📚 Year 8 Cambridge Law: Legal Formulas & Maxims Quick Reference Handbook |
Law can feel like a vast collection of rules, but at its heart, many legal outcomes can be understood through simple 'formulas' – structured ways of thinking about rights, wrongs, and responsibilities. This handbook collects the most essential legal 'formulas' and principles you will meet in Year 8 Cambridge Law, turning key concepts into easy-to-remember building blocks.
1. The Crime Formula: Actus Reus + Mens Rea |
For almost every criminal offence, the prosecution must prove two things beyond reasonable doubt: a guilty act and a guilty mind. The Latin terms are Actus Reus (the physical element) and Mens Rea (the mental element). If either is missing, there is usually no crime.
拉丁术语是Actus Reus(客观行为)和Mens Rea(主观心态)。
- Actus Reus can be an act, an omission (when there is a duty to act), or a state of affairs.
- Mens Rea can be intention (purpose), recklessness (awareness of a risk and going ahead anyway), or negligence (falling below a reasonable standard).
Actus Reus + Mens Rea → Criminal Liability
2. The Negligence Formula: Duty + Breach + Causation + Damage |
In civil law, the tort of negligence allows a person to claim compensation for harm caused by another's carelessness. The claimant must establish four elements. If even one link fails, the claim will not succeed.
| Duty of Care | The defendant owed a legal duty to the claimant (e.g. driver to pedestrian). | |
| Breach | The defendant fell below the standard of a reasonable person in that situation. | |
| Causation | The breach caused the damage, both in fact and in law (remoteness). | |
| Damage | The claimant suffered actual loss or injury recognised by the law. | |
Duty + Breach + Causation + Damage = Successful Negligence Claim
3. The Contract Formula: Offer + Acceptance + Consideration + Intention |
A legally binding contract does not need to be written down, but it must contain four key ingredients. Without any of these, the agreement is merely a social arrangement, not enforceable in court.
- Offer: a clear expression of willingness to be bound on certain terms, made by the offeror.
- Acceptance: an unqualified agreement to all the terms of the offer, communicated to the offeror.
- Consideration: something of value exchanged between the parties (e.g. money for goods), which makes the deal a bargain.
- Intention to create legal relations: both parties must intend the agreement to be legally binding; commercial agreements are presumed to have this intention, social ones are not.
Offer + Acceptance + Consideration + Intention → Enforceable Contract
4. The Sources of Law Hierarchy |
In the English legal system, not all laws carry the same weight. Understanding the hierarchy helps you know which rule prevails in a conflict. The formula moves from the highest authority downwards.
Parliamentary Sovereignty (Acts of Parliament) > Delegated Legislation > Common Law (Judicial Precedent)
Parliament can make or unmake any law, and courts must apply Acts of Parliament. However, judges also develop law through precedent, filling gaps where statute is silent, but they cannot override an Act of Parliament.
5. The Statute-Making Formula: From Bill to Act |
An idea becomes law through a structured legislative process in the UK Parliament. The journey involves both the House of Commons and the House of Lords, and ends with Royal Assent.
ttee Stage → Report Stage → Third Reading → Other House → Royal Assent → Act of Parliament
Once a Bill completes all stages in both Houses and receives Royal Assent, it becomes law and is known as an Act of Parliament. This process is a key part of the separation of powers and ensures thorough scrutiny.
6. The Court Hierarchy and Precedent Formula |
The doctrine of judicial precedent (stare decisis) means 'to stand by things decided'. Lower courts are bound by the decisions of higher courts in similar cases. The hierarchy determines which rulings must be followed.
| Supreme Court | Binds all courts below; normally follows its own past decisions unless it departs from them using the Practice Statement 1966. | |
| Court of Appeal | Bound by the Supreme Court; its own decisions bind lower courts and, with few exceptions, itself. | |
| High Court | Bound by the Court of Appeal and Supreme Court; its decisions bind lower courts but not itself (though they are strongly persuasive). | |
| Lower Courts (Crown, Magistrates', County) | Bound by all higher courts' decisions. | |
For a precedent to bind, the material facts of the present case must be sufficiently similar, and the earlier court must be higher in the hierarchy. The ratio decidendi (reasoning) binds; obiter dicta (other comments) are persuasive only.
7. The Presumption of Innocence Formula |
This is the golden thread of criminal law: 'everyone is innocent until proven guilty.' Legally, this translates into a burden of proof placed on the prosecution and a high standard of proof.
Prosecution Proves Case Beyond Reasonable Doubt → Guilt
The defendant does not normally have to prove their innocence. This principle is reinforced under Article 6 of the European Convention on Human Rights (right to a fair trial). If the jury or magistrates are left with any reasonable doubt, they must acquit.
8. The Natural Justice Formula: The Right to a Fair Hearing |
Natural justice underpins all decision-making that affects a person's rights. It can be reduced to two Latin maxims that act as a formula for procedural fairness.
emo judex in causa sua (no one should be a judge in their own cause) → Procedural Fairness
This means any person accused or facing a decision must know the case against them and have a genuine opportunity to respond. The decision-maker must be impartial, free from bias, and have no personal interest in the outcome. These rules apply in courts, tribunals, and even school disciplinary panels.
9. The Human Rights Key Rights Formula |
Under the Human Rights Act 1998, certain Convention rights are directly applicable in UK courts. You can think of these as a set of protected freedoms and limits on state power. Three types often interact.
Absolute rights + Limited rights + Qualified rights → Human Rights Protection
- Absolute rights (e.g. freedom from torture, Article 3) cannot be interfered with in any circumstances.
- Limited rights (e.g. right to liberty, Article 5) can be limited only in defined situations, such as lawful detention.
- Qualified rights (e.g. respect for private life, Article 8; freedom of expression, Article 10) can be interfered with if the restriction is prescribed by law, has a legitimate aim, and is necessary in a democratic society.
This structure ensures a balance between individual freedoms and the wider community interest.
10. The Age of Criminal Responsibility and Youth Justice Formula |
In England and Wales, children are treated differently under criminal law. The age of criminal responsibility is a bright-line rule: under a certain age, a child cannot be guilty of a crime, regardless of their act or understanding.
ge < 10 years → Irrebuttable presumption of doli incapax (incapable of committing a crime)
Age 10–17 years → Youth Court, special sentencing principles (welfare paramount)
Those aged 10–17 are dealt with in the Youth Court, which has a less formal atmosphere, and sentences focus on rehabilitation and preventing reoffending. The primary aim is the welfare of the child, even when imposing punishment.
