Welcome to your essential quick reference guide for Year 8 SQA Law. Although law does not have mathematical equations in the traditional sense, it relies on core principles, Latin maxims and conceptual 'formulae' that help us determine outcomes in cases. This handbook distils those key ideas into accessible points, covering everything from the rule of law and court structures to the elements of a crime and fundamental human rights. Use it to memorise, revise and deepen your understanding of how law works in Scotland.
1. The Rule of Law |
The rule of law is the foundation of any democratic society. It means that nobody is above the law, including government officials, and that laws must be clear, publicised and applied equally. This principle protects citizens from arbitrary rule and ensures that justice is predictable and fair. In Scotland, the rule of law underpins the entire legal system and is safeguarded by an independent judiciary.
The key requirements are that laws are prospective, not retrospective; they are made following a proper procedure; and disputes about alleged breaches are resolved by impartial courts. Without the rule of law, rights become meaningless promises.
2. Sources of Law in Scotland |
Scotland has a mixed legal system, drawing on both civil law traditions and common law. Understanding where laws come from helps you predict how a judge might decide a case. The principal sources are legislation (statute law) passed by the UK Parliament and the Scottish Parliament, and common law developed through court decisions (precedent).
European Union law and the European Convention on Human Rights (ECHR) also have significant influence, as do institutional writers and customary practices. Within Scotland, 'institutional writings' such as those by Stair and Erskine still hold persuasive authority.
|---|---|
| Legislation 立法 | Acts of Parliament; supreme over common law. |
| Precedent 判例 | Decisions of higher courts bind lower courts. |
| ECHR 欧洲人权公约 | Protects fundamental rights; can be raised in Scottish courts. |
3. Actus Reus and Mens Rea: The Guilty Act and Guilty Mind |
In criminal law, the 'formula' for most offences is: Actus Reus + Mens Rea = Crime. Actus reus refers to the guilty act – ssion or state of affairs that constitutes the offence. Mens rea refers to the guilty mind – recklessness or knowledge. Both must usually be present at the same time for a conviction.
For example, in assault, the actus reus is the physical attack, while the mens rea is the intention to cause injury or reckless disregard for the victim's safety. Some offences, known as strict liability offences, do not require mens rea – the guilty act alone is sufficient.
- Actus reus can include an omission (failure to act) when a duty of care exists.
- Mens rea terms: intention (purpose), recklessness (conscious risk-taking), negligence (below reasonable standard).
4. Scottish Court Structure |
The Scottish court system is hierarchical, with different courts handling criminal and civil matters. For criminal cases, the main courts are the Justice of the Peace Court, Sheriff Court and High Court of Justiciary. For civil disputes, the Sheriff Court and Court of Session are most important, with the UK Supreme Court as the final court of appeal in civil cases.
The High Court of Justiciary deals with the most serious crimes (murder, rape) and has exclusive jurisdiction over certain offences. The Sheriff Court can hear cases with a judge and jury (solemn procedure) or with a sheriff sitting alone (summary procedure).
f the Peace Court → Sheriff Court (Summary & Solemn) → High Court of Justiciary (Criminal) | Sheriff Court → Court of Session (Inner/Outer House) → UK Supreme Court (Civil)
5. The Presumption of Innocence |
One of the most vital principles of justice is the presumption of innocence. Every person accused of a crime is considered innocent until proven guilty beyond a reasonable doubt. This means the prosecution must prove the accused's guilt, not the other way around. The defence does not have to prove innocence.
This principle is protected under Article 6 of the European Convention on Human Rights and is reflected in Scottish criminal procedure. It puts a heavy burden on the Crown to present sufficient, credible evidence. If there is a reasonable doubt, the accused must be acquitted.
6. Burden and Standard of Proof |
Closely linked to the presumption of innocence is the concept of proof. The 'burden of proof' refers to which party must prove the facts in a case. In criminal trials, the burden lies on the prosecution. The 'standard of proof' is the level of certainty required: in criminal cases, it is 'beyond reasonable doubt'; in civil cases, it is 'on the balance of probabilities'.
The formula can be remembered as: Criminal = 'beyond reasonable doubt' (very high), Civil = 'more likely than not' (above 50% a defence may have a burden, for example if a special defence like self-defence is raised.
| Case Type 案件类型 | Standard of Proof 证明标准 | Burden Usually On 举证责任通常由……
|---|---|---|
| Civil 民事 | Balance of probabilities 盖然性权衡 | Pursuer (claimant) 原告 |
7. Types of Criminal Offences |
Scottish law classifies crimes by their seriousness and the procedure used. The main distinction is between common law crimes and statutory offences. Common law crimes (e.g. murder, theft, assault) have been developed by courts over centuries. Statutory offences are created by Acts of Parliament, such as road traffic offences and many modern regulatory crimes.
Procedurally, crimes are also divided into those tried under solemn procedure (before a jury) and summary procedure (judge alone). The most serious crimes, like murder and rape, can only be tried on indictment in the High Court. Less serious crimes may be tried in the Sheriff Court or Justice of the Peace Court.
8. Key Latin Maxims for Young Lawyers |
Latin phrases act like shorthand formulae in law. They pack complex legal ideas into a few words. Knowing them will help you recognise legal reasoning in judgments. Here are some you must memorise for SQA study:
- Actus non facit reum nisi mens sit rea – 'An act does not make a person guilty unless the mind is also guilty.'
- Ignorantia juris non excusat – 'Ignorance of the law is no excuse.'
- Audi alteram partem – 'Hear the other side.' A principle of natural justice.
- Nemo tenetur seipsum accusare – 'No one is bound to accuse himself.' The right against self-incrimination.
- Res ipsa loquitur – 'The thing speaks for itself.' Used when facts suggest negligence.
9. The Age of Criminal Responsibility |
In Scotland, the age of criminal responsibility was raised to 12 by the Age of Criminal Responsibility (Scotland) Act 2019. This means a child under 12 cannot be prosecuted or convicted of an offence. The law recognises that children below this age lack the capacity to form the necessary criminal intent.
While a child under 12 cannot be held criminally responsible, harmful behaviour can still be addressed through child protection measures and referral to a children's hearing. The law balances the need to protect society with the developmental needs of children.
- Before 2019, the minimum age of prosecution was 8. 2019年之前,最低起诉年龄为8岁。
- The United Nations has recommended that states set the age at least at 14.
10. Key Human Rights Articles in the ECHR | 《
The European Convention on Human Rights (ECHR) sets out fundamental rights that public authorities in Scotland must respect. Several articles create a framework of protections that function like 'rights equations' – if certain conditions are met, the right must be upheld.
| Article 条款 | Right 权利 | Real-life Connection 现实关联 |
|---|---|---|
| Article 2 | Right to life 生命权 | The State must protect life and investigate deaths. |
| Article 3 | Prohibition of torture and inhuman treatment 禁止酷刑和不人道待遇 | Absolute right; no exceptions. |
| Article 5 | Right to liberty and security 自由和安全权 | No arbitrary arrest or detention. |
| Article 6 | Right to a fair trial 公正审判权 | Includes presumption of innocence, access to lawyer. |
| Article 8 | Right to respect for private and family life |
| Article 10 | Freedom of expression 言论自由 | Qualified right; can be restricted for public safety. |
The Scotland Act 1998 requires that the Scottish Parliament and Government act compatibly with ECHR rights. This makes these articles directly relevant to how law is made and applied in Scotland.
11. Legal Vocabulary Essentials |
Every legal system has its own language. Here is a rapid-fire glossary of terms you will encounter. Think of them as the building blocks for all legal 'formulae'. Accused: the person charged with a crime. Prosecutor: the legal party bringing the case against the accused (in Scotland, the Procurator Fiscal). Verdict: the decision reached by a judge or jury (guilty, not guilty, not proven in Scotland).
Precedent: a court decision that serves as an example for future similar cases. Statute: a written law passed by a legislative body. Civil law: deals with disputes between individuals or organisations. Criminal law: deals with offences against the state. Liability: legal responsibility for one's actions or omissions.
12. Putting It All Together: A Case Analysis 'Formula' |
When given a scenario, use this structured approach to identify legal issues. First, spot the area of law (criminal, civil, human rights). Second, identify the relevant facts. Third, apply the key principle or 'formula' (e.g., actus reus + mens rea). Fourth, consider any defences or exceptions. Finally, reach a reasoned conclusion.
ng an argument, and Ben falls and breaks his arm. Area: criminal law (assault). Fact: Alex' or recklessness) = potential assault. Defence: perhaps self-defence if Ben attacked first? Check evidence. Conclusion: Alex likely commits assault, unless a valid defence applies.
