📚 Mastering Case Analysis: A Practical Workshop |
Welcome to this practical workshop on legal case analysis, designed for Year 9 OCR Law students. Cases are the building blocks of the law, and learning how to dissect them is a vital skill. In this article, you will move step by step through the process that lawyers and judges use every day. You will begin with reading facts, move on to spotting legal issues, and finally construct clear, logical arguments. To make it real, we will work through three complete practice scenarios covering criminal law, tort and contract. By the end, you will be able to approach any case study with confidence.
1. What Is Case Analysis? |
Case analysis is the method by which legal professionals examine a set of facts, identify the relevant legal questions, and apply the law to reach a reasoned conclusion. It is not about guessing or relying on intuition. Instead, it is a structured process that ensures decisions are consistent, fair and based on authority. For GCSE students, mastering this process early gives you a powerful toolkit for exams and beyond.
2. Reading and Understanding the Facts |
Every case begins with a story. Your first job is to read the facts carefully and separate material facts from background noise. Material facts are those that could affect the outcome of the case. For example, in a case about a stolen bicycle, the colour of the bicycle might be irrelevant, but the fact that the defendant was seen taking it from a locked shed is clearly material. Highlight or underline these crucial details while you read.
Always ask yourself three questions when reviewing the facts: Who did what? When and where did it happen? And what was the result? These questions will help you build a clear timeline of events. A disorganised understanding of the facts is one of the quickest routes to a weak analysis, so take your time at this stage.
3. Spotting the Legal Issue |
Once you have a firm grasp of the facts, the next step is to frame the legal question that needs to be answered. This means mapping the facts onto a known area of law. Is someone potentially criminally liable? Has a civil wrong (a tort) been committed? Or has a contract been broken? Stating the issue clearly – for example, 'Has Jack committed theft under the Theft Act 1968?' – sets the direction for the whole analysis.
Many scenario-based exam questions will mix several possible issues. A single story might involve a possible crime, a breach of contract and a tort. Train yourself to unpick these layers and treat each one separately. Remember that in English law, the standard of proof and the parties involved differ between criminal and civil cases, which will influence how you argue each issue.
4. Finding the Relevant Law |
With the issue clearly stated, you must now locate the legal rule that governs it. Most rules in English law come either from an Act of Parliament (statute) or from a previous court decision (precedent). For instance, the basic definition of theft is found in section 1 of the Theft Act 1968, while the neighbour principle in negligence was established in the famous case of Donoghue v Stevenson.
As a Year 9 student, you are not expected to memorise hundreds of cases. Instead, focus on learning a few key authorities and understanding how to use them. When you write, state the rule simply: 'Under the Theft Act 1968, theft is the dishonest appropriation of property belonging to another with the intention to permanently deprive.' Then be ready to break that rule into its elements.
5. The Rule of Precedent |
The doctrine of precedent, or stare decisis, means that lower courts must follow the decisions of higher courts when the facts are sufficiently similar. This principle ensures certainty and fairness in the law. When analysing a case, you may need to decide whether an existing precedent binds the current situation or whether the facts can be 'distinguished' – meaning the cases are different enough that the old rule should not apply.
For example, a precedent saying that a person who hides goods in a shop commits theft might not apply to someone who merely changes a price tag without taking the item. Being able to argue why a case is similar or different is a sophisticated skill that examiners love to see. Always ask: are the material facts of my scenario essentially the same as those in the precedent?
6. Applying Law to Facts |
The application stage is the heart of case analysis. Here you take each element of the legal rule and check whether the facts satisfy it. It is like fitting puzzle pieces together. For theft, you would go through: was there an appropriation? Does the property belong to another? Was the defendant dishonest? Did they intend to permanently deprive the owner? You must link each element directly to a specific fact from the scenario.
Strong answers use phrases like 'Here, Jack took the bicycle without permission, which satisfies the act of appropriation' or 'The fact that Jack sold the bicycle the next day strongly suggests an intention to permanently deprive.' Weak answers make vague statements without tying law to facts. Always be precise and factual.
7. The IRAC Method | IRAC方法
Many law teachers introduce IRAC, which stands for Issue, Rule, Application and Conclusion. It is a simple recipe for a well-structured answer. Begin by stating the Issue, then set out the relevant Rule, next Apply the rule to the facts, and finally reach a Conclusion. This method prevents rambling and ensures you do not miss any vital step.
8. Common Mistakes to Avoid |
Even motivated students fall into predictable traps. The most frequent is jumping to a conclusion before analysing the law. Never begin an answer with 'He is guilty' – always walk through the steps first. Another mistake is confusing criminal and civil terminology: a person is found 'guilty' in a criminal case, but 'liable' in a tort or contract claim. A third pitfall is ignoring weak points on the other side; a balanced analysis acknowledges counter-arguments and explains why they may fail.
Also, avoid relying on moral judgement instead of legal rules. Saying something is “unfair” does not make it illegal. The law sets specific tests, and your job is to apply those tests, not your personal sense of justice. Stick to what the statute or precedent actually says, and let the law guide your conclusion.
9. Practice Scenario 1: The Stolen Bicycle (Criminal Law) |
Tom left his blue mountain bike chained to a railing outside the library. When he returned, the chain was cut and the bike was gone. Two days later, Tom spotted a boy named Jack riding an identical blue bike in the park. Tom called the police, claiming Jack had stolen his bike. Jack insisted he had bought the bike from an online marketplace and had a receipt. The prosecution must decide whether to charge Jack with theft.
Using the framework, first identify the issue: can the prosecution prove that Jack committed theft contrary to section 1 of the Theft Act 1968? The rule requires (1) appropriation of property belonging to another, (2) dishonesty, and (3) an intention to permanently deprive. Now apply the rule. As for appropriation, Jack certainly took control of the bike – but whether it was Tom's property is unclear because the bike could be a different one of the same model. Dishonesty is also in doubt if Jack genuinely believed he was buying a legitimate item. The intention to permanently deprive would be satisfied if the bike was Tom's, but Jack’s possession as an apparent owner is not necessarily inconsistent with honesty.
The key material facts that weaken the prosecution case are the identical model and the existence of a receipt. A court would likely conclude that the prosecution cannot meet the high criminal standard of proof beyond reasonable doubt. The conclusion is that Jack would probably not be convicted. This exercise shows how the same set of facts can be analysed from both sides.
10. Practice Scenario 2: The Noisy Neighbour (Tort Law) |
Susan lives in a semi-detached house. Her next-door neighbour, Dan, started a business repairing musical instruments from his garage. Every evening from 6 p.m. to 11 p.m., Dan tests amplifiers and drums, causing loud, repetitive noise. Susan cannot sleep, and her doctor says the stress has worsened her health. Susan wants to sue Dan for the tort of private nuisance.
The legal issue is whether Dan's activities amount to a private nuisance. Private nuisance is an unreasonable interference with a person's use or enjoyment of their land. Factors which courts consider include the duration and intensity of the interference, the character of the neighbourhood, and any abnormal sensitivity on the part of the claimant. Here, the noise is regular and long-lasting, and it occurs during hours when people typically rest. Although some noise from a home business might be expected in a residential area, the volume and timing of amplifier testing are likely to go beyond what an ordinary neighbour should tolerate.
Applying the rule, the intensity of the noise (amplifiers and drums) makes it more than a minor annoyance. The duration – five hours every evening – is substantial. Susan's health impact strengthens her claim, although the test is objective: would a reasonable person find the interference unreasonable? The likely conclusion is that a court would find Dan liable in private nuisance and could grant an injunction to restrict the noisy activities, as well as damages for Susan's suffering.
11. Practice Scenario 3: The Broken Promise (Contract Law) |
Amy told her friend Ben, 'I will sell you my electric guitar for £80.' Ben immediately replied, 'Great, I accept! I will bring the cash tomorrow.' The next morning, Amy sold the guitar to another buyer for £100. When Ben arrived with the £80, the guitar was gone. Ben now wants to know if Amy has broken a contract and whether he can claim any remedy.
The issue is whether a valid contract was formed and subsequently breached. Formation requires an offer, acceptance, consideration and an intention to create legal relations. Amy's statement was a clear offer to sell a specific item for a definite price. Ben's reply was an unconditional acceptance. The consideration was the promise of £80 for the guitar. Although they are friends, the use of precise terms and the nature of the transaction suggest an intention to create legal relations, distinguishing it from a purely domestic arrangement.
Applying the rule, all four elements are satisfied. A contract came into existence the moment Ben said 'I accept.' Amy's later sale to a third party is a breach of that contract. Ben can sue for breach and, as the guitar is now gone, is likely to claim damages for the difference between the contract price and the market value, or possibly the higher price Amy received. The conclusion is that Amy is liable for breach of contract, and a court would award Ben a remedy.
