📚 How Children With Learning Disabilities or Autism Can Avoid Being Forcibly Restrained at School |
Every week in England, thousands of disabled children are physically held, dragged, pinned or shut in rooms at school. Most of these incidents involve pupils with learning disabilities, autism or speech, language and communication needs, and most of them happen without the child's parents being told on the day. Restraint is not a rare emergency measure for this group; for many families it is a routine part of the school week. This article sets out the legal baseline, the practical safeguards and the exact language that pupils, parents, carers, teaching assistants and tutors can use to reduce the risk of a forced hold - and to respond effectively when one happens anyway.
1. Start With the Legal Baseline |
In England, the power to use force in schools comes from Section 93 of the Education and Inspections Act 2006 and is explained in the DfE guidance 'Use of Reasonable Force' (2013). Staff may use reasonable force only to prevent a pupil from committing a criminal offence, injuring themselves or others, damaging property, or to maintain good order and discipline. Three words carry all the weight: reasonable, proportionate, last resort. Force must never be used as a punishment, and it must stop the moment the risk has passed.
- Equality Act 2010 - schools must make reasonable adjustments and must not discriminate because of disability, including discrimination arising from disability.
- Children and Families Act 2014, Section 42 - where a pupil has an EHCP, the provision in it is a legal duty, not a suggestion.
- Human Rights Act 1998 - Article 3 (no inhuman or degrading treatment) and Article 8 (private life) both apply to restraint.
- UN Convention on the Rights of Persons with Disabilities - Article 16 protects disabled children from exploitation, violence and abuse.
A useful first sentence to remember is this: restraint is a safety intervention, not a behaviour-management tool. If it is being used to make a child comply, it is already outside the law.
2. What Actually Counts as Restraint |
Many schools describe only the most dramatic incidents as restraint, and therefore report very few. The definition used in national guidance is much wider, and it includes anything that restricts a child's freedom of movement or liberty. Recognising the full range is the first step to challenging it.
| Restrictive physical intervention | 限制性身体干预 | Holding arms, pinning to the floor, dragging, blocking a doorway | 抓手臂、按倒在地、拖拽、堵门 | |
| Seclusion | 隔离 | A child alone in a room they cannot leave | 孩子独自被关在无法离开的房间 | |
| Mechanical restraint | 器械约束 | Straps, lap belts, weighted furniture used to restrict | 束带、绑带、用于限制的加重座椅 | |
| Chemical restraint | 药物约束 | Sedation or PRN medication used to control behaviour | 用镇静剂或按需用药控制行为 | |
| Psychological restraint | 心理约束 | Threats, 'if you do not sit down we will hold you' | 威胁、"你再不坐下我们就按住你" |
If a child is taken to a room and the door is held shut while they are alone, that can also amount to a deprivation of liberty, which is a far more serious legal matter than a brief hold.
3. Why Restraint Happens, and Why It Harms |
Restraint is rarely caused by a child's behaviour alone. It is usually the product of an environment that has already failed: too much noise, unclear instructions, unmet communication needs, unpredictable staffing, and staff who have been trained to intervene physically but not trained to prevent escalation. Fear plays a large part too - an adult who is frightened reaches for control rather than connection.
The harm is cumulative. Physical holds cause bruising, joint injury and sometimes fractures, but the invisible damage matters more: trauma responses, school refusal, loss of trust in adults, learned helplessness, and a child who learns that their body is not theirs. Research on restraint consistently finds that it increases aggressive behaviour over time rather than reducing it.
- Behaviour is communication - it usually signals pain, fear, confusion or overload.
- Punishment-based responses teach compliance, not self-regulation.
- Every restraint damages the relationship that makes future de-escalation possible.
4. Communication Passports and Pre-Agreed Signals |
The single most effective protection is a written, child-led communication passport that travels with the pupil and is read by every adult who works with them, including supply teachers, lunchtime supervisors and taxi or bus escorts. It should be one page, positive in tone, and written with the child where possible.
- What helps me: quiet space, warning before changes, being called by my name, a visual timetable.
- What makes things worse: loud voices, being touched without warning, sudden transitions, crowded corridors.
- How I show I am struggling: I repeat a phrase, I cover my ears, I stop speaking.
- What to do: offer me the break card, give me two choices, do not ask questions for two minutes.
Agree a physical or visual signal - a card, a hand tap, a coloured token - that means 'I need to leave now' without the child having to speak. A child who can leave a room early is far less likely to be held in it later.
5. Sensory Regulation and De-escalation |
Autistic pupils and pupils with learning disabilities often reach crisis because of sensory and cognitive overload rather than defiance. Proactive sensory regulation - a scheduled movement break, ear defenders, a chewy, a weighted lap pad, access to a low-stimulus space - reduces the frequency of crisis. The space must be genuinely available, unlocked and voluntary; a room used to shut children in is not a sensory room.
The low-arousal approach works because it removes the audience, the demand and the confrontation. Useful micro-skills include: hands visible and low, body turned slightly sideways, one adult speaking only, sentences under six words, silence allowed, and no question that begins with 'why'.
Overload → Anxiety → Defensive behaviour → Crisis → Tension reduction → Recovery → Repair
6. Behaviour Support Plans That Actually Protect |
A behaviour support plan is only useful if it is built on a functional assessment of what the behaviour achieves for the child, not on a list of sanctions. Record antecedents, behaviour and consequences over at least two weeks, then identify the function: escape, attention, sensory feedback or access to an object or activity.
Antecedent (A) → Behaviour (B) → Consequence (C) → Function
From that assessment, the plan should specify a replacement behaviour that meets the same need, a graded set of staff responses, the names of the adults responsible, and the exact point at which staff must withdraw. If physical intervention is ever considered, it belongs in a separate positive handling plan signed by parents, with a review date.
- Ask for the plan in writing, and ask who has been trained to deliver it.
- Ask what the data shows: how many incidents last term, what triggered them, what was tried first.
- Ask for a named, consistent adult who knows the child well.
7. Reasonable Adjustments Under the Equality Act |
The Equality Act 2010 requires schools to make reasonable adjustments for disabled pupils, and it protects against indirect discrimination and discrimination arising from disability. A rule applied rigidly to a disabled child - 'no leaving the classroom', 'everyone must attend assembly' - can be unlawful if it puts that child at a substantial disadvantage and no adjustment is made.
In practice, adjustments that reduce restraint include: a flexible start and finish time, a reduced timetable during recovery, permission to leave lessons without asking, exams access arrangements, a quiet alternative to the dining hall, and staff trained in autism and communication rather than in holds alone.
Where a pupil has an EHCP, provision is legally required. If it is not being delivered, the route is the annual review first, then the SEND Tribunal. Do not wait for a crisis to request a review.
8. Scripts for the Moment of Crisis |
Language is a de-escalation tool. The sentences below are short, non-threatening and give the child control without giving up safety. Practise them before you need them, because nobody invents good wording while a child is on the floor.
- 'I can see this is really hard. I am not going to touch you.'
- 'You can stay here, or go to the quiet room. Which one?'
- 'I am going to step back now. I will be by the door.'
- 'Take your time. Nobody is going to rush you.'
- 'I need to keep everyone safe. Tell me what would help.'
Sentences to avoid: 'Calm down', 'Why did you do that?', 'If you do not stop, we will have to hold you', and anything beginning with 'You always'. Each of these raises arousal and makes a physical intervention more likely.
9. Recording, Escalation and Complaint Routes |
You cannot challenge what has not been recorded. After any incident, request the post-incident report, the body map, the staff names and the review date. Parents and carers over 16, or pupils with capacity, can make a subject access request under UK GDPR for the full record, including internal emails. Schools must respond within one month.
The escalation ladder is usually: class teacher, SENCO, headteacher, governing body complaint, local authority, then the Local Government and Social Care Ombudsman. Where disability discrimination is involved, the Equality and Human Rights Commission can advise. Ofsted and the Care Quality Commission consider safeguarding information during inspection, so reporting to them is not wasted effort.
- Keep a dated diary of every incident, with your own photographs of any marks.
- Send follow-up emails rather than making phone calls - the written trail matters.
- Take a supporter or advocate to every meeting and ask for minutes.
10. Partnering With Parents and Carers |
Parents are the experts on their own child. A school that treats them as partners gets better information, earlier warning signs and a calmer child. A home-school communication book, a weekly ten-minute call and a shared 'what worked today' note cost almost nothing and prevent a great many holds.
