1. What Is Case Analysis in Law? |
Case analysis is the process of examining a legal scenario, identifying the relevant facts, spotting the legal issues, and applying the rules of law to reach a reasoned conclusion. In WJEC Year 9 Law, you will often be given short problem scenarios. Your job is not to write everything you know about a topic, but to use the law to solve the problem in front of you. This skill is also called legal reasoning, and it mirrors what solicitors and barristers do daily.
2. The FIRAC Framework: A Step-by-Step Tool | FIRAC
To analyse a case systematically, we use a simple framework called FIRAC: Facts, Issues, Rules, Application, and Conclusion. This structure ensures you do not skip any essential stage. In a WJEC exam, even a brief answer that follows this order will earn higher marks than a long, disorganised one. You do not need to label each section with a subheading, but your thinking should follow the same logical flow.
3. Drill 1: The Playground Football Injury |
Read the following scenario carefully. During a school lunch break, 14-year-old Tom kicked a football hard towards a group of students. The ball hit Sarah, who was not playing, on the side of the head. Sarah suffered a concussion and missed two weeks of school. Tom says he did not mean to hit her and was just aiming at the goal. Consider whether Tom may be liable under the tort of negligence.
4. Facts and Issues: Laying the Groundwork |
Before applying any law, you must isolate the legally significant facts. Here, the key facts are: Tom kicked a ball at school, he used force, the ball hit a non-participant, and Sarah suffered a recognised injury. The central legal issue is whether Tom owed Sarah a duty of care, whether he breached that duty, and whether his actions caused her harm. Identifying the issue as 'possible negligence' narrows the focus of your research.
5. The Rule: Elements of Negligence |
To establish negligence in English law, three elements must be proved: duty of care, breach of that duty, and damage caused by the breach. A duty of care exists if it is reasonably foreseeable that your actions could injure another person. The standard expected is that of the 'reasonable person' of the same age. Breach means falling below that standard. Finally, the damage must be a direct result of the breach, not too remote.
6. Application: Bringing Law to Life | 适用:让法律活起来
Apply the negligence test to Tom's case. It is clearly foreseeable that kicking a football hard near a crowd could cause injury, so Tom owes a duty. Considering his age, a reasonable 14-year-old would know that kicking at people is dangerous; Tom’s act may well breach that standard. Sarah's concussion is a recognised injury, and the chain of causation is direct. Even if Tom did not intend to hit her, negligence covers careless, not just deliberate, acts.
7. Conclusion and Advice |
A court would likely find Tom liable for negligence. Sarah could claim damages for her pain, suffering, and time off school. Tom's best defence could be contributory negligence if Sarah had been warned or was where she should not have been, but the facts do not indicate this. A lawyer would advise an early apology and an offer to cover medical costs to avoid court. In an exam answer, state your conclusion clearly with reasons.
8. Drill 2: The Stolen Mobile Phone |
Scenario: Emma, aged 13, left her new smartphone on a table in the school library while she went to fetch a book. When she returned two minutes later, the phone was gone. A teacher later found the phone in Jack's bag. Jack, also 13, claims he 'found it' and planned to hand it in but forgot. Analyse this scenario with the offence of theft under the Theft Act 1968 as it applies to England and Wales.
9. Facts and the Legal Issue |
The important facts are: Emma owned the phone, it was left temporarily unattended, Jack took it without asking, and he kept it in his bag without informing anyone. The legal issue is whether Jack's actions satisfy the definition of theft under s.1 of the Theft Act 1968: 'A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it.'
10. The Rule: Breaking Down the Definition |
The Act requires four elements: appropriation, property, belonging to another, and dishonest intention to permanently deprive. Appropriation means assuming the rights of the owner, like taking or keeping. Property includes personal items like a phone. The phone clearly belonged to Emma, even when she left it briefly. The last element is the mental state: Jack must have acted dishonestly by ordinary standards and intended to keep the phone forever, or treat it as his own.
11. Application and Honest Belief |
Jack appropriated the phone by picking it up and later putting it in his bag. That phone was property belonging to Emma. The tricky part is dishonesty and intention. Jack says he 'found' it and meant to hand it in. Under the Theft Act, if someone finds property and takes reasonable steps to trace the owner, they may not be dishonest. However, Jack made no attempt to find the owner and hid the phone in his bag. A court could infer dishonesty and an intention to keep it permanently, even if he later changed his story.
12. Conclusion and Exam Tips |
It is likely Jack would be found guilty of theft. The key exam technique is to tackle each element in order. Do not just write 'Jack stole the phone' – explain how each legal requirement is met using the facts. Mentioning the Theft Act 1968 by name shows knowledge. Always discuss potential defences, like Jack's claim of finding, but then explain why it might fail. This balanced approach demonstrates high-level legal reasoning.
