📚 How UK Multi-Agency Working Protects Children Affected by Domestic Abuse |
Domestic abuse is one of the most frequently recorded safeguarding concerns in the United Kingdom, and children are caught inside it far more often than public debate suggests. A child who hears shouting, sees a parent injured, hides a phone, or simply lives in a house where one adult controls another is now recognised in law as a victim in their own right. No single agency can meet that child's needs alone. Police officers, children's social care, schools, health professionals, housing teams, probation services and voluntary-sector specialists must combine their separate pieces of information into one coherent protective response. This article explains how that multi-agency system works, where it succeeds, and where it still fails children.
1. Defining Domestic Abuse in UK Law |
In England and Wales the Domestic Abuse Act 2021 provided the first statutory definition. Behaviour by person A towards person B is domestic abuse if both are aged 16 or over, they are 'personally connected', and the behaviour is abusive. Abusive behaviour includes physical or sexual abuse, violent or threatening behaviour, controlling or coercive behaviour, economic abuse, and psychological, emotional or other abuse. It does not matter whether the behaviour is a single incident or a course of conduct.
The term 'personally connected' is deliberately broad. It covers people who are or were married or in a civil partnership, who are or were engaged, who are or were in an intimate personal relationship, who are the parents of the same child, or who are relatives. The 2021 Act also placed economic abuse on a statutory footing, defining it as behaviour having a substantial adverse effect on a person's ability to acquire, use or maintain money, property, goods or services.
Where the behaviour amounts to a course of conduct, the criminal law may be engaged. Section 76 of the Serious Crime Act 2015 created the offence of controlling or coercive behaviour in an intimate or family relationship, and the 2021 Act extended it to post-separation abuse where the parties no longer live together. In Scotland, the Domestic Abuse (Scotland) Act 2018 created a single offence of abusive behaviour towards a partner or ex-partner, and in Northern Ireland the Domestic Abuse and Civil Proceedings Act (Northern Ireland) 2021 created a comparable offence.
