📚 Year 8 WJEC Law: Formula & Theorem Quick Reference Handbook | Year 8 WJEC
Law may not look like maths, but it is full of logical structures that work like formulas. Just as you solve equations with symbols, you can break down legal problems using core elements and predictable rules. This handbook gathers the key legal "formulas" you need for Year 8 WJEC Law — from the building blocks of a crime to how contracts come to life. Each section presents a rule in a simple equation style, followed by clear explanation and an example. Use this to revise quickly, check your understanding, and train your legal reasoning as if you were solving puzzles.

1. The Basic Crime Formula |
Crime = Actus Reus + Mens Rea
A person is guilty of most crimes only if two parts are proven: the physical act (actus reus) and the mental element (mens rea). Actus reus means the guilty act — doing something forbidden, or sometimes failing to act when there is a duty. Mens rea means the guilty mind — intending to do the act or being reckless about the consequences. If either element is missing, a conviction usually cannot be secured. This formula is the backbone of criminal liability in English law.
n is the mens rea. So crime = actus reus + mens rea. But if Sam mistakenly picks up an identical phone believing it is his own, there is no mens rea — therefore no crime.
2. Theft Quick Formula |
opriation of Property Belonging to Another + Dishonesty + Intention to Permanently Deprive
Under the Theft Act 1968, theft has three essential ingredients. Appropriation means taking, using, or controlling someone else’s property as if it were your own. The property must belong to another person. Dishonesty is judged by the standards of ordinary decent people; certain defences (like believing you have a legal right) may make the act not dishonest. Finally, the intention to permanently deprive the owner of the property separates theft from mere borrowing.
Example: If Mia swaps the price tag on an expensive jacket to pay less, she appropriates the jacket, acts dishonestly, and intends to keep it — theft is complete.
3. Strict Liability Equation |
Strict Liability Offence = Actus Reus (no mens rea required)
For certain regulatory offences, mens rea is not required. These are called strict liability offences. It is enough that the defendant did the prohibited act; the prosecution does not have to prove intent or recklessness. Common examples include selling alcohol to underage customers, food safety violations, or driving without insurance. The law focuses on protecting the public and making enforcement straightforward.
re very limited, but the prosecution must still prove the actus reus happened voluntarily.
4. Causation Chain Theorem |
Liability = Actus Reus + Causation (Factual + Legal) + No Intervening Act
Causation links the defendant’s act to the harm. Factual causation asks: 'But for the defendant’s action, would the harm have occurred?' If the answer is no, factual causation exists. Legal causation asks whether the defendant’s act was a substantial and operating cause of the harm. An intervening act (novus actus interveniens) can break the chain of causation if it is an unforeseeable event or a free, voluntary act by a third party.
Example: Alex pushes Ben, who falls and hits his head. The ambulance is delayed by a storm, and Ben dies. The storm is an intervening act? No — medical complications and ordinary delays do not usually break the chain. Alex remains liable for the death.
5. Omissions Rule — When Inaction = Actus Reus |
Omissions Liability = Legal Duty to Act + Failure to Act + Resulting Harm
In English law, you are not generally liable for doing nothing, even if you could easily help. However, liability for omissions arises when a legal duty to act exists. Such a duty can come from a statute, a contract, a special relationship (parent–child), an assumption of care, or creating a dangerous situation. If you have a duty, fail to perform it, and harm results, you may be guilty of a crime exactly as if you had acted.
Example: A lifeguard employed to watch a pool falls asleep and a swimmer drowns. The contract creates a duty; the failure to act becomes actus reus.
6. Non-Fatal Offences Flowchart |
Assault = Causing Victim to Apprehend Immediate Unlawful Force (no contact needed)
Battery = Application of Unlawful Force (even slight contact)
ABH = Assault or Battery + Actual Bodily Harm (s.47)
GBH = Wounding or Inflicting Grievous Bodily Harm (s.20, s.18 with intent)
These non-fatal offences form a ladder of severity. Assault and battery are the lowest level and are summary offences. Actual bodily harm (ABH) requires some injury, even if minor, such as bruises or scratches. Grievous bodily harm (GBH) involves serious injury. Under s.20 the mens rea is recklessness or intent to cause some harm; under s.18 there must be specific intent to cause grievous bodily harm or resist arrest.
Formula: Start at the bottom: was there assault or battery? Then ask: did an injury result? If yes, ABH. Then ask: was it really serious? If yes, GBH. Always check mens rea level.
7. Contract Formation Formula |
Valid Contract = Offer + Acceptance + Consideration + Intention to Create Legal Relations
A contract is a legally binding agreement. An offer is a clear statement of terms by one party (the offeror) showing willingness to be bound. Acceptance must match the offer exactly and be communicated to the offeror. Consideration is something of value exchanged between the parties — each must give something. Intention to create legal relations means both sides meant to be legally bound. In social or domestic agreements, this intention is usually presumed absent unless proved otherwise.
Example: Jamil offers to sell his bike to Ellie for £100. Ellie says 'I accept.' The bike is the consideration from Jamil, £100 from Ellie. They both clearly intended to be bound — a contract exists.
8. Negligence Triangle |
Negligence = Duty of Care + Breach of Duty + Damage (caused by the breach)
In tort law, negligence allows a claimant to recover compensation for harm caused by another’s carelessness. First, the defendant must owe the claimant a duty of care. The neighbour principle from Donoghue v Stevenson tells us to foresee who might be affected by our actions. Second, the defendant must breach that duty by falling below the standard of a reasonable person. Third, the breach must cause recoverable damage that is not too remote. All three points must be proved on the balance of probabilities.
Formula use: Tick each box — duty, breach, causation of damage. Without one, the negligence claim fails.
9. Defences to Crimes — The Shield Formulas |
t of Reason + Disease of the Mind + Not Knowing Nature/Quality of Act or That It Was Wrong
Automatism = Total Loss of Voluntary Control + External Factor
Self-defence = Honest Belief in Need to Defend + Reasonable Force
Defences can remove liability even if the actus reus and mens rea are present. Insanity is a legal, not medical, test — the defendant must prove they met the M’Naghten rules. Automatism applies where the defendant’s body moves without conscious control, e.g., due to a spasm, reflex, or an unexpected blow. Self-defence allows reasonable force to protect oneself, others, or property; the force must be proportionate to the threat as the defendant honestly perceived it.
Formula: If crime components are satisfied, check which shield applies. A successful defence means 'not guilty'.
10. Sentencing Factors Equation |
Sentence = Starting Point from Guideline + Aggravating Factors – Mitigating Factors
When a court decides a sentence, it uses sentencing guidelines to find the starting point based on the seriousness of the offence and the harm caused. Then it adds time for aggravating factors, such as a weapon being used, a vulnerable victim, or previous convictions. It reduces the sentence for mitigating factors, like an early guilty plea, showing remorse, or having no previous convictions. The result must be fair and serve the purposes of punishment, deterrence, protection of the public, and rehabilitation.
Remember: A guilty plea at the earliest opportunity can reduce a sentence by up to one third.
11. Legal System Hierarchy Formula |
hy = Supreme Court binds Court of Appeal < lower courts. Statute prevails over common law.
English law follows a clear hierarchy of sources and courts. The Supreme Court is the highest court and its decisions bind all courts below. The Court of Appeal binds itself and lower courts. High Court decisions bind County and Magistrates’ Courts but not other High Court judges. Statutes (Acts of Parliament) are the supreme form of law and override common law rules made by judges. Understanding this pyramid is essential to apply legal rules correctly.
Quick check: If there is a conflict between a statute and a case, the statute wins.
12. Interpretation of Statutes — The Rule Toolkit |
Literal Rule = Plain, Ordinary Meaning of Words
Golden Rule = Modified Literal Meaning to Avoid Absurdity
Mischief Rule = What Was the Problem the Statute Meant to Cure?
Judges use these interpretation tools to work out what an Act of Parliament really means. Start with the literal rule: read the words as they are. If that leads to an absurd result, use the golden rule to make a small adjustment. If the meaning is still unclear, go to the mischief rule: look at the problem the law was designed to fix and interpret the words to suppress that mischief. These formulas help you predict how a court will read a statute.
Example: A statute says ‘no vehicles in the park’. Under the literal rule a bicycle is a vehicle. But if applying it would stop a baby’s pram or a police motorbike on patrol, the golden rule might adjust the meaning to avoid absurdity. The mischief rule would ask what nuisance the law was really targeting.
