By working through real-life style scenarios, you will build essential critical thinking and reasoning skills that are at the heart of studying law.
1. Introduction to Case Analysis |
Case analysis is the method lawyers and judges use to solve legal disputes. A legal case is simply a story where two or more people have a disagreement that the law can settle. To analyse a case, you must look at the facts carefully, find the legal issue, and apply the relevant rules.
In Year 7 Law, we focus on building the habit of structured thinking. You will not need to memorise long statutes, but you will learn to ask the right questions: Who is involved? What event caused the problem? Which law might apply? What outcome seems fair and legally sound?
2. Understanding Legal Cases |
A legal case has four main parts: the parties, the facts, the legal issue, and the outcome or remedy sought. The parties are the people or organisations on either side of the dispute. In a criminal case, the state prosecutes the defendant; in a civil case, the claimant sues the defendant.
Facts are the events that actually happened. You must separate important facts from unimportant details. For instance, if someone took a bicycle without permission, the fact that the bicycle was locked is important because it shows the owner did not consent. The colour of the bicycle may not matter at all.
The legal issue is the question of law that the court must decide. For example, 'Did the defendant commit theft?' or 'Did the shop owner fail in their duty of care?'. The remedy is what the claimant wants the court to do – such as awarding damages, returning property, or punishing a wrongdoer.
3. The IRAC Method | IRAC方法
A powerful tool for case analysis is the IRAC method, which stands for Issue, Rule, Application, and Conclusion. This structure helps you organise your thoughts clearly and logically, just like a real lawyer would do.
The Issue is the legal question that needs an answer. The Rule is the law or legal principle that applies to that issue. Application means you connect the facts of the case to the rule, explaining how the rule works in this specific situation. Finally, the Conclusion is your decision on the issue, based on the application.
For every case study we examine, you will be asked to identify the issue, state the rule in your own words, apply the rule to the facts, and then draw a short conclusion. Practice with this method will make your answers much stronger and more persuasive.
4. Case 1: The Stolen Bicycle |
Read the following scenario carefully. Sam left his new bicycle locked to a school bike rack. Later, Alex removed the lock using a tool and rode the bicycle to a nearby park. Alex never returned the bicycle and told a friend, 'I just borrowed it, but Sam doesn't know.' The next day, Sam discovered the bicycle missing and reported the matter.
Now let's apply IRAC. Issue: Is Alex criminally liable for theft of the bicycle? Rule: Theft is the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. Application: Alex took the bicycle without Sam's consent. He broke the lock, which shows he knew Sam did not agree. He kept the bicycle and had no plan to return it, which suggests an intention to permanently deprive. The fact that he called it 'borrowing' does not matter because the owner did not agree and Alex knew this.
Conclusion: Alex is likely guilty of theft because all the elements are met: he acted dishonestly, he took property belonging to another, and he intended to keep it permanently.
5. Case 2: A Slippery Floor |
Maria went to a local supermarket. Near the drinks aisle, she slipped on a patch of spilt juice that had not been cleaned up. There were no warning signs. Maria fell and broke her wrist. She later found out that the spillage had been there for over an hour and staff had walked past it several times without taking action.
Issue: Is the supermarket liable for negligence for Maria's injury? Rule: Under the law of negligence, an occupier owes a duty of care to visitors to keep the premises reasonably safe. If they breach that duty and cause injury, they must compensate the injured person.
Application: The supermarket had a duty of care to Maria as a customer. The spillage created a foreseeable risk of slipping. Staff knew or should have known about the spillage because it had been there for over an hour. By failing to clean it up or put out a warning sign, the supermarket breached its duty. This breach directly caused Maria's fall and wrist fracture.
Conclusion: The supermarket is likely liable in negligence and Maria would be entitled to compensation for her injury. This case shows how the law protects people from careless behaviour in public places.
6. Case 3: The Broken Promise |
Liam agreed to pay his neighbour Ethan £50 to wash and polish his car on Saturday morning. Ethan spent money on special cleaning products and arrived at Liam's house on time. However, Liam changed his mind and said he no longer wanted the car washed. Ethan was upset because he had turned down another job to do this one.
Issue: Is there a binding contract and has Liam breached it? Rule: A legally binding contract requires an offer, acceptance, and consideration (something of value exchanged). Once a contract is formed, both parties must perform their promises; if one does not, that party is in breach and may have to pay damages.
Application: Liam made a clear offer to pay £50 for the car wash, and Ethan accepted by agreeing to do the work. Consideration exists on both sides: the promise of payment from Liam and the promise of service from Ethan. Ethan even bought supplies, showing he relied on the agreement. Liam's refusal to let Ethan do the work is a breach because he failed to perform his side of the bargain. Ethan has suffered a loss – the money he spent and the lost opportunity for another job.
Conclusion: A contract was formed and Liam breached it. Ethan is entitled to claim damages to cover the cost of the cleaning products and possibly the lost profit from the other job. Even an oral agreement can be a valid contract.
7. Common Mistakes in Analysis |
One frequent mistake is confusing facts with opinions. For example, saying 'Alex was jealous of Sam's new bike' is an opinion unless there is direct evidence. Always base your analysis only on the facts that are given.
Another mistake is skipping the rule statement. Students often jump straight from the issue to a conclusion. If you do not explain the legal rule, your answer lacks foundation. Always write a short rule sentence, even if it feels repetitive.
Also, avoid vague language such as 'the defendant did something wrong'. Be specific: identify which legal duty was breached or which element of the law was satisfied. Precision makes your argument much stronger.
Finally, remember that not every bad event leads to legal liability. The law only provides a remedy when certain specific conditions are met. Your task is to check whether those conditions are present in the case.

Now it's your turn. Try analysing the following mini-cases using IRAC. Write down the Issue, Rule, Application and Conclusion for each one. Suggested rules are provided to help you.
Exercise A: Tom borrowed his friend's tablet but later sold it online without asking. The friend had only agreed to lend it for one day. Is Tom guilty of theft? (Rule: Theft requires dishonest appropriation of property belonging to another with the intention to permanently deprive.)
Exercise B: A restaurant served a customer a dish containing nuts, even though the customer had clearly told the waiter about a severe nut allergy. The customer became seriously ill. Is the restaurant liable for negligence? (Rule: A professional owes a duty of care to customers to provide food that is safe and as described.)
Exercise C: Sara offered to sell her guitar to Ben for £100. Ben accepted and paid the money. Later Sara refused to hand over the guitar, saying she had changed her mind. Has a contract been formed and is it breached? (Rule: A contract needs offer, acceptance and consideration.)
9. Answers and Explanations |
Below are model answers for the practice exercises. Compare them with your own responses to see where you can improve. The wording may differ, but the legal reasoning should be similar.
Exercise A – Issue: Is Tom guilty of theft? Rule: Theft is the dishonest taking of another's property with the intention to permanently deprive. Application: Tom took the tablet under the pretence of borrowing, but selling it shows he had no intention of returning it. He acted dishonestly by selling something he did not own. The owner only agreed to a one-day loan, so the keeping and selling exceed that permission. Conclusion: Tom is likely guilty of theft.
Exercise B – Issue: Is the restaurant negligent? Rule: A restaurant must take reasonable care to serve safe food as requested. Application: The customer gave a clear warning about a nut allergy. The staff failed to ensure the dish was nut-free, which breached their duty. This directly caused a serious allergic reaction. Conclusion: The restaurant is liable in negligence for the customer's illness.
Exercise C – Issue: Was a contract formed and breached? Rule: A binding contract requires offer, acceptance and consideration. Application: Sara's offer of £100 and Ben's acceptance created the agreement. The £100 payment is consideration. A valid contract exists. Sara's refusal to deliver the guitar is a breach. Conclusion: Ben can claim the guitar or get his money back plus possible damages.
