Post-16 special educational needs funding is not a single pot of money and it is not awarded on sympathy. It is a negotiated settlement between a local authority, an education provider, a health commissioner and sometimes an adult social care team. The families who succeed are almost never the ones with the most emotional case; they are the ones who arrive with a file. This guide sets out the due diligence you should complete before you submit an application, a placement request or an appeal.

Most failed applications fail at this first step. The family writes a letter asking for 'more support' or 'a specialist placement', and the local authority responds by testing whether the existing plan is adequate. Instead, write down the outcome you want in three columns: the need, the provision, and the cost. If you cannot fill all three columns, you are not ready to apply.

2. Know the Legal Framework You Are Relying On | 明确你所依据的法律框架
In England the post-16 position rests on Part 3 of the Children and Families Act 2014 and the SEND Code of Practice: 0 to 25 years (2015). Once a young person is over compulsory school age, the rights transfer from the parent to the young person. That single fact changes the entire due diligence process, because the young person, not the parent, must make the placement request and holds the right of appeal.

Key provisions to check and note include the duty to maintain and review the EHC plan annually, the duty to consult the young person, the duty to name the requested institution unless a specific exception applies, and the duty to commission provision jointly across education, health and care.

3. Due Diligence on the EHC Plan Itself | 对EHC计划本身的尽职调查
Before you argue about money, verify the status of the plan. A draft plan and a final plan have completely different legal weight. Check the date of issue, the date of the last annual review, whether any amendment has been issued, and whether the plan is still being maintained at all. A plan that was finalised eighteen months ago without review is itself a compliance failure worth documenting.

4. Audit the Annual Review Trail | 审计年度审查记录
The annual review is the engine of the whole system. If the review has been done properly, you will have a written report, the young person's views, the parents' views, reports from the setting, and any professional advice obtained in the previous twelve months. If it has not been done properly, that gap is your strongest procedural argument.

Build a chronology. List every review meeting, every request you made, every response you received, and every deadline that was missed. Timelines are persuasive because they are factual. A single sheet of A4 showing that four requests went unanswered over eleven months does more work than three pages of argument.

- Key date: for a Year 11 to Year 12 transfer, the review should happen in the autumn term and the final amended plan must be issued by 31 March, so the receiving institution can be named and funded before September.
- Key date: the plan must be reviewed at least every twelve months, and sooner if the young person's needs change materially.

The EHC plan has health and social care sections, and they are the most commonly neglected part of the document. A post-16 application that ignores them leaves money on the table and, worse, leaves the young person without support that a different statutory route would have funded.

Check whether a social care assessment has been carried out under the relevant children's legislation, and whether a transition assessment has been requested ahead of the eighteenth birthday. Check whether the young person is, or should be, known to the health commissioner for continuing care purposes. These are separate statutory doors, and knocking on only one of them is a due diligence failure.

Do not rely on the prospectus. Verify the provider on four axes: regulatory status, inspection history, capacity to meet the specific needs in the plan, and financial structure.

- Regulatory status: is the institution on the Secretary of State's approved list of independent special schools and special post-16 institutions? Approval under section 41 of the Children and Families Act 2014 makes it far simpler for a local authority to name the provider. If it is not approved, expect the authority to push back and plan for a longer, evidence-heavy process.
- Inspection history: read the most recent full inspection report of the provider, and any report covering residential provision if the placement is residential. Look for the words used about outcomes and independence, not just the overall grade.
- Capacity: ask the provider in writing whether they can meet each strand of provision in the plan, and ask for the model of delivery, not a general statement of willingness.
- Financial structure: ask whether the provider holds a high needs place allocation from the funding body, or whether a place would have to be commissioned mid-year. This single question determines whether the money can arrive in September or in the following January.

7. Map Every Funding Stream and Who Pays | 梳理每一项经费来源与付款方
Post-16 high needs funding is layered. The base is core programme funding for a 16-19 student, commonly around £6,000, which the institution receives through the national funding formula. On top of that sits high needs place funding of £6,000 for an agreed high needs place, and above that a top-up negotiated between the institution and the local authority from the authority's high needs budget. Where a young person also has health or care needs, further streams may apply.
