1. What is Law? |
A law is a rule made by the government that everyone in a country must follow. If you break a law, there are serious consequences, such as fines, community service or even imprisonment.
Law is different from personal or family rules. It is created through a formal process and is enforced by official bodies like the police and courts. Without law, there would be chaos and conflict.
In England and Wales, the legal system is based on common law, meaning that some laws come from judges' decisions in earlier cases, as well as from written Acts of Parliament.
2. Rules vs. Laws |
It is easy to confuse rules and laws, but they have important differences. The table below highlights the main distinctions.
| Aspect | Rules | Laws |
|---|---|---|
| Who makes them? | Schools, parents, clubs, organisations | Parliament (MPs and Lords) or judges |
| Who must follow them? | Only members of that group | Everyone in the country |
| Consequences | Detention, loss of privileges, warning | Fines, imprisonment, criminal record |
| Examples | No running in corridors, wear uniform | Theft, speeding, assault |
Rules apply in specific places, like a school or a sports club. Laws apply everywhere and are much more serious when broken. Both help maintain order, but laws have the backing of the state.
3. Why Do We Need Laws? |
Laws serve several essential purposes in society. First, they protect people from harm. For example, criminal laws against assault and theft keep individuals safe and their property secure.
Second, laws provide a way to resolve disputes. If two neighbours argue about a fence or a contract is broken, civil law offers a fair process to settle the disagreement without violence.
Third, laws promote fairness and equality. Anti-discrimination laws ensure that people are treated equally regardless of their race, gender or disability. Laws also protect our basic rights, such as freedom of speech.
Finally, laws allow society to run smoothly. Road traffic laws, environmental regulations and tax laws create order and fund public services like schools and hospitals.
4. How Are Laws Made?
In the UK, most new laws are Acts of Parliament. The process begins with a proposal called a Bill. A Bill can be introduced by the government or sometimes by individual MPs.
The Bill must be debated and approved by both the House of Commons and the House of Lords. The Commons is made up of elected MPs, while the Lords consists of appointed and hereditary peers.
Both Houses can suggest changes. Once they agree on the final wording, the Bill goes to the monarch for Royal Assent. Today, Royal Assent is a formality and the monarch always signs it.
After Royal Assent, the Bill becomes an Act of Parliament and is now a law. It is then officially published and comes into force, sometimes immediately or on a later date.
5. Who Makes the Law? |
Parliament is the supreme law-making body in the UK. This is known as parliamentary sovereignty. It means that Parliament can create, change or repeal any law.
However, judges also play a role. When the meaning of a law is unclear, judges interpret it. Their decisions, called precedents, can develop the law over time. This is the common law system.
In Wales, the Senedd (Welsh Parliament) has the power to make laws in certain areas, such as health, education and the environment. These laws apply only in Wales.
Local councils can also make local laws called byelaws, for example banning drinking alcohol in certain public places or regulating dog walking on beaches.
6. Types of Law: Criminal and Civil |
UK law is divided into two main branches: criminal law and civil law. Understanding the difference is fundamental.
Criminal law deals with behaviour that the state considers harmful to society. Examples include murder, theft, burglary and drug offences. The state, usually through the Crown Prosecution Service, brings the case against the defendant. If found guilty, the punishment could be a fine, community sentence or prison.
Civil law handles disputes between individuals or organisations. Common cases involve contracts, negligence, property ownership and family matters. The person who brings the case is the claimant, and they usually seek a remedy, such as compensation (damages) or an injunction, rather than punishment.
The standard of proof also differs: in criminal law the prosecution must prove guilt beyond reasonable doubt; in civil law the claimant must prove the case on the balance of probabilities.
7. The Court System |
The court system in England and Wales is structured to handle different types of cases. For criminal cases, the lowest court is the Magistrates' Court, where less serious offences (summary offences) are heard, usually by three magistrates or a district judge.
More serious crimes, such as robbery or murder, are tried in the Crown Court before a judge and a jury. The jury, made up of 12 members of the public, decides whether the defendant is guilty, while the judge decides the sentence.
Civil cases are often started in the County Court or the High Court, depending on the value and complexity of the claim. There are also specialist tribunals for issues like immigration, employment and benefits.
If a party is unhappy with a decision, they can appeal to a higher court. The Court of Appeal hears appeals from lower courts, and the Supreme Court is the highest court in the UK, whose decisions bind all other courts.
8. Rights and Responsibilities |
All people in the UK have basic rights protected by laws such as the Human Rights Act 1998. These include the right to life, freedom from torture, the right to a fair trial, freedom of expression, and respect for private and family life.
With rights come responsibilities. For example, the right to freedom of expression does not allow you to spread hate speech or defame others. Your right to enjoy your property comes with the duty not to cause a nuisance to neighbours.
Citizens also have duties such as obeying the law, paying taxes, serving on a jury when called, and, for those eligible, voting in elections. A well-functioning society depends on both rights and responsibilities being respected.
9. Law and Justice |
The rule of law is a key principle meaning that no one is above the law. Everyone, including government officials, must obey the law. Laws must be clear, publicised and applied equally.
An important part of justice is the presumption of innocence. A person accused of a crime is considered innocent until proven guilty. The burden of proof lies with the prosecution.
Access to justice means that people should be able to get legal help and have their case heard fairly. Legal aid is sometimes available for those who cannot afford a lawyer. Justice delayed can be justice denied, so courts aim to deal with cases without unnecessary delay.
10. Key Legal Terms |

11. Case Study: A Simple Legal Scenario |
Let's apply what we have learned. Imagine Alex is caught shoplifting a video game from a store. The store security detains Alex and calls the police.
The police arrest Alex and take him to the station. Because theft is a criminal offence, the Crown Prosecution Service decides there is enough evidence to charge Alex. Alex becomes the defendant.
Alex's case is first heard in the Magistrates' Court because it is a relatively minor theft. Alex pleads not guilty. The magistrates decide the case can stay in their court unless Alex chooses a trial by jury in the Crown Court.
During the trial, the prosecution must prove beyond reasonable doubt that Alex intended to permanently deprive the store of the game. The defence argues Alex forgot to pay. The magistrates listen to witnesses and examine CCTV footage.
If found guilty, Alex might receive a fine, a referral order, or a discharge, depending on his age and circumstances. The aim is both punishment and rehabilitation.
12. Revision Tips |
To succeed in your Year 7 Law assessments, regular revision is key. Start by making flashcards for key terms and definitions covered in this guide. Test yourself or ask a friend to quiz you.
Draw diagrams showing the law-making process and the court hierarchy. Visual aids help you remember the steps and the different courts. Explain these aloud to someone else – teaching is an excellent way to learn.
Practice applying the law to simple scenarios, like the shoplifting case. Identify whether it is criminal or civil, who the parties are, and what might happen. The more you apply, the better you will understand.
Finally, review past worksheets and any notes from class. Write summary paragraphs linking ideas, such as how rights connect to responsibilities. Little and often is more effective than cramming.
