1. What is Case Study Analysis? |
A case study in law is a detailed examination of a real or hypothetical legal dispute. When we analyse a case, we do not just describe what happened; we break down the facts, spot the legal questions hidden inside them, and apply rules from statutes or court decisions to find a fair solution. This process mirrors what judges and solicitors do every day in the Sheriff Court and the Court of Session in Scotland.
To analyse a case effectively, you need to master four key steps: recognising the material facts, identifying the legal issue(s), stating the relevant legal principle, and applying that principle to see if a claim or defence is likely to succeed. These steps form the backbone of every exercise in this article.
2. Key Legal Principles for Case Analysis |
Before jumping into our case scenarios, it helps to refresh a few foundational concepts that appear again and again in SQA Law. In delict (the Scots term for civil wrongs, similar to tort in England), you will often encounter the duty of care and the neighbour principle. In contract law, look for offer, acceptance, consideration and intention to create legal relations. In criminal law, you must identify both the actus reus (the guilty act) and the mens rea (the guilty mind), and remember that in Scotland a child under 12 cannot be prosecuted. In family and human rights cases, the welfare of the child is paramount, and individual freedoms are protected by the Human Rights Act 1998 and the European Convention on Human Rights.
Keep these principles in mind as you read each case. The real skill lies in knowing which principle to apply when the facts are messy and the parties disagree.
3. Case 1: The Slippery Floor – Negligence |
Facts
On a rainy Saturday morning, Mrs Jones visited her local supermarket. A cleaner had just mopped the floor at the end of the fruit aisle but forgot to place a 'wet floor' warning sign. As Mrs Jones reached for a bag of apples, her foot slipped on the damp surface. She fell heavily and fractured her wrist. Medical evidence confirmed she would be unable to work as a piano teacher for six weeks. Mrs Jones now wishes to claim compensation from the supermarket.
Legal issue
Did the supermarket owe a duty of care to Mrs Jones? Was that duty breached? And did the breach directly cause her injury and financial loss?
Application of the law
In Scots delict law, the famous case Donoghue v Stevenson 1932 SC (HL) 31 established the 'neighbour principle'. A person must take reasonable care to avoid acts or omissions that they can reasonably foresee would be likely to injure their neighbour. A customer inside a supermarket is clearly the shop's neighbour. It is entirely foreseeable that a wet floor without a warning could cause someone to slip and suffer injury. By failing to put out a sign, the supermarket breached its duty of care. This breach was the direct cause of the fall, and the fall was the direct cause of the broken wrist. There is a clear chain of causation. Moreover, the type of harm – physical injury – and the consequential loss of earnings are recoverable in negligence.
Conclusion
The supermarket is likely liable in delict for negligence. Mrs Jones has a strong case and would be entitled to damages for her injury, her pain and suffering, and the six weeks of lost income.
4. Case 2: The Portrait Promise – Contract or Just Words? |
Facts
Tom is an art student. His friend Kate admired his sketches and said, 'Please paint a portrait of me. I'll pay you £50 when it's done.' Tom agreed, spent three weekends completing the portrait, and bought special paints costing £15. When he presented the finished work to Kate, she laughed and said, 'I was only joking! We're friends – you didn't really think I'd pay, did you?' Tom now wants to recover at least the £50 or his expenses.
Legal issue
Was a legally binding contract formed between Tom and Kate? The key disputed element is whether there was an intention to create legal relations. Additionally, we need to check whether the other requirements – offer, acceptance and consideration – were present.
Application of the law
Kate's words, 'Paint a portrait of me. I'll pay you £50,' amount to a clear offer. Tom accepted by beginning to paint and completing the work. Consideration exists on both sides: the portrait for Kate, and the promise of £50 for Tom. That leaves the final element – intention to create legal relations. In social or domestic arrangements, the law presumes there is no such intention unless there is evidence to the contrary. However, when a clear price is agreed and one party relies on the promise to their detriment (buying expensive paints, spending many hours), the arrangement may cross the line from a purely social one into a commercial one. The fact that Kate specified a sum and Tom acted to his detriment strongly suggests the parties did intend to create a binding deal. Her later claim that it was a 'joke' is unlikely to defeat the contract if a reasonable person in Tom's position would have believed the offer was serious.
Conclusion
A valid contract likely existed. Kate's failure to pay is a breach of contract. Tom could claim the £50 agreed price, or at the very least recover his £15 expenses under the principle of reliance loss.
5. Case 3: The Stolen Sweets – Young Offender |
Facts
Craig, aged 13, walked into a corner shop in Glasgow after school. While the shopkeeper was busy with another customer, Craig slipped three packets of chocolate sweets into his school bag and left without paying. He was stopped outside by a community police officer who had seen everything on CCTV. When questioned, Craig admitted, 'I wanted the sweets and I didn't have any money, so I just took them.'
Legal issue
Has Craig committed theft? And if so, what happens to a 13-year-old under Scots law?
Application of the law
Theft in Scots law is the taking and carrying away of property belonging to another person, without consent, with the intention of permanently depriving the owner of it. The physical act (actus reus) is clearly present: Craig took the sweets and left the shop. The required mental element (mens rea) is also there: he admitted he intended to keep the sweets, knowing he had no right to them. The age of criminal responsibility in Scotland is 12. This means Craig, at 13, can be held criminally responsible. However, simply because he is legally responsible does not mean he will automatically be prosecuted in an adult court. For most offences committed by children under 16, the case is referred to the Children's Reporter, who may arrange a Children's Hearing. The Hearing focuses on the child's welfare and needs rather than punishment. It could impose measures such as a police warning, a requirement to apologise, or a compulsory supervision order.
Conclusion
Craig has technically committed theft, but the response will almost certainly be through the Children's Hearing system rather than a criminal trial. The focus will be on why he stole and how to prevent it happening again.
6. Case 4: The Overhanging Branches – Neighbour Nuisance |
Facts
Mrs Brown owns a large apple tree that overhangs her neighbour Mr Smith's garden. During a summer storm, a heavy branch broke and fell onto Mr Smith's greenhouse, smashing three glass panels. The fallen apples also dented his lawnmower. Frustrated, Mr Smith cut back the overhanging branches all the way to the boundary line and threw the cut branches and apples over the fence into Mrs Brown's garden. Mrs Brown is upset, saying the branches and fruit were her property.
Legal issue
Who is liable for the damage caused by the falling branch? And does a neighbour have the right to cut overhanging branches, and what must be done with the cuttings?
Application of the law
In Scots property law, the owner of a tree is generally liable if it causes damage through negligence. If Mrs Brown knew the branch was dead or dangerously overhanging and did nothing, she could be liable for the harm to the greenhouse under the law of nuisance or delict. However, storm damage is sometimes treated as an 'act of God' if it was unforeseeable. Still, a reasonable tree owner should regularly inspect and maintain trees that overhang a neighbour's property. Regarding the right of abatement (self-help remedy), a landowner is entitled to cut back branches that encroach over the boundary, but must do so reasonably, without entering the neighbour's land without permission. Crucially, the cut branches and any fruit remain the property of the tree owner. Mr Smith was entitled to cut back to the boundary, but he should have offered the cuttings and fruit back to Mrs Brown, not thrown them over the fence in a way that might cause further nuisance.
Conclusion
Mrs Brown may be partly liable if she failed to maintain the tree. Mr Smith acted within his rights by cutting the branches, but his disposal of the material was improper. A better solution would be for the neighbours to discuss maintenance and share costs, or one could seek a court order if agreement is impossible.
