📚 Case Study Practice: Applying Legal Rules |
Welcome to your case study practice session. In this guide, you will learn how lawyers and judges analyse real-life problems by breaking them down into key parts. By the end, you will feel confident tackling any legal scenario you meet in your OCR Year 7 Law course.
1. Understanding a Legal Case |
A legal case is a story that involves a conflict between two or more people. Your job is to read the story, find out what went wrong, and decide who should win according to the law.
Think of a case as a puzzle. Every piece of information, every character and every action can help you form a fair answer. The law provides the rules for solving the puzzle.
2. Identifying the Facts |
Facts are the simple, true pieces of information in the case. For example, who did what? When? Where? Facts do not include opinions or guesses. You must only use facts that are clearly given in the story.
Always separate facts from feelings. A statement like 'Emma was careless' is an opinion. The fact might be 'Emma left the textbook on a bus seat.'
3. Finding the Legal Issue |
The legal issue is the main question the court needs to answer. It often begins with words like 'Is...' or 'Did...'. For example: 'Is A liable to pay B for the lost item?' or 'Did B break the rule?'
Knowing the correct issue keeps your analysis focused. If you identify the wrong issue, your final answer will not match the real problem.
4. Recognizing the Parties |
In a civil case, the person who brings the claim is called the claimant. The person against whom the claim is made is the defendant. In a criminal case, the state brings the case against the accused.
Make sure you know who wants what. The claimant often seeks a remedy, such as money to cover a loss. The defendant will try to show they are not responsible, or that a different rule applies.
5. The Rule of Law |
A legal rule is a standard that must be followed. It can come from an Act of Parliament (a statute) or from earlier court decisions (precedent). The rule tells us what people are allowed to do and what they must do.
In our Year 7 cases, rules are often simple duties. For example: 'A person who borrows something must take reasonable care of it.' Once you find the correct rule, you can move to the next step.
6. Applying the Rule to Facts |
This is the heart of case analysis. You take the legal rule you have found and match it against the facts. Ask yourself: 'Do the facts fit the rule?' If they do, the rule tells you the outcome.
Rule + Facts -> Conclusion
For example, if the rule says 'A borrower must return the item', and the facts show the borrower failed to return it, then the borrower has broken the rule. Always explain why the facts do or do not meet the rule.
7. Reaching a Conclusion |
Your conclusion is the final answer to the legal issue. It should be short, clear and based entirely on your application. Avoid introducing new ideas at this stage.
A strong conclusion directly answers the question you set out to solve. For instance: 'The defendant must pay the claimant 15 pounds because she failed to take reasonable care of the borrowed textbook.'
8. Case Study Example: The Lost Textbook |
Read the following case carefully. Emma borrowed a science textbook from her friend Jack. She promised to return it on Monday. On Sunday, Emma took the book to the park. When she left, she forgot it on a bench. The book was never found. Jack is asking Emma to pay 15 pounds to buy a new copy.
Think about the people involved and what each one wants. This is a civil dispute between two friends. No crime has been committed, but one person has suffered a loss.
9. Step-by-Step Analysis |
Facts: Emma borrowed Jack's book. She agreed to return it by Monday. She left the book on a park bench and lost it. Jack needs 15 pounds for a replacement.
Parties: Jack is the claimant; he wants compensation. Emma is the defendant; she may argue it was an accident.
Legal issue: Is Emma legally obligated to pay Jack 15 pounds for losing the borrowed book?
Relevant rule: A person who borrows property must take reasonable care of it. If they fail to do so and the property is lost or damaged, they must pay for the loss.
Application: Emma took the book to the park, which is not unreasonable on its own. However, leaving it unattended on a bench is a failure to take reasonable care. A careful person would keep the book with them. Her carelessness directly caused the loss.
Conclusion: Emma must pay Jack 15 pounds. The facts clearly show she did not take reasonable care, and her failure caused Jack's loss.
10. Writing Your Own Case Brief |
A case brief is a short, organised summary of a case. It helps you remember the important parts and present your analysis clearly. Use the following structure.
Case name: Give the case a simple title, such as 'Jack v Emma' (claimant's name first, then a 'v' for 'versus', then the defendant).
Facts: Write 3-4 sentences covering who, what, when, where and how the problem arose.
Issue: State the legal question as one clear sentence.
Reasoning: Explain the rule and how you applied it to the facts. This is the longest part of your brief.
Conclusion: Write a one-sentence result that answers the issue.
11. Common Mistakes to Avoid |
One common mistake is adding facts that are not in the story. You might think 'Emma was in a hurry' — but if the case does not say that, you cannot use it. Stick strictly to the given facts.
Another mistake is choosing the wrong rule. Always ask: does this rule really connect to the problem? A rule about lying is not useful for a case about lost property unless someone lied about it.
Avoid giving a conclusion without explaining why. The strongest answers always link the facts to the rule step by step. Never write 'Emma loses' without showing the reasoning.
12. Practice Makes Perfect |
Now it is your turn. Read this short case. Tom finds a wallet on the playground at school. Inside there is 20 pounds and a student ID card. Tom keeps the wallet and spends the money. The owner reports it to a teacher, who finds Tom. The owner wants the wallet and the 20 pounds back.
Your task: Identify the facts, the parties and the issue. Think about the rule: 'A person who finds lost property must try to return it to the true owner and must not treat it as their own.' Apply that rule to the facts and write a short conclusion. Try structuring your answer like a case brief.
Practising with small cases builds a strong legal mind. The more you do, the easier it becomes to spot the right rule and apply it fairly.
