1. What is Law? |

Law is a system of rules created and enforced by the state to regulate the behaviour of individuals and organisations. It sets out what we are obliged to do, what we are forbidden from doing, and the consequences of breaking the rules. Law differs from moral or social rules because it is backed by the authority of the state, enforced through courts and police, and violations lead to legal sanctions such as fines, imprisonment, or community service. Without law, there would be no reliable mechanism to resolve disputes or protect rights.

A key principle in many legal systems is the rule of law. This means that everyone is subject to the law equally, including government officials. It ensures that laws are clear, publicised, applied evenly, and protect fundamental rights. The rule of law prevents arbitrary use of power and guarantees that justice is accessible to all.

2. Classification of Law |

The law is commonly divided into criminal law and civil law. Criminal law deals with conduct that the state considers harmful to society as a whole. In a criminal case, the state prosecutes the defendant. If found guilty, the defendant may be punished by a fine, a community sentence, or imprisonment. Examples of criminal offences include theft, assault, and fraud.

Civil law, on the other hand, deals with disputes between individuals, businesses, or organisations. The party bringing the claim is the claimant, and the one against whom the claim is made is the defendant. The usual remedy is compensation (damages) rather than punishment. Key areas of civil law include contract law, tort law, and family law. The standard of proof also differs: criminal cases require proof 'beyond reasonable doubt', whereas civil cases are decided on the 'balance of probabilities'.

3. Sources of Law |

In the English legal system, the two most important sources of law are statute law (Acts of Parliament) and common law (judicial precedent). Parliament is sovereign, meaning it can pass, amend, or repeal any law. Statutes are written documents that have been debated and approved by the House of Commons, the House of Lords, and the monarch.

Common law is developed by judges. When a case raises a point of law that has not been decided before, the judge's ruling becomes a precedent. Lower courts are bound to follow the decisions of higher courts in similar subsequent cases, ensuring consistency and fairness. This is called the doctrine of stare decisis. Some major areas of law, such as negligence and contract, have been shaped almost entirely by judicial decisions.

4. The Court System |

The court structure in England and Wales is divided into criminal courts and civil courts. For criminal matters, the Magistrates' Court deals with less serious offences, such as minor traffic violations and petty theft. These cases are usually heard by magistrates without a jury. More serious crimes, such as robbery or murder, are tried in the Crown Court, where a judge presides and a jury decides the facts. Appeals from the Crown Court go to the Court of Appeal (Criminal Division) and then to the Supreme Court.

In civil cases, the County Court handles most smaller claims, such as debt recovery or personal injury claims under £100,000. The High Court deals with more complex and higher-value cases. There are three divisions of the High Court: the King's Bench Division, the Chancery Division, and the Family Division. Appeals in civil matters follow a similar route: from the County Court or High Court to the Court of Appeal (Civil Division) and then to the Supreme Court.

5. Criminal Law: Actus Reus and Mens Rea |

To secure a conviction, the prosecution must usually prove two elements in a crime: the actus reus and the mens rea. The actus reus refers to the guilty act – the physical action or omission that constitutes the crime. For example, in theft, the actus reus is the appropriation of property belonging to another. The actus reus can also be a failure to act when the law imposes a duty to act, such as a parent failing to feed their child.

The mens rea is the guilty mind, meaning the defendant's mental state at the time of the offence. The highest form of mens rea is intention – the defendant deliberately brought about the prohibited result. A lower form is recklessness, where the defendant foresaw the risk that their conduct would cause the harmful result but unreasonably took that risk. Both must usually coincide in time for liability to be established. Some strict liability offences, however, require only the actus reus and no proof of mens rea.

6. Defences in Criminal Law |

Even when the actus reus and mens rea are present, a defendant may raise a defence to avoid or reduce liability. A defence is a reason why the defendant should not be held fully responsible. Common defences include self-defence, duress, insanity, automatism, and intoxication.

Self-defence allows a person to use reasonable force to protect themselves, another person, or property. The force must be proportionate to the threat as the defendant honestly perceived it. Duress is a defence where the defendant was forced to commit a crime under a threat of immediate death or serious injury. However, duress is not available for murder. The defence of insanity requires proof that the defendant suffered from a disease of the mind that caused a defect of reason so that they did not know the nature and quality of their act or that it was wrong. If successful, a special verdict of 'not guilty by reason of insanity' is returned.

7. Tort Law: Negligence |

Tort law deals with civil wrongs that cause harm to another. The most important tort is negligence. To succeed in a claim for negligence, the claimant must prove three elements: the defendant owed them a duty of care, the defendant breached that duty, and the breach caused damage that was not too remote.

The duty of care was famously explained in Donoghue v Stevenson [1932]. The court established the 'neighbour principle': a person must take reasonable care to avoid acts or omissions that could foreseeably injure their neighbour. A neighbour is anyone who is so closely and directly affected by one's actions that they ought reasonably to be in contemplation. Breach of duty occurs when the defendant falls below the standard of a reasonable person. The standard is objective, not based on the defendant's personal characteristics. Finally, the damage caused must be a foreseeable consequence of the breach, and there must be no intervening act that breaks the chain of causation.

8. Contract Law: Formation |

A contract is a legally enforceable agreement between two or more parties. For a contract to be valid, four main elements are needed: offer, acceptance, consideration, and an intention to create legal relations. An offer is a clear and definite statement of the terms on which the offeror is willing to be bound. It must be communicated to the offeree and can be distinguished from an invitation to treat, which is merely an invitation to negotiate.

Acceptance is a final and unqualified expression of assent to the terms of the offer. The general rule is that acceptance must mirror exactly the offer; any variation becomes a counter-offer that destroys the original offer. Consideration is what each party brings to the contract – often a promise for a promise. It must be something of value in the eyes of the law but need not be adequate. Finally, the parties must intend their agreement to be legally binding. In social or domestic arrangements, there is a presumption that there is no such intention, whereas in commercial agreements it is presumed to exist.

9. Human Rights and the Law |

Human rights are fundamental freedoms and protections that belong to every individual regardless of nationality, gender, or background. After the Second World War, the Universal Declaration of Human Rights was adopted, and in Europe, the European Convention on Human Rights (ECHR) was drafted. In the United Kingdom, the Human Rights Act 1998 incorporated the ECHR into domestic law, allowing individuals to rely on Convention rights in national courts.

Key rights under the ECHR include Article 2: the right to life, Article 3: freedom from torture and inhuman or degrading treatment, Article 5: the right to liberty and security, Article 6: the right to a fair trial, Article 8: respect for private and family life, Article 10: freedom of expression, and Article 14: prohibition of discrimination. These rights are not absolute; some are qualified, meaning they can be restricted in certain circumstances for the public interest, provided the restriction is lawful, necessary, and proportionate.

10. The Legal Profession and Access to Justice |

In the English legal system, there are two main branches of legal professionals: solicitors and barristers. Solicitors usually work directly with clients, providing legal advice, drafting documents, and preparing cases for trial. They may represent clients in lower courts but often instruct barristers for advocacy in higher courts. Barristers specialise in courtroom advocacy and providing expert opinions on the law. They are often self-employed and work in chambers.

Access to justice is a fundamental principle. Legal aid is government-funded assistance that helps people who cannot afford legal representation. However, it is not available for every type of case. Alternative dispute resolution (ADR) methods, such as mediation (where a neutral third party helps the parties reach a settlement) and arbitration (where a third party makes a binding decision), are becoming increasingly popular because they can be less formal, cheaper, and quicker than going to court. Ensuring everyone can enforce their rights, regardless of wealth, is essential for a fair legal system.
