📚 Year 9 Cambridge Law: Quick Reference to Key Legal Principles and Rules | Year
Welcome to your quick-reference guide for Year 9 Cambridge Law. Just like maths has formulas to solve problems, law has fundamental principles, rules and 'legal equations' that determine rights, duties and liabilities. This handbook distils the key concepts you need to master – from criminal liability to negligence, contract formation and the doctrine of precedent. Use it to revise systematically and check your understanding.
1. The Structure of Law: Types of Law |
Law is broadly divided into public law and private law. Public law governs the relationship between individuals and the state. It includes constitutional law (how the state is organised), administrative law (the actions of government bodies) and criminal law (offences against society).
Private law deals with disputes between individuals or organisations, where the state provides a framework for resolution. Key areas are contract law (agreements between parties), tort law (civil wrongs such as negligence) and family law (matters like divorce and child custody).
Another essential distinction is between civil law and criminal law. Criminal law aims to punish offenders and protect society, with the state prosecuting the defendant. The burden of proof is 'beyond reasonable doubt'.
Civil law resolves disputes and provides remedies, typically with one party suing another. The burden of proof is 'on the balance of probabilities'. Understanding this structure helps you categorise legal problems correctly.
2. Sources of Law |
English law comes from two main sources: statute law (Acts of Parliament) and common law (judge-made law through court decisions). Statute law is the highest form of law; Parliament is sovereign and can pass or repeal any law. If a statute conflicts with common law, the statute prevails.
Common law is developed through the doctrine of precedent, where judges follow the decisions of higher courts in previous similar cases. This provides consistency and predictability. Some areas, like murder, are largely common law, while theft is now codified in the Theft Act 1968.
Additionally, European Union law (retained after Brexit in limited form) and international treaties influence domestic law. For exam purposes, focus on the interplay between Parliament and the courts.
3. Criminal Liability Formula: Actus Reus + Mens Rea + No Defence |
Most crimes require two essential elements: the guilty act (actus reus) and the guilty mind (mens rea). If the prosecution proves both beyond reasonable doubt and no valid defence exists, the defendant is criminally liable. This can be expressed as a legal 'formula'.
Actus Reus + Mens Rea − Defence = Criminal Liability
Each element must coincide in time. The actus reus can be a positive act, an omission (where the law imposes a duty to act, e.g. a parent caring for a child) or a state of affairs (e.g. being found drunk in a public place).
Mens rea refers to the mental fault element: intention, recklessness, negligence or knowledge, depending on the offence. If either element is missing, there can be no conviction for that crime (unless it is a strict liability offence).
4. The Elements of Actus Reus |
Actus reus must be a voluntary act. If the defendant acts involuntarily – for example, due to a muscle spasm or being pushed by another – there is no actus reus. The law generally does not punish automatic or reflex actions.
Omissions can satisfy actus reus only where there is a legal duty to act. Duties arise from statute (e.g. to provide a breath sample), a contract, a relationship (parent-child), voluntary assumption of responsibility, or creating a dangerous situation.
Causation also forms part of actus reus in result crimes. The prosecution must prove factual causation (the 'but for' test: but for the defendant's conduct, would the result have happened?) and legal causation (the defendant's act was a substantial and operating cause of the result).
Thin skull rule: the defendant must take their victim as they find them. If the victim has a pre-existing condition that makes an injury more severe, the defendant is still fully liable.
5. Types of Mens Rea |
Mens rea is the mental element required for a crime. The highest level is intention, which can be direct (the defendant's purpose was to bring about the result) or oblique (the result was a virtually certain consequence of the defendant's actions and they foresaw this).
Recklessness is taking an unjustified risk. The modern test comes from R v G (2004): a person acts recklessly if they are aware of a risk and it is, in the circumstances known to them, unreasonable to take that risk.
Negligence occurs when the defendant's conduct falls below the standard of a reasonable person. Gross negligence manslaughter requires a very high degree of negligence. Some offences require knowledge or belief, such as handling stolen goods knowing they are stolen.
For strict liability crimes, no mens rea is needed for at least part of the actus reus.
6. Causation in Criminal Law: Connecting Act and Result |
In result crimes like murder or criminal damage, the prosecution must prove that the defendant's conduct caused the prohibited consequence. Causation combines two tests.
Causation = Factual Causation ('But For') + Legal Causation (Substantial & Operating Cause)
Factual causation uses the 'but for' test from R v White (1910): but for the defendant's conduct, would the result have occurred? If the result would have happened anyway, factual causation fails.
Legal causation requires the defendant's act to be a substantial and operating cause. It need not be the only cause, but must be more than minimal. An intervening act (novus actus interveniens) may break the chain of causation if it is a free, voluntary and informed act of a third party or an extraordinary natural event.
Medical negligence usually does not break the chain unless it is so independent and potent that the original injury is merely the setting.
7. Strict Liability Offences |
Strict liability crimes require no proof of mens rea for at least one element of the actus reus. The prosecution only needs to prove the voluntary act. These are usually regulatory offences concerning public safety, such as selling alcohol to a minor or food hygiene breaches.
Actus Reus (no Mens Rea required) = Strict Liability
The courts presume that mens rea is required unless the statute clearly indicates otherwise. Key case: Sweet v Parsley (1969) established that where an offence carries a serious social stigma, mens rea is required. Strict liability is justified on grounds of protecting the public and encouraging vigilance.
8. Tort of Negligence Formula: Duty + Breach + Damage + Causation |
To succeed in a negligence claim, the claimant must prove four elements on the balance of probabilities.
Duty of Care + Breach of Duty + Causation + Damage = Negligence Liability
Duty of care established by the Caparo three-part test: (1) foreseeability of harm, (2) proximity between the parties, and (3) it is fair, just and reasonable to impose a duty.
Breach occurs when the defendant falls below the standard of a reasonable person, considering factors like likelihood of harm, seriousness of potential injury, cost of precautions and social utility of the activity.
Causation must be both factual (but for) and legal (the damage is not too remote, as in The Wagon Mound). Damage must be recognisable harm: personal injury, property damage or economic loss in limited circumstances.
9. Contract Formation Formula: Offer + Acceptance + Consideration + Intention |
A legally binding contract requires four key ingredients. If any is missing, no contract exists.
ffer + Acceptance + Consideration + Intention to Create Legal Relations = Binding Contract
An offer is a clear statement of terms by which the offeror intends to be bound. It must be distinguished from an invitation to treat (e.g. goods on a shelf, advertisements).
Acceptance must be a mirror image of the offer, unconditional and communicated to the offeror (postal rule exception: acceptance by post is effective upon posting). Silence cannot usually constitute acceptance.
Consideration is the 'price' each party pays for the other's promise – something of value in the eyes of the law. It must be sufficient but need not be adequate. Past consideration is not good consideration (with limited exceptions).
Intention to create legal relations is presumed in commercial agreements but not in domestic or social arrangements unless evidence shows otherwise.
10. Defences in Law: Negating Liability |
Even when the elements of a crime, tort or breach are present, a valid defence can reduce or extinguish liability. Defences act like subtracting factors in the legal formula.
Proved Elements – Applicable Defence = Reduced or No Liability
In criminal law, full defences include self-defence (reasonable force in defence of self, others or property), duress (threats of death or serious injury forcing the defendant to commit a crime), and insanity (defect of reason causing the defendant not to know the nature of the act or that it was wrong).
Partial defences to murder reduce liability to manslaughter: loss of control and diminished responsibility.
In tort, common defences are consent (voluntary assumption of risk), contributory negligence (the claimant's own carelessness contributed to their damage, reducing damages proportionally) and illegality (no claim if the claimant was involved in an illegal act).
11. The Doctrine of Precedent: Stare Decisis |
The English common law system operates on the doctrine of precedent (stare decisis – 'stand by what has been decided'). Courts are bound to follow the decisions of higher courts in cases with sufficiently similar facts.
Earlier Binding Decision + Similar Material Facts = Same Legal Outcome
A judgment contains the ratio decidendi (the legal reason for the decision) which is binding on lower courts, and obiter dicta (other remarks) which are persuasive but not binding.
The court hierarchy is crucial: decisions of the Supreme Court bind all lower courts. The Court of Appeal is bound by the Supreme Court and generally by its own previous decisions, subject to limited exceptions. Lower courts must follow the decisions of all higher courts.
Precedent can be avoided if the material facts are distinguishable, meaning the ratio of the earlier case does not apply. This allows the law to develop flexibly while maintaining consistency.
12. Human Rights Principles: The Fundamental Law Formula |
The Human Rights Act 1998 incorporates the European Convention on Human Rights into UK law. Public authorities must act compatibly with Convention rights, and courts must interpret legislation consistently with these rights where possible.
Individual Rights ↔ Legitimate State Aim + Proportionality
Key rights include: Article 2 (right to life), Article 3 (freedom from torture and inhuman treatment), Article 5 (right to liberty), Article 6 (right to a fair trial), Article 8 (respect for private and family life), Article 10 (freedom of expression) and Article 11 (freedom of assembly).
Some rights are absolute (e.g. Article 3) and cannot be interfered with. Most are qualified rights, meaning the state can interfere if the limitation is prescribed by law, pursues a legitimate aim and is necessary in a democratic society (the proportionality test).
When balancing rights, courts apply a proportionality formula: is the measure suitable, necessary, and does it strike a fair balance between the individual's right and the community's interest?
