1. The General Criminal Liability Formula |
Criminal liability in English law is typically built on a simple two-part structure. The prosecution must prove that the defendant committed a guilty act with a guilty mind, unless a defence applies.
Actus Reus + Mens Rea – Defence = Crime
The actus reus can be an act, an omission (in limited circumstances), or a state of affairs. The mens rea varies by offence and may include intention, recklessness, or negligence.
2. Murder: The Unlawful Killing Formula |
Murder is a common law offence with a classic definition. For a defendant to be guilty, the killing must be unlawful, of a reasonable person in being, and carried out with malice aforethought.
Unlawful Killing + Human Being + Malice Aforethought = Murder
Malice aforethought means an intention to kill or an intention to cause grievous bodily harm (GBH). Recklessness as to whether death or GBH is caused is not sufficient; intention is key.
3. Voluntary Manslaughter: Defences to Murder |
If the elements of murder are satisfied but a special partial defence applies, the defendant will be convicted of voluntary manslaughter instead. The two main defences are diminished responsibility and loss of control.
Murder – Diminished Responsibility = Voluntary Manslaughter
Murder – Loss of Control = Voluntary Manslaughter
Diminished responsibility requires an abnormality of mental functioning arising from a recognised medical condition which substantially impairs the defendant's ability to understand the nature of their conduct or form a rational judgment. Loss of control requires a loss of self-control attributable to a qualifying trigger and that a person of the same sex and age with a normal degree of tolerance and self-restraint might have done the same.
4. Assault: The Apprehension Formula |
Assault (as a common assault) does not require physical contact. The actus reus is causing the victim to apprehend immediate, unlawful force. The mens rea is intention or recklessness as to causing such apprehension.
ct causing apprehension + Immediate unlawful force + (Intention or Recklessness) = Assault
Words alone can amount to an assault, but they can also negate an assault if they clarify that no force will actually be used. Silent telephone calls may also constitute an assault if they cause the victim to fear immediate personal violence.
5. Battery: The Unlawful Touching Formula |
Battery requires actual physical contact. The actus reus is the application of unlawful force to another person, no matter how slight. The mens rea is intention or recklessness as to applying such force.
Application of unlawful force + (Intention or Recklessness) = Battery
Touching a person's clothing while it is being worn can amount to battery. The force does not need to be hostile in nature; any undesired touching which is more than everyday jostling can be unlawful.
6. Section 47 Assault: Actual Bodily Harm (ABH) |
ABH is a more serious offence under the Offences Against the Person Act 1861. It is constructed by adding the consequence of "actual bodily harm" to an assault or battery. No extra mens rea is needed beyond that for the original common assault.
Assault/Battery + (Occasioning) + Actual Bodily Harm = S47 ABH
Actual bodily harm includes any hurt or injury calculated to interfere with the health or comfort of the victim, such as bruises, scratches, and psychiatric injury recognised by medical science. Temporary loss of consciousness can also qualify.
7. Section 20 and Section 18: Grievous Bodily Harm (GBH) and Wounding |
GBH offences are structured by the severity of harm and the mens rea. Section 20 (malicious wounding/inflicting GBH) requires a lighter mens rea — intention or recklessness as to some harm, even minor. Section 18 (wounding/causing GBH with intent) demands specific intent.
Wounding/GBH + (Intention or Recklessness as to some harm) = S20 Offence
Wounding/GBH + Intention to cause GBH or resist arrest = S18 Offence
A wound requires the breaking of both layers of the skin, the dermis and epidermis. GBH means "really serious harm", which can include broken bones, severe psychiatric harm, and serious infections. The jury decides whether the harm is really serious.
8. Contract Formation: The Basic Equation |
A legally binding contract relies on several essential ingredients. Without all of them, an agreement may not be enforceable through the courts. This formula encapsulates the fundamental requirements of English contract law.
Offer + Acceptance + Consideration + Intention to Create Legal Relations = Contract
The offer must be clear and communicated, distinguishing it from an invitation to treat. Acceptance must mirror the offer exactly and be communicated. Consideration is something of value exchanged between the parties, and the intention to create legal relations is presumed in commercial contexts but not in social or domestic agreements.
9. The "But For" Test: Factual Causation | “要不是”测试:事实因果关系
In both criminal law and the tort of negligence, the claimant or prosecution must establish a factual link between the defendant's act or omission and the harm suffered. The starting point is the 'but for' test.
But for the defendant's breach/act, would the harm have occurred? No → Causation established.
If the harm would have happened anyway regardless of the defendant's conduct, factual causation fails. This test is vital in establishing the actus reus of result crimes and the breach section of negligence.
10. Negligence: The Tort Liability Formula |
To succeed in a claim for negligence, a claimant must prove three core elements. The law requires that the defendant owed a duty of care, breached that duty, and caused damage which is not too remote.
f Care + Breach of Duty + (Causation & Remoteness of Damage) = Successful Negligence Claim
The duty of care is established using the Caparo three-part test: foreseeability of damage, proximity, and whether it is fair, just and reasonable to impose a duty. Breach is measured against the objective standard of the reasonable person. Causation must satisfy both the "but for" test and the legal principle that the harm must not be too remote a consequence.
11. Consideration: The Exchange Formula |
Consideration is the price one party pays for the other's promise. It must move from the promisee but need not be adequate. The law looks for sufficient value, not equivalence. This formula helps to understand past consideration and performance of existing duties.
thing of Value in Return (Sufficient but not necessarily Adequate) = Enforceable Agreement
Past consideration is generally not good consideration; the act or forbearance must be given in exchange for the promise. Performance of an existing public duty or a contractual duty already owed to a third party may constitute good consideration if practical benefit is shown.
12. The Defence of Intoxication: The "Dutch Courage" Formula |
Intoxication is not a general defence but can negate mens rea for specific intent crimes if the intoxication was involuntary. Voluntary intoxication may provide a partial defence if it leads to a mistake, but the law distinguishes between specific and basic intent offences.
Voluntary Intoxication + Basic Intent Crime = No Defence
ntoxication + Specific Intent Crime (if incapable of forming mens rea) = Reduced Liability
Dutch courage, where a person drinks to summon the nerve to commit a crime, is no defence at all because the mens rea was formed before the intoxication. The law treats the defendant as having the required intent at the time of the act.
