1. What is Law? |
Law is a system of rules created and enforced by the state to regulate behaviour. It maintains order, protects individuals and property, and provides a framework for resolving disputes. Without law, society would be chaotic. Legal rules are backed by sanctions, such as fines, imprisonment or compensation orders, which distinguish them from social customs.
Law also reflects the values of a society at a particular time, but it is not the same as morality. While many laws have a moral basis – such as those against murder or theft – some laws govern purely practical matters, like driving on the left. Understanding this distinction helps us evaluate whether a law is just.
2. Sources of Law |
In England and Wales, there are two main sources of law: statute law, made by Parliament, and common law, developed by judges. Parliament, as the supreme law-making body, passes Acts that cover all areas of legal life. Under the doctrine of parliamentary sovereignty, no other body can override an Act of Parliament.
Common law arises from the decisions of judges in individual cases. When a higher court decides a point of law, that decision becomes a precedent which lower courts must follow. This system, known as stare decisis, ensures consistency and predictability in the law. Judges also have a role in interpreting statutes when the wording is ambiguous.
3. Criminal Law vs Civil Law |
Criminal law deals with conduct considered harmful to society as a whole. The state, through agencies like the Crown Prosecution Service, prosecutes individuals accused of crimes. If the defendant is found guilty beyond reasonable doubt, the court imposes a punishment such as a prison sentence, a fine or community service.
Civil law, by contrast, resolves disputes between individuals or organisations. Common examples include breach of contract, negligence and family matters. The person bringing the claim, the claimant, must prove their case on the balance of probabilities. The usual remedy is damages – financial compensation – rather than punishment.
4. Elements of a Crime: Actus Reus and Mens Rea |
To secure a conviction in criminal law, the prosecution must normally prove two elements: the actus reus (guilty act) and the mens rea (guilty mind). The actus reus is the physical element of the crime – it could be an action, such as striking someone, or an omission when there is a legal duty to act.
The mens rea refers to the mental state of the defendant at the time of the act. The main levels are intention (a deliberate decision to bring about a consequence) and recklessness (knowing there is a risk but proceeding anyway). Both the actus reus and mens rea must coincide in time for liability to be established.
5. The Court System |
The court structure in England and Wales is a hierarchy. At the bottom are the magistrates' courts, which handle the majority of criminal cases, including summary offences like minor traffic violations. More serious indictable offences, such as robbery or murder, are tried in the Crown Court before a judge and jury.
In civil matters, the County Court deals with less valuable claims, while the High Court handles more complex cases. Appeals from these courts go to the Court of Appeal and, if a point of law of public importance is involved, to the Supreme Court, which is the final court of appeal in the UK.
6. Age of Criminal Responsibility |
In England and Wales, the age of criminal responsibility is 10 years old. Children under 10 are deemed incapable of forming criminal intent – a principle known as doli incapax. This means they cannot be prosecuted for any offence, no matter how serious, because the law presumes they cannot understand the consequences of their actions.
Young people aged 10 to 17 are usually dealt with in the youth court, which is a specialist branch of the magistrates' court. The youth court emphasises rehabilitation and education, and the sentences available are different, focusing on preventing reoffending rather than purely on punishment.
7. Defences in Criminal Law |
Even when the prosecution proves actus reus and mens rea, a defendant may avoid liability by raising a valid defence. Self-defence allows a person to use reasonable force to protect themselves or another from an attack. The force used must not be disproportionate to the threat faced.
Other defences include insanity, where the defendant did not understand the nature or wrongfulness of their act, and duress, where they were forced to commit a crime under threat of death or serious injury. Each defence has detailed legal tests that have been developed through case law.
8. The Legal Profession |
There are several key roles within the legal profession. Solicitors are often the first point of contact for clients. They provide legal advice, draft wills and contracts, and may represent clients in the lower courts. Many solicitors work in private practice, but others are employed in-house by companies or government bodies.
Barristers are specialist advocates who represent clients in the higher courts. They are usually instructed by solicitors to provide expert opinions on complex matters or to conduct trials. Judges, who may be former barristers or solicitors, preside over court proceedings and must remain impartial, ensuring that the law is applied correctly.
9. Human Rights and the Law |
The Human Rights Act 1998 brought the European Convention on Human Rights into UK law. This means individuals can rely on Convention rights in domestic courts. Fundamental rights protected include the right to life (Article 2), the prohibition of torture (Article 3), the right to a fair trial (Article 6) and the right to respect for private and family life (Article 8).
All public authorities, like the police or local councils, must act in a way that is compatible with these rights. If a person believes their rights have been breached, they can bring a claim in court. Courts can issue declarations of incompatibility, putting pressure on Parliament to change the law.
10. Law, Morality and Justice |
Law, morality and justice are closely linked but distinct concepts. Legal rules are enforceable by the state, while moral rules are enforced by social pressure and individual conscience. It is possible for an action to be legal but morally questionable, such as some forms of tax avoidance, or immoral but not illegal, such as telling a lie in many situations.
Justice is an ideal that legal systems strive to achieve. Procedural justice means that cases are handled fairly, with both sides heard. Substantive justice means that the law itself produces fair outcomes. Debates about justice arise when laws seem to produce unfair results, prompting calls for reform.
