📚 Year 9 SQA Law: Formula & Theorem Quick Reference Guide | SQA
Welcome to the quick reference guide for SQA Law at Year 9 level. While law is not typically a subject of mathematical formulas, several legal principles can be expressed as simple 'formulas' or theorems to help you remember key concepts. This guide translates fundamental rules of Scots law into easy-to-memorise equations. Knowing these building blocks will support your understanding of criminal law, delict, contract, and the Scottish legal system.
1. The Sources of Law in Scotland |
Scottish law comes from two main sources: legislation passed by the UK Parliament and the Scottish Parliament, and judicial precedent created by court decisions. The formula is straightforward.
Legislation (Statute) + Judicial Precedent = Scots Law. Acts of Parliament, such as the Criminal Justice (Scotland) Act 2016, and acts of the Scottish Parliament, like the Children (Scotland) Act 1995, form the written law. Precedent, or case law, develops when judges interpret statutes and apply rules from earlier cases, especially from the High Court of Justiciary in criminal matters and the Court of Session in civil matters.
2. The Crime Formula |
In Scots criminal law, proving a crime generally requires two elements. The formula is fundamental.
Actus Reus + Mens Rea = Crime. Actus Reus refers to the guilty act: the physical conduct, omission, or state of affairs prohibited by law. Mens Rea refers to the guilty mind: the mental state the accused had at the time of the act, such as intention, recklessness, or in some cases negligence. Both must be present for most crimes, and the prosecution must prove each beyond reasonable doubt.
3. Strict Liability Theorems |
Some offences do not require the prosecution to prove Mens Rea. These are known as strict liability offences, and they are common in regulatory law.
Strict Liability Offence: Actus Reus + No Need for Mens Rea = Guilt. In these cases, simply committing the prohibited act is enough to establish liability. Examples include many traffic offences, selling alcohol to a minor, and certain food safety violations. The accused’s intention or state of mind is irrelevant, although defences such as due diligence may apply.
4. The Caparo Test for Duty of Care | 注意义务的 Caparo 测试
In the law of delict (the Scots law equivalent of tort), establishing negligence requires a duty of care. The Caparo test provides a three-part formula to determine whether such a duty exists.
Duty of Care = Foreseeability of Harm + Proximity + Fair, Just and Reasonable. First, the harm must be a foreseeable consequence of the defender's actions. Second, there must be a sufficient relationship of proximity between the parties. Third, the court must consider it fair, just and reasonable to impose a duty. This test comes from the English case Caparo v Dickman and is persuasive in Scotland.
la then becomes: Duty of Care + Breach of Duty + Causation + Damage = Delictual Liability.
5. Contract Formation Equation |
The rules for making a legally binding contract in Scotland are similar to those in other common law systems, with one key difference regarding promise.
e + Intention to Create Legal Relations + Consideration (or Unilateral Promise) = Contract. An offer is a clear expression of willingness to contract on certain terms. Acceptance must be a final and unconditional agreement to those terms. The parties must intend to be legally bound. In Scots law, a contract can be formed without consideration if a promise is made in writing and intended to be binding, a distinct feature from English law.
6. Interpretation of Statutes |
When courts apply Acts of Parliament, they often need to interpret the words. There are three main 'rules' or approaches, functioning like formulas for finding meaning.
Statute + Interpretation Approach = Meaning. The Literal Rule gives words their ordinary dictionary meaning, even if the result seems harsh. The Golden Rule allows a departure from the literal meaning when it would lead to an absurdity. The Mischief Rule looks at the problem (mischief) the statute was designed to remedy and interprets words to suppress that mischief. Courts may also use internal and external aids to interpretation.
7. Defences in Criminal Law |
Even if the prosecution proves the basic crime formula, the accused may have a defence. Defences can be procedural or substantive.
Valid Defence → Acquittal or Reduced Sentence. Common defences in Scots law include self-defence, which arises when the accused used reasonable force to protect themselves or another. Alibi is a special defence that must be notified before trial; it states the accused was elsewhere. Mental disorder, automatism, and coercion are other examples. Intoxication is generally not a defence except when it causes automatism. Special defences must be lodged in advance.
8. The Children's Hearings System |
Scotland has a unique welfare-based system for dealing with children who may need care or protection, or who have offended. The process follows a clear formula.
Referral to the Children's Reporter + Grounds Established (or Accepted) = Children's Hearing Decision. A referral can be made by police, social work, or education. The Reporter decides whether there is enough evidence and whether a hearing is necessary. If grounds for referral are not accepted, the case may go to the sheriff court for proof. Once grounds are established, a panel of lay volunteers decides on a disposal, such as supervision requirement, which aims to support the child's welfare.
9. Human Rights and the Scotland Act |
The Human Rights Act 1998 and the Scotland Act 1998 give effect to the European Convention on Human Rights (ECHR) in domestic law. They create a formula for challenging incompatible law or actions.
ECHR Rights + Scotland Act Duties = Potential Legal Challenge. Public authorities, including the Scottish Government and courts, must act in a way that is compatible with Convention rights. Legislation must be read and given effect in a way that is compatible with Convention rights so far as it is possible to do so. If a person's rights are breached, they may bring proceedings against the public authority. The courts can make a declaration of incompatibility, which triggers a political remedy.
10. The Verdict Theorem in Scots Criminal Trials |
The Scottish criminal jury has three possible verdicts, a unique feature compared to most other legal systems. This can be captured in a verdict formula.
Proven + Not Proven + Not Guilty = Three Verdict System. A verdict of 'guilty' (sometimes referred to as 'proven' historically) means the prosecution has proved its case. 'Not guilty' means the Crown failed to meet the standard of proof. 'Not proven' also results in acquittal, meaning the accused is free to leave, but it is often viewed as indicating the jury believed the accused was guilty but the evidence was insufficient. A simple majority of jurors is sufficient for a verdict.
11. The Rule of Law Formula |
The rule of law is a foundational constitutional principle. It can be expressed as a formula that underpins the entire legal system.
ernment According to Law + Access to Justice + Fundamental Rights Protection = Rule of Law. This requires that everyone, including the government, is subject to the law. Citizens must have access to courts and fair procedures. The law must protect fundamental rights, such as liberty and a fair trial. In Scotland, the rule of law is reinforced by the independence of the judiciary and the requirement that the Scottish Government acts within the powers given by the Scotland Act.
12. Evidence and Presumption of Innocence |
The most important protection for an accused person is the presumption of innocence. This is a crucial theorem in criminal procedure.
Accused Person = Innocent (Until Proven Guilty Beyond Reasonable Doubt). The prosecution bears the burden of proof. The accused does not have to prove their innocence. The standard of proof is 'beyond reasonable doubt', meaning the jury or judge must be satisfied so that they are sure of guilt. If there is a reasonable doubt, the verdict must be one of acquittal. This principle is a cornerstone of fair justice in Scotland.
