1. Understanding Case Analysis in Law |
Case analysis is not about simply describing the law; it is about applying legal principles to specific facts. You need to demonstrate how the law operates in a given situation. This skill is tested across criminal, tort, and contract questions. Always read the scenario twice, underline key facts, and identify every possible legal issue before writing.
2. The IRAC Method: A Structured Approach | IRAC
IRAC stands for Issue, Rule, Application, and Conclusion. It is the most widely recommended framework for answering legal problem questions. First, identify the legal issue(s). Second, state the relevant legal rule, citing statute or case law where possible. Third, apply the rule to the facts, discussing both sides if the outcome is uncertain. Finally, reach a clear conclusion. This method keeps your answer logical and examiner-friendly.
3. Criminal Law: Assault and Battery |
Scenario: John raises his fist and moves towards Peter, shouting "I will hit you!" Peter backs away, trips on a kerb, and sustains a bruised knee. Discuss John's criminal liability for assault and battery.
Issue: Whether John has committed assault and/or battery.
Rule: An assault is any act that intentionally or recklessly causes the victim to apprehend immediate unlawful force. A battery is the intentional or reckless application of unlawful force to another. The actus reus of assault is causing apprehension of immediate violence; for battery, it is the actual infliction of force. Mens rea for both is intention or subjective recklessness.
Application: John's raised fist and aggressive movement, combined with his words, clearly caused Peter to apprehend immediate unlawful force. This satisfies the actus reus of assault. John intended to cause that apprehension, thus mens rea is present. However, Peter's injury resulted from his own tripping, not from force applied by John. There is no direct or indirect application of force by John, so battery is not made out. The fact that Peter sustained a bruise does not automatically mean battery; the force must come from the defendant.
Conclusion: John is criminally liable for assault. He is not liable for battery.
4. Criminal Law: Theft and Mens Rea |
Scenario: Sarah sees a bicycle left unlocked outside a supermarket. She genuinely believes it has been abandoned because it looks rusty. She takes it home, cleans it, and later sells it for £50. The original owner reports the theft. Discuss Sarah's liability for theft.
Issue: Whether Sarah is liable for theft under s.1 Theft Act 1968.
Rule: Theft is the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. Dishonesty is defined partially by s.2, which states that a person is not dishonest if they believe they have the legal right to the property, or that the owner would consent if they knew, or that the property has been abandoned. The belief does not need to be reasonable, but it must be genuinely held.
Application: Sarah appropriated property belonging to another by taking the bicycle. She intended to keep it permanently, as shown by her selling it. The key question is whether she acted dishonestly. She believed the bicycle was abandoned because it looked rusty and was left unlocked. If this belief was genuinely held, she falls within the s.2 exception and is not dishonest. The prosecution must prove that she was dishonest; if the magistrates accept her claim of genuine belief, no theft is committed. Even if her belief was unreasonable, it could still be genuine. However, if the facts suggest she merely hoped it was abandoned without truly believing it, she would be dishonest.
Conclusion: If Sarah genuinely believed the bicycle was abandoned, she is not liable for theft. If her belief was not genuine, she would be guilty.
5. Tort Law: Negligence and Duty of Care |
Scenario: David is driving while checking his phone, fails to see a red light, and strikes a pedestrian, Emma, who is crossing legally. Emma suffers a broken leg and lost income. Advise Emma on a claim in negligence.
Issue: Is David liable in the tort of negligence?
Rule: To establish negligence, the claimant must prove: (1) the defendant owed them a duty of care; (2) the defendant breached that duty by falling below the standard of a reasonable person; (3) the breach caused damage which is not too remote. The duty of care test comes from Donoghue v Stevenson: you must take reasonable care to avoid acts or omissions that you can reasonably foresee would be likely to injure your neighbour.
Application: David, as a road user, clearly owes a duty of care to other road users, including pedestrians like Emma. By using his phone, he failed to meet the standard of a reasonable driver, thus breaching his duty. His breach directly caused the collision and Emma's injuries; but for his phone use, he would have stopped at the red light. The broken leg and loss of income are foreseeable types of harm and not too remote. Emma can also claim for financial losses caused by the physical injury.
Conclusion: Emma is likely to succeed in a negligence claim and recover compensation for her injuries and financial losses.
6. Contract Law: Offer and Acceptance |
Scenario: On Monday, Alice emails Bob: "I offer to sell you my laptop for £200, this offer is open until Friday." On Thursday afternoon, Bob replies by email: "I accept your offer." On Friday morning, Alice sees Bob's email but immediately replies: "Sorry, I changed my mind, laptop no longer for sale." Discuss whether a binding contract exists.
Issue: Was there a valid contract formed between Alice and Bob?
Rule: A contract requires a clear offer, acceptance communicated before any revocation, consideration, and intention to create legal relations. An offer can be revoked at any time before acceptance is communicated, but once valid acceptance occurs, a contract is formed. The postal rule does not apply to instantaneous communications like email; acceptance is effective when it is received. The offeror can specify the method of acceptance.
Application: Alice made a clear offer, stating it was open until Friday. Bob accepted on Thursday afternoon, and his email arrived in Alice's inbox, likely constituting communication of acceptance when it was received (or when she could reasonably be expected to read it). The offer remained open and had not been revoked by Thursday. Alice's attempted revocation on Friday morning came after acceptance was already communicated. Therefore, a binding contract was formed on Thursday upon receipt of the acceptance. The fact that Alice later changed her mind is irrelevant; she has breached the contract.
Conclusion: A valid contract was formed on Thursday, and Alice cannot simply withdraw. Bob could sue for breach of contract.
7. Contract Law: Breach and Remedies |
Scenario: Tom contracts to deliver 100 textbooks to Lisa's bookshop by Monday for £500. Tom delivers only 80 books at 11:00 on Tuesday. Because of the delay and shortfall, Lisa loses a £200 customer order. Advise Lisa on remedies for breach of contract.
Issue: What remedies are available to Lisa for Tom's breach?
Rule: Breach of contract entitles the innocent party to damages to put them in the position they would have been in had the contract been performed. Damages can be based on expectation loss and consequential loss, provided the loss is not too remote (Hadley v Baxendale). The court may also consider whether the breached term was a condition or warranty; a breach of condition allows termination of the contract, while breach of warranty allows only damages.
Application: Tom's failure to deliver the correct quantity and to deliver on time likely amounts to a breach of condition, as time and quantity are essential in a commercial delivery. Lisa could terminate the contract and claim damages. Her expectation loss is the £500 value of the undelivered 20 books, or the cost of buying them elsewhere. She can also claim for the £200 lost customer order as consequential loss, provided this loss was in the reasonable contemplation of the parties when the contract was made. If Tom knew the order was for a specific customer, the loss would be recoverable. Lisa should also deduct any amount she still owes Tom for the 80 books delivered.
Conclusion: Lisa can claim damages for the undelivered books and potentially the lost customer order. She may also have the right to treat the contract as terminated.
8. Defences in Criminal Law: Self-Defence |
Scenario: In a pub, Paul suddenly punches Mike in the chest without warning. Mike, feeling threatened, immediately punches Paul hard in the face, breaking his jaw. Mike did not know if Paul would hit him again. Discuss Mike's criminal liability and the defence of self-defence.
Issue: Can Mike rely on self-defence to avoid liability for causing grievous bodily harm?
Rule: Self-defence is available where a person uses reasonable force to protect themselves from an unjustified attack. The force must be necessary and proportionate in the circumstances as the defendant honestly believed them to be. Even if the belief is mistaken, it may still be valid if honestly held. Pre-emptive strikes can qualify as long as the danger is imminent.
Application: Paul's punch was an unjustified attack, and Mike honestly believed he was under threat. He reacted instantly. The question is whether breaking Paul's jaw with a single punch was reasonable force in the heat of the moment. The court will not weigh with nicety the exact force used; it will consider whether a reasonable person in Mike's situation would have thought that degree of force was necessary. Because Paul initiated the attack and Mike could not be sure the attack was over, a punch may be proportionate. However, the severity of the injury might suggest excessive force if he continued after the threat ceased or used disproportionate retaliation. On these facts, a single reactive punch is likely to be considered reasonable self-defence.
Conclusion: Mike is likely to be acquitted on the basis of self-defence, provided the force was not grossly disproportionate.
9. Tort Law: Private Nuisance |
