1. What Is Law? |
Law is a system of rules created and enforced by the state through institutions such as the police and the courts. Its primary purpose is to maintain order, protect individuals and property, and provide a framework for resolving disputes. Unlike moral or social rules, legal rules carry official sanctions, such as fines or imprisonment, if they are broken.
A key feature of law is that it applies equally to all members of society – we call this the rule of law. No one is above the law, not even government officials. This makes law predictable and fair. Another important trait is that laws are usually written down and publicly accessible, so citizens can know their rights and duties.
Law is also distinguished from custom or etiquette. While breaking a custom might bring social disapproval, breaking a legal rule brings a formal penalty imposed by the state. Understanding this difference helps you see why studying law is about more than just remembering rules – it is about grasping how society is organised.
2. Sources of Law |
In the English legal system, law comes from two main sources: Parliament‑made law (statute law) and judge‑made law (common law or case law). Statute law is created when Parliament passes an Act. Examples include the Theft Act 1968 and the Human Rights Act 1998. Statutes often set out broad principles and sometimes entire areas of law in a single document.
Common law, on the other hand, develops through decisions made by judges in the higher courts. When a judge decides a case, their legal reasoning can become a precedent that lower courts must follow in future similar cases. This system of binding precedent is called stare decisis. It ensures consistency and fairness across the legal system.
There is also a source known as equity, which originated from the Court of Chancery to provide remedies where the rigid common law was unfair. Today, equitable remedies such as injunctions and specific performance sit alongside and supplement the common law. Occasionally, international and European sources, such as the European Convention on Human Rights, also influence English law.
3. The Court System in England and Wales |
English courts are structured in a hierarchy. For criminal cases, the lowest level is the Magistrates' Court, which handles minor offences (summary offences) and can also send more serious cases to the Crown Court. The Crown Court deals with serious criminal offences (indictable offences) and also hears appeals from the Magistrates' Court. Above these are the High Court, Court of Appeal, and the Supreme Court, which is the final appeal court.
For civil cases, the County Court deals with smaller claims, while the High Court hears larger or more complex civil disputes. The High Court has three divisions: King's Bench, Chancery, and Family. Civil appeals usually go to the Court of Appeal (Civil Division) and then possibly to the Supreme Court. Tribunals also exist for specific areas such as employment or immigration.
Understanding this structure is essential because the hierarchy determines which decisions bind other courts. Decisions of the Supreme Court bind all lower courts, while the Court of Appeal binds itself and lower courts, subject to certain exceptions.
4. Criminal Law vs Civil Law |
One of the first distinctions you must master is between criminal law and civil law. Criminal law deals with conduct that the state considers harmful to society. The state prosecutes the defendant, and if found guilty, the defendant may be punished by imprisonment, a fine, or a community order. Civil law, in contrast, deals with disputes between individuals or organisations. The person bringing the case (the claimant) seeks a remedy, usually damages (money) or an injunction, rather than punishment.
The following table summarises the key differences:
|---|---|---|
| Purpose / 目的 | Punish offenders and deter crime 惩罚犯罪者并威慑犯罪 | Compensate the claimant or enforce rights 赔偿原告或强制执行权利 |
| Burden of proof / 举证责任 | On the prosecution 由控方承担 | Usually on the claimant 通常由原告承担 |
| Standard of proof / 证明标准 | Beyond reasonable doubt 排除合理怀疑 | On the balance of probabilities 盖然性权衡 |
| Possible outcome / 可能的结果 | Conviction and sentence 定罪和判刑 | Liable or not liable; remedy ordered 判承担责任或不承担责任;责令给予救济 |
It is worth noting that the same behaviour can sometimes give rise to both criminal and civil liability. For instance, a physical assault can lead to a criminal prosecution for battery and a civil claim for compensation for personal injury.
5. Elements of a Crime: Actus Reus and Mens Rea |
To be convicted of most criminal offences, two things must be proved: the guilty act (actus reus) and the guilty mind (mens rea). Actus reus refers to the physical element of the crime – it can be an action (e.g., stabbing), a failure to act when there is a duty to do so, or even a state of affairs. The act must be voluntary.
Mens rea is the mental element. It can take various forms depending on the offence: intention (aiming to bring about a result), recklessness (knowing a risk and unreasonably taking it), or sometimes negligence. For example, theft requires the intention to permanently deprive the owner of property. The specific mens rea for each crime is set out in its definition.
There are, however, some strict liability offences where mens rea is not required for at least part of the actus reus. These are often minor regulatory offences, such as selling food past its use‑by date. The principle is that protecting the public outweighs the need to prove fault.
6. Introduction to Tort Law |
Tort law concerns civil wrongs that cause harm to someone, entitling the victim to claim damages. It is not about punishment but about putting the injured person back, as far as money can, into the position they would have been in had the tort not occurred. The most important tort for Year 9 is negligence.
To succeed in a claim for negligence, the claimant must prove four things: (1) the defendant owed them a duty of care; (2) the defendant breached that duty by falling below the standard of a reasonable person; (3) the breach caused the claimant's loss or injury (causation); and (4) the loss was not too remote. These are often remembered as duty, breach, causation, and damage.
Another tort you may encounter is occupiers' liability, which deals with the duty owed by those who control premises to visitors. Private nuisance, protecting a person's use and enjoyment of their land, is also relevant. All tort claims share the civil standard of proof – balance of probabilities.
7. Introduction to Contract Law |
A contract is a legally binding agreement between two or more parties. For a contract to exist, there must be an offer, an acceptance of that offer, consideration (something of value exchanged), and an intention to create legal relations. Contracts can be written, oral, or even implied by conduct, although some must be in writing by statute.
An offer is a clear statement of terms on which the offeror is prepared to be bound once accepted. An acceptance must be unqualified and communicated to the offeror. The 'mirror image rule' says that acceptance must exactly match the offer; otherwise, it is a counter‑offer which destroys the original offer. Consideration is what each party gives to the other – it can be money, an act, or a promise not to do something.
In social or domestic arrangements, there is a presumption that parties do not intend to create legal relations, while in commercial agreements the opposite presumption applies. These presumptions can be rebutted by evidence.
8. Legal Personnel |
The legal profession in England and Wales is divided mainly into solicitors and barristers. Solicitors provide a wide range of legal services, including giving advice, drafting documents, and representing clients in lower courts. Barristers specialise in advocacy (presenting cases in court) and offer expert opinions on complex legal issues. Most barristers are self‑employed but work in 'chambers'.
Other key figures include judges, who preside over court proceedings and ensure a fair trial. In the Crown Court, a jury of 12 members of the public decides whether the defendant is guilty or not guilty, based on the facts. The judge then determines the sentence. Magistrates, who may be lay people or legally qualified district judges, decide cases in the Magistrates' Court.
Legal aid is available to help people who cannot afford a lawyer, ensuring access to justice. This is a crucial part of the system, especially in criminal cases where a fair trial is a fundamental right.
