1. Why Case Analysis Matters |
In Edexcel Year 9 law, you are often presented with a short scenario and asked to advise the parties or predict the outcome. This is not a memory test – it is a reasoning exercise. You must show that you can identify the relevant legal rules, apply them to new facts and reach a logical conclusion. Mastery of case analysis also helps you understand how real judges develop the common law through precedent.
Furthermore, case analysis trains you to write like a lawyer: clear, structured and focused on the material facts. Every single mark in a problem question depends on your ability to link the law to the facts, not on storytelling.
2. Step 1 – Read and Understand the Facts |
Begin by reading the scenario twice. Underline or highlight the parties, their actions and any key details such as dates, locations and words spoken. Ask yourself: who did what to whom? Do not jump to a legal label too quickly; instead, separate the legally significant (material) facts from the background noise. For example, in a negligence claim, the fact that the defendant was eating a sandwich at the time is irrelevant unless it affected their duty of care.
A useful technique is to create a short timeline or bullet list of events. This stops you from missing a crucial step in the sequence, which is often where the legal issue hides.
3. Step 2 – Spot the Legal Issue(s) |
Every case turns on a legal question. Phrase the issue as a neutral question that captures the dispute. In criminal law, the issue might be: 'Did the defendant form the necessary mens rea when she took the bag?' In tort law: 'Does a bystander owe a duty of care to a trespasser who is injured on their land?' A well‑framed issue immediately tells the examiner you know what the parties are fighting about.
Most Year 9 scenarios contain only one or two issues. Do not invent third issues just to fill space. Depth is more important than breadth – a single issue analysed thoroughly will always score higher than three issues mentioned superficially.
4. Step 3 – State the Relevant Legal Rule |
Here you must state the rule that will resolve the issue. Use precise language: cite the name of a key case if you have one, or describe the principle from statute. For example, for negligence: 'Under the neighbour principle established in Donoghue v Stevenson, a person must take reasonable care to avoid acts or omissions which can reasonably be foreseen to injure their neighbour.' For omissions in criminal law: 'The general rule is that there is no duty to act, unless a special relationship exists or the defendant has created a dangerous situation.'
If you are using a precedent, be sure to extract the ratio decidendi, which is the binding reason for the decision. Merely dropping a case name without explaining its principle earns no marks.
5. Step 4 – Apply the Rule to the Facts |
Application is the heart of legal reasoning. Take each element of the rule and match it to the facts from your scenario. Show the examiner, step by step, how the law fits. For instance: 'Here, the defendant owed a duty of care to the claimant because the damage was foreseeable – when the defendant left a heavy box balanced on a shelf above a doorway, it was obvious that a passer‑by could be struck.'
Always use the facts you underlined earlier. If the scenario mentions the weather, a warning sign or a shouted remark, weave those details into your application. Generic statements like 'the defendant was careless' are too vague; the examiner wants to see 'the defendant drove at 45 mph in a 20 mph school zone at 3.15 pm when children were leaving the gates'.
6. Step 5 – Conclude with a Judgment |
Your conclusion must answer the issue you identified. It can be short: 'Therefore, the defendant is likely to be found liable for negligence because he fell below the standard of a reasonable driver.' If there are two possible outcomes, acknowledge the uncertainty and state which result is more probable based on the balance of probabilities.
In criminal case analyses, your conclusion should also specify the verdict: 'The defendant will be convicted of theft under s.1 of the Theft Act 1968 because he appropriated property belonging to another with the intention to permanently deprive.' Never leave a question hanging without a definite resolution.
7. Understanding Precedent: Ratio and Obiter |
When you use a past case, you need to know which part carries binding authority. The ratio decidendi is the legal principle that was necessary for the judge to reach the decision. Only the ratio is binding on future courts. Everything else the judge says by the way is called obiter dicta. Obiter dicta may be persuasive but never create a binding precedent.
A classic illustration comes from R v Howe. In that case, the House of Lords decided that duress is not a defence to murder – that is the ratio. In the same speech, the judge speculated about whether duress could ever be a defence to attempted murder. That remark was obiter and not binding, but it was later used persuasively in R v Gotts.
In a problem question, always signal to the examiner that you know which parts of a case are binding by saying: 'The ratio of the case establishes that…' or 'Following the precedent in…'.
8. Practice Drill 1: The Unlocked Car (Civil) |
Read the following scenario carefully. Then work through the IRAC steps below.
Facts: Emily parked her car on a busy street and left it unlocked with the keys in the ignition while she dropped a letter in a postbox five metres away. A stranger, Jake, jumped into the car and drove off at high speed. Thirty seconds later, Jake lost control and crashed into a garden wall belonging to Mr Singh, causing £2,000 worth of damage. Mr Singh is suing Emily in negligence, arguing that she should have foreseen the risk.
Issue: Did Emily owe a duty of care to Mr Singh for damage caused by a thief who stole her unlocked car?
Rule: The test for duty of care in novel situations comes from Caparo Industries plc v Dickman: (i) was the damage foreseeable, (ii) was there a relationship of proximity, and (iii) is it fair, just and reasonable to impose a duty? Additionally, courts are generally reluctant to impose a duty on a car owner for the criminal acts of a third party unless the risk was particularly obvious.
Application: It is reasonably foreseeable that an unlocked car with keys in the ignition may be stolen in a busy area. However, the damage to Mr Singh’s wall was caused by Jake’s dangerous driving, not directly by Emily. The relationship between Emily and Mr Singh is remote – they are strangers. The courts have held in cases like Topp v London Country Bus that a person is not generally liable for the criminal acts of others unless they have assumed responsibility or created a special risk. Leaving keys in a car is careless, but English law does not impose a general duty to prevent third‑party crime. It is unlikely that a court would find it fair, just and reasonable to make Emily pay for Jake’s crash.
Conclusion: Emily is unlikely to be held liable in negligence to Mr Singh. The claim would probably fail on the Caparo test, particularly the third limb.
9. Practice Drill 2: The School Prank (Criminal) |
Facts: During a chemistry lesson, 14‑year‑old Leo hid a beaker of harmless water behind a curtain and told his classmate, Mia, that it contained strong acid. Mia, believing Leo, became terrified and ran out of the room, tripping on the stairs and breaking her wrist. Police wish to charge Leo with assault occasioning actual bodily harm (ABH) under s.47 of the Offences Against the Person Act 1861.
Issue: Can an ABH charge be sustained when the victim’s injury was caused indirectly by fear, and can words alone amount to an assault?
Rule: An assault is committed when the defendant intentionally or recklessly causes the victim to apprehend immediate unlawful force. The actus reus can be satisfied by words alone, as confirmed in R v Ireland; R v Burstow (silent phone calls amounted to an assault). For ABH under s.47, the prosecution must prove an assault or battery that caused actual bodily harm, defined as any hurt or injury calculated to interfere with the health or comfort of the victim (R v Miller). The harm does not have to be direct; in R v Roberts, the victim jumped from a moving car to escape unwanted sexual advances and was injured – the defendant was held liable because his actions caused her to take the evasive action.
Application: Here, Leo’s words, 'that beaker contains strong acid', were meant to make Mia believe she was in immediate danger of being splashed by acid. This satisfies the apprehension of immediate force. Mia’s reaction – running and falling – was a foreseeable consequence of the fear Leo created. Her broken wrist is actual bodily harm. Applying Roberts, the chain of causation is not broken by Mia’s own act of fleeing because her response was proportionate to the threat she perceived. The mens rea for assault is intention or recklessness as to causing the victim to apprehend force; Leo acted deliberately, so the mental element is met.
Conclusion: Leo is likely to be convicted of s.47 ABH. The prank, while intended as a joke, satisfies all the actus reus and mens rea elements.
10. Common Mistakes in Case Analysis |
One frequent error is reciting the facts back without analysing them. The examiner already knows the scenario; your job is to put the facts to work. Another is mixing up ratio and obiter in a precedent question, which shows a misunderstanding of the doctrine of stare decisis. Students also lose marks by jumping straight to a conclusion without showing the steps of reasoning.
Avoid using 'I think' or 'in my opinion' – use 'the defendant is likely to be liable' or 'the court would probably find'. Write in the third person and keep your language objective. Also, never leave an alternative outcome without at least a brief explanation of why you prefer one over the other.
11. How to Improve Your Analysis Skills |
Practise with short news stories or fictional scenarios. Write a one‑paragraph IRAC for each. Swap drafts with a study partner and challenge each other’s applications. The more you practise, the faster you will become at spotting the rule and making a convincing argument.
Create a concise case bank for each topic area, listing the case name, the ratio decidendi and a two‑sentence summary of the facts. This transforms passive reading into active recall. Before an exam, spend fifteen minutes writing out ratios from memory – it is one of the most effective revision techniques.
12. Final Checklist for Exams |
Before you hand in your paper, run through this checklist:
Have I identified the key material facts? |
Have I stated the issue as a clear question? |
Have I named a relevant case or statutory provision and extracted the binding rule? |
Have I applied each element of the rule to the specific scenario facts? |
Have I reached a definite conclusion that answers the issue? |
If all boxes are ticked, you have delivered a rigorous piece of legal analysis. Keep this framework in mind whenever you face a problem question, and your answers will develop authority and clarity.
