic Contract Law: Offer, Acceptance and Consideration |

A legally binding contract requires an offer, acceptance, consideration, and the intention to create legal relations. An offer is a clear statement of the terms on which the offeror is willing to be bound. It must be distinguished from an invitation to treat, which is merely an invitation to make an offer, such as goods displayed on a shelf.

Acceptance must be unconditional and communicated to the offeror. The postal rule states that acceptance by post takes effect when the letter is posted, not when it is received. However, modern communications methods may require different rules.

Consideration is the 'price' each party pays for the other's promise. It must be sufficient but need not be adequate — in other words, the court does not assess whether a good bargain was made, only that something of value in the eyes of the law was exchanged.

9. Police Powers and Individual Rights |

Police powers in Northern Ireland (and across the UK) are regulated primarily by the Police and Criminal Evidence (Northern Ireland) Order 1989, known as PACE. It balances the need to investigate crime with the protection of civil liberties. Powers include stop and search, arrest, detention, and questioning, each subject to strict safeguards.

To carry out a lawful stop and search, an officer must have reasonable grounds for suspicion. The search must be in a public place and the officer must give their name, station, and reason. A blanket stop and search power under section 60 of the Criminal Justice and Public Order Act 1994 allows searches without reasonable suspicion in certain circumstances, but this is controversial.

Upon arrest, a person must be told the grounds for arrest and the fact that they are under arrest. PACE Codes of practice set out the treatment of detainees, including rights to legal advice, notification of a friend or relative, and limits on detention without charge.

10. Human Rights Act 1998 | 《1998

The Human Rights Act 1998 incorporated the European Convention on Human Rights (ECHR) into UK domestic law. It allows individuals to bring cases concerning Convention rights directly in UK courts, rather than having to go to the European Court of Human Rights in Strasbourg. Key rights include the right to life (Article 2), prohibition of torture (Article 3), right to a fair trial (Article 6), and respect for private and family life (Article 8).

Section 3 requires courts to read and give effect to legislation in a way which is compatible with Convention rights, 'so far as it is possible to do so'. If a higher court finds that primary legislation cannot be read compatibly, it may issue a declaration of incompatibility under section 4. This does not strike down the law but sends a signal to Parliament to amend it.

ArticleRightQualification
2Right to lifeAbsolute in substance, with limited exceptions for lawful acts of war or in defence of others.
5Right to libertyDeprivation allowed only on specified grounds, e.g. lawful arrest or detention of a minor for educational supervision.
8Respect for private and family lifeQualified right — can be limited if necessary in a democratic society for national security, public safety, etc.

11. The Jury System |

Trial by jury is a cornerstone of the criminal justice system. Juries are used in the Crown Court for trials on indictment and in a few civil cases, such as defamation. The principle is that a group of ordinary citizens should decide the facts and deliver a verdict based on the evidence, while the judge directs them on the law.

Jurors must be aged between 18 and 75, registered as a parliamentary or local government elector, and ordinarily resident in the UK for at least five years since the age of 13. Certain individuals are disqualified, including those with serious criminal convictions or mental health issues that make them unsuitable.

A jury normally consists of 12 people, and their verdict should be unanimous. After two hours of deliberation, a majority verdict may be accepted: 11-1 or 10-2 in standard cases, or 10-0 in cases where the jury has been reduced to 11 or 10 members. The judge cannot direct a jury to convict; the role of the jury is to assess the weight of the evidence independently.

12. Key Defences in Criminal Law |

A defence provides a legal argument that, even if the prosecution proves the actus reus and mens rea, the defendant should not be convicted. Defences can be complete, resulting in acquittal, or partial, reducing a murder charge to voluntary manslaughter. Self-defence, duress, necessity, insanity, and automatism are among the most tested defences at GCSE level.

Self-defence (and the defence of others) permits the use of reasonable force in defence of oneself or another. The force must be proportionate to the threat as the defendant genuinely believed it to be. Even a mistaken belief may be relied upon if it is honest.

Duress by threats occurs when a person commits a crime because they were threatened with death or serious violence. It is not a defence to murder or attempted murder. Duress of circumstances is similar but arises from a situation rather than a specific threat from a person.

For insanity, the M'Naghten rules require the defendant to prove that, at the time of the act, they were suffering from a defect of reason caused by a disease of the mind, so that they did not know the nature and quality of the act, or did not know it was wrong. The special verdict is 'not guilty by reason of insanity'.
