📚 Year 9 AQA Law: Formula & Theorem Quick Reference Handbook | Year 9 AQA
This quick reference handbook transforms key legal principles from the Year 9 AQA Law syllabus into easy-to-memorise 'formulas' and 'theorems'. Much like in science and mathematics, law has its own logical structures that can be expressed as equations, rules, and tests. Use this guide to build confidence with criminal liability, negligence, contract formation, and more.
1. The Core Criminal Liability Equation |
Criminal Offence = Actus Reus + Mens Rea − Valid Defence
Actus reus refers to the guilty act, which can be an action, an omission (in limited circumstances), or a state of affairs. Mens rea is the guilty mind, encompassing intention, recklessness, or negligence depending on the offence. A defence such as self-defence, duress, or insanity can negate liability even when actus reus and mens rea are present.
|---|---|---|
| Actus Reus | The voluntary act or omission that breaks the law. | Stabbing someone (action); failing to feed a dependent (omission). |
| Mens Rea | The mental state of the defendant at the time of the act. | Intending to kill (intention); driving dangerously without caring about risk (recklessness). |
| Defence | A reason why the defendant should not be held criminally liable. | Self-defence, automatism. |
This basic equation is the starting point for analysing any criminal scenario in your exam. Always check each element in turn.
2. The Negligence Theorem (Tort Law) |
Liability for Negligence = Duty of Care + Breach of Duty + Causation + Damage
To succeed in a negligence claim, a claimant must prove that the defendant owed them a duty of care (neighbour principle from Donoghue v Stevenson), breached that duty by falling below the standard of the reasonable person, and that the breach caused (both factually and legally) the damage suffered. Damage must be a type recognised by law, such as personal injury or property damage.
|---|---|---|
| Duty of Care | Was the claimant a foreseeable neighbour? | Donoghue v Stevenson – manufacturer owes duty to consumer. |
| Breach | Did the defendant act as a reasonable person would? | Reasonable doctor, reasonable driver – objective standard. |
| Causation | Factual: 'but for' test; Legal: remoteness of damage. | Barnett v Chelsea Hospital – 'but for' the doctor's breach, patient would still have died. |
| Damage | Was there actual loss or injury? | Physical injury, psychiatric harm (with restrictions). |
This theorem is fundamental to tort law and appears frequently in scenario-based questions. Memorise the sequence: duty, breach, causation, damage.
3. Contract Formation Formula |
Valid Contract = Offer + Acceptance + Consideration + Intention to Create Legal Relations
A binding contract requires an unequivocal offer, a mirror-image acceptance communicated to the offeror, something of value exchanged (consideration), and an objective intention to be legally bound. Social and domestic agreements are presumed not to have such intention unless rebutted, while commercial agreements are presumed to have it.
Offer → Acceptance → Consideration → Binding Contract
A counter-offer destroys the original offer, as in Hyde v Wrench. Acceptance must be communicated; silence cannot be acceptance (Felthouse v Bindley). Consideration need not be adequate but must be sufficient (something of value in the eyes of the law).
4. The Theft Definition Equation |
onest Appropriation of Property Belonging to Another with Intention to Permanently Deprive
Under the Theft Act 1968, section 1, the actus reus of theft is the appropriation of property belonging to another. The mens rea consists of dishonesty and an intention to permanently deprive. Section 2 gives examples where dishonesty may be absent (e.g. belief in legal right to the property), and section 6 clarifies that borrowing can amount to an 'intention to permanently deprive' if it treats the property as one's own.
+ Property + Belonging to Another + Dishonesty + Intention to Permanently Deprive = Theft
Remember that appropriation includes assuming any right of the owner, so even switching a price tag can be an appropriation. The Ghosh test for dishonesty (now modified by Ivey v Genting Casinos) asks whether the defendant's conduct was dishonest by the standards of ordinary decent people.
5. The Test for Assault and Battery (Non-Fatal Offences) |
Assault = Intentionally Causing Victim to Apprehend Immediate Unlawful Personal Violence
Battery = Intentionally or Recklessly Applying Unlawful Force to Another
Assault does not require physical contact; the victim must expect immediate violence and the fear must be reasonable. Words alone can constitute assault, as can silence in context. Battery requires actual physical contact, however slight. Both are common law offences; assault is often referred to as a 'technical assault'. No harm need result for a battery.
im apprehends immediate force + defendant intended or was reckless as to that apprehension
Battery = Application of unlawful force + intent or recklessness as to that force
6. The Causation Sequence in Criminal Law |
ausation = Factual Causation (But For) + Legal Causation (Substantial and Operative Cause)
For result crimes such as murder, the prosecution must prove that the defendant's act both factually and legally caused the prohibited consequence. Factual causation is established by the 'but for' test (R v White). Legal causation requires that the defendant's act was a substantial and operative cause of the result; it need not be the only cause. The chain of causation can be broken by a novus actus interveniens – a free, voluntary, and informed act of a third party or an extraordinary natural event.
But-for Test: 'But for the defendant's conduct, would the result have occurred?' → If YES, no factual causation.
Victim's own actions (e.g. refusing medical treatment) generally do not break the chain unless they are daft or unreasonable (R v Blaue). Medical negligence will only break the chain if it is so potent as to make the original wound merely part of the background.
7. The Defences Equation |
s Satisfied → Acquittal; Partial Defence = Reduction from Murder to Voluntary Manslaughter
Self-defence (including defence of property) requires that the defendant used reasonable force in the honest belief that it was necessary. Duress (by threats or circumstances) requires a threat of death or serious injury, with no safe avenue of escape, and the threat must have been the reason for the crime. Intoxication may be a partial defence for specific intent crimes if involuntary, but generally not for voluntary intoxication. Automatism is a complete defence if there was a total loss of voluntary control due to an external factor.
Valid Defence = Objective requirement + Subjective (honest) belief + Proportionality
Consent can be a defence to assault and battery in certain situations, such as sports or surgery. However, a person cannot consent to actual bodily harm or more serious injury unless in recognised exceptions (e.g. tattooing, boxing).
8. The Murder and Voluntary Manslaughter Progression |
Murder = Unlawful Killing of a Human Being under the Queen's Peace + Intention to Kill or Cause Grievous Bodily Harm (GBH)
Voluntary Manslaughter = Murder – forethought + Partial Defence (Diminished Responsibility / Loss of Control / Suicide Pact)
The mandatory life sentence for murder can be reduced if the defendant successfully raises one of three special partial defences: diminished responsibility (abnormality of mental functioning arising from a recognised medical condition), loss of control (a qualifying trigger plus a person of defendant's age and sex would have reacted similarly), or killing in pursuance of a suicide pact. These defences do not result in acquittal but reduce the conviction to voluntary manslaughter.
Murder Actus Reus + Mens Rea → Conviction for Murder
If Partial Defence Proven → Voluntary Manslaughter
9. The Statutory Interpretation Formula |
Statutory Interpretation = Literal Rule + Golden Rule + Mischief Rule + Purposive Approach
Judges apply these rules to interpret unclear legislation. The literal rule gives words their plain, ordinary dictionary meaning, even if the result is absurd. The golden rule modifies the literal rule when it leads to an absurdity. The mischief rule looks at the gap or 'mischief' the statute was designed to remedy, and interprets words to suppress that mischief. The purposive approach (promoted by EU law) goes further, considering the wider purpose of the legislation.
|---|---|
| Literal Rule | Whiteley v Chappell (voting dead person – not a 'person entitled to vote'). |
| Golden Rule (narrow) | R v Allen (bigamy offence – 'marry' interpreted as 'go through a ceremony of marriage'). |
| Mischief Rule | Smith v Hughes (prostitutes soliciting from windows – within the 'street' mischief). |
| Purposive | Pepper v Hart (using Hansard to find Parliamentary purpose). |
These can be remembered with: Literal (ordinary meaning), Golden (absurdity correction), Mischief (what was the gap?), Purposive (what is the aim?).
10. The Judicial Precedent Theorem |
Binding Precedent = Ratio Decidendi of a Higher Court + Same Material Facts
The doctrine of stare decisis requires lower courts to follow the decisions of higher courts in the same hierarchy when the material facts are similar. The ratio decidendi (the legal reasoning essential to the decision) is binding; obiter dicta (remarks 'by the way') are persuasive only. The Supreme Court (formerly House of Lords) binds all lower courts but is not bound by its own previous decisions, though it will only depart from them when it is right to do so (Practice Statement 1966). The Court of Appeal is generally bound by its own earlier decisions with limited exceptions.
Ratio = Reason for deciding; Obiter = Things said by the way
Avoiding precedent is possible through distinguishing (pointing out a material difference in facts), overruling (by a higher court), or reversing (on appeal in the same case).
11. The European Convention on Human Rights (ECHR) and the Human Rights Act 1998 |
slation must be read and given effect in a way compatible with Convention Rights (s.3 HRA)
The Human Rights Act 1998 incorporates key rights from the ECHR into UK law, including the right to life (Article 2), freedom from torture (Article 3), right to liberty (Article 5), right to a fair trial (Article 6), and respect for private and family life (Article 8). Courts must interpret legislation compatibly where possible; if not possible, they can issue a declaration of incompatibility, which does not invalidate the law but triggers political pressure to amend it.
Section 3: 'read and given effect' → compatible interpretation
n 4: Declaration of Incompatibility → alerts Parliament but does not override the statute.
12. The Tort of Trespass – Simple Formula |
Trespass = Direct, Intentional, and Unlawful Interference with Land or Person
Trespass to land requires (1) physical entry onto land in possession of another, (2) without justification, and (3) with intent or carelessness. Defences include licence, legal authority, or necessity. Trespass to the person includes assault, battery, and false imprisonment.
Land Trespass: Entry + No Permission → Actionable per se (no damage needed)
This is a useful 'formula' for revision because it emphasises that trespass is actionable without proof of physical harm, unlike negligence.
