2. The English Legal System: Courts |
The English legal system is structured as a hierarchy, where lower courts deal with less serious cases and higher courts hear appeals and complex matters. The main criminal courts are the Magistrates' Court (for summary offences such as minor assaults) and the Crown Court (for indictable offences like robbery or murder). Civil disputes start in the County Court or the High Court, depending on the value and complexity of the claim. The court hierarchy can be visualised as follows:
| Court Level | Criminal Cases | Civil Cases |
|---|---|---|
| Supreme Court | Final appeal on point of law | Final appeal on point of law |
| Court of Appeal | Appeals against conviction/sentence | Appeals from High Court and County Court |
| High Court | Judicial review; case stated appeals | Complex or high-value claims (Queen's Bench, Chancery, Family) |
| Crown Court / County Court | Trials for indictable offences | Most civil trials; fast track and multi-track |
| Magistrates' Court | Summary trials; preliminary hearings | Minor civil matters (e.g. some family) |
Appeals travel up the hierarchy, and a key principle is that the decisions of higher courts bind lower courts under the doctrine of judicial precedent. For instance, a Supreme Court ruling must be followed by the Court of Appeal and all courts below.
3. Sources of Law: Statute and Precedent |
Law in England and Wales comes primarily from two sources: statute law, created by Parliament through Acts, and common law, developed by judges through case decisions. Statutes are the supreme form of law; if a statute contradicts a common law rule, the statute prevails. Courts interpret statutes using rules of interpretation such as the literal rule, the golden rule and the mischief rule.
Judicial precedent, also known as stare decisis, requires judges to follow the legal principles established in previous cases. The binding part of a judgment is the ratio decidendi (the reason for the decision), while any remarks made 'by the way' are obiter dicta and are persuasive, not binding. Original precedent arises when a court decides a case for the first time where there is no existing authority – the famous case of Donoghue v Stevenson [1932] created the neighbour principle in negligence, a classic example of original precedent.
4. Legal Personnel: Judges, Solicitors and Barristers |
The legal profession in England and Wales is divided into several key roles. Solicitors provide legal advice and prepare cases, usually having the first contact with clients. Barristers specialise in advocacy and represent clients in the higher courts; many still work from chambers and take instructions from solicitors. Judges preside over courts, ensure a fair trial and, in senior courts, give reasoned judgments that may create precedent.
Key judicial roles you will study include magistrates (unpaid volunteers who hear summary cases), District Judges in the County Court, Circuit Judges in the Crown Court, High Court Judges, Lord Justices of Appeal and the Justices of the Supreme Court. Understanding who does what in the legal system will help you navigate case reports and appreciate how trials and appeals operate.
5. Introduction to Criminal Law |
Criminal law deals with conduct that the state considers harmful to society. A defendant is prosecuted by the Crown Prosecution Service (CPS) and must be proved guilty beyond reasonable doubt. The burden of proof lies with the prosecution, except in limited defences where the defendant must prove something on the balance of probabilities.
Every crime is made up of two core elements: actus reus (the guilty act) and mens rea (the guilty mind). Both must be present for liability to arise, and they must coincide in time. For example, in R v Cunningham [1957], the defendant tore a gas meter from a wall to steal money, causing gas to escape and injure a neighbour. The court held that 'maliciously' meant recklessness as to the risk of some harm, not merely wickedness – a crucial definition of mens rea.
6. Actus Reus and Mens Rea in Detail |
The actus reus can take several forms: a positive act (striking a victim), an omission (failure to act where a duty exists, such as parental duty), or a state of affairs (e.g. being found drunk in a public place). Causation must also be established for result crimes – both factual causation (the 'but for' test) and legal causation (substantial and operative cause). In R v White [1910], the defendant put cyanide in his mother's drink, but she died of a heart attack before the poison took effect. He was acquitted of murder because the actus reus was not the factual cause of death.
Mens rea describes the mental state of the defendant. The main types relevant at GCSE are intention (direct or oblique) and recklessness. In Cunningham recklessness, the defendant must have foreseen the risk of a particular harmful consequence and nonetheless taken that risk unreasonably. This subjective test looks at what the defendant actually thought. In contrast, strict liability offences require no mens rea for at least part of the actus reus – these are often regulatory crimes like selling alcohol to a minor.
7. Offences Against the Person: Assault and Battery |
Assault and battery are two distinct common law offences. Assault is causing the victim to apprehend immediate unlawful personal violence – no physical contact is required. For example, raising a fist as though to punch someone can be an assault if the victim reasonably expects to be hit. Battery is the actual infliction of unlawful physical force; even a small touch without consent may amount to battery. The mens rea for both is intention or Cunningham recklessness.
More serious non-fatal offences are found in the Offences Against the Person Act 1861. Section 47 covers assault occasioning actual bodily harm (ABH) – any hurt or injury calculated to interfere with health or comfort, such as cuts, bruises or psychiatric harm. Section 20 deals with maliciously wounding or inflicting grievous bodily harm (GBH), and section 18 covers wounding or causing GBH with intent. The distinction between s.20 and s.18 lies solely in the mens rea: s.18 requires specific intent to cause serious harm.
8. Property Offences: Theft |
Theft is defined in the Theft Act 1968, s.1 as the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. Five elements must be proved: appropriation (assuming the rights of an owner), property (money, tangible items, certain intangible property), belonging to another, dishonesty (according to the standards of ordinary honest people, as in R v Ghosh [1982]) and intention to permanently deprive.
Appropriation can occur even if the owner consents, as long as the consent was obtained by deception (as in R v Gomez [1993]). Thus, a shopper who switches price labels to pay less appropriates the goods dishonestly. You will also encounter the concept of 'momentary appropriation' – the law says that the intention to permanently deprive does not require that the thief succeeds in keeping the item; it is enough that he intends to treat the property as his own.
9. Defences in Criminal Law |
A defendant may be acquitted even if all elements of the offence are present if a valid defence is successfully raised. Common defences studied at GCSE include self-defence (and defence of another), duress, intoxication (voluntary and involuntary) and insanity. Self-defence allows reasonable force to protect oneself or another, or to prevent crime; the force must be proportionate in the circumstances as the defendant honestly believed them to be.
Duress by threats occurs when a defendant commits an offence because he reasonably feared death or serious injury, and a sober person of reasonable firmness would have reacted the same way. However, duress is not a defence to murder or attempted murder. Voluntary intoxication may negate a specific intent (as in s.18 GBH with intent), but it is no defence to basic intent crimes such as s.20 GBH or assault, because becoming voluntarily intoxicated is itself reckless behaviour.
10. Introduction to Civil Law and Negligence |
Civil law resolves disputes between individuals and organisations, aiming to compensate the claimant rather than punish the defendant. The burden of proof is on the claimant 'on the balance of probabilities'. One of the most important torts you will study is negligence – a breach of a legal duty of care owed to the claimant that causes foreseeable damage. The foundational case is Donoghue v Stevenson [1932], where Lord Atkin stated: 'You must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour.'
To establish negligence, three elements are required: duty of care, breach of that duty, and damage caused by the breach. The modern duty-of-care test comes from Caparo Industries plc v Dickman [1990]: foreseeability of harm, proximity between the parties, and whether it is fair, just and reasonable to impose a duty. Breach is judged by the standard of the reasonable person. Causation again uses the 'but for' test, and the damage must not be too remote.
11. Legal Skills: Applying the Law and Case Analysis |
Success in GCSE Law depends not only on knowing the rules but also on applying them to scenarios. Adopt the IRAC method: Issue – identify the legal question; Rule – state the relevant law and case principles; Application – apply the rule to the facts, arguing both sides where appropriate; Conclusion – reach a reasoned outcome. Practice writing short answers using this structure, and always support your arguments with case names.
Additionally, learn to read case reports critically. For each case, note the material facts, the legal point at issue, the ratio decidendi and, if relevant, influential obiter dicta. Being able to distinguish cases based on their facts is a higher-order skill that elevates your evaluation responses. Create revision cards for landmark cases such as Donoghue v Stevenson, R v Cunningham, R v White, and R v Ghosh.
12. Summer Transition Tasks and Study Tips |
Here are five practical tasks you can complete over the summer to give yourself the best possible start: (1) Read a selection of short legal news articles from sources like the BBC or The Law Society Gazette and summarise the legal issue in one paragraph. (2) Watch an episode of a legal documentary or court drama (e.g. 'The Briefs', 'Crown Court') and note down the court procedures you observe. (3) Create a glossary of 20 key legal terms you have met in this guide, such as 'actus reus', 'precedent' and 'negligence'. (4) Write a one-page profile of the UK Supreme Court, including its role, how it hears cases and the names of the current justices. (5) Attempt a simple scenario question: 'Ahmed pushes Ben in a queue, causing Ben to drop his phone, which smashes. Discuss Ahmed's criminal liability for battery and criminal damage.'
(3) 为本指南中遇到的20个关键法律术语创建词汇表,例如“actus reus(犯罪行为)”、“precedent(先例)”、“negligence(过失)”。
Stay curious and organised. Set up a dedicated folder or notebook for law, and as you learn new concepts, always ask yourself: what is the legal principle, how does it work in practice, and is there a case that demonstrates it? By engaging with the material before September, you will walk into your first law lesson already thinking like a lawyer.
