📚 Legal Prerequisites and Identity Conditions for Overseas Children Applying to Schools in England |
Every year thousands of families relocate to England and discover that the school application process is governed not by one rule but by three overlapping systems: education law, admissions law and immigration law. Each system answers a different question. Education law asks who must provide a school place. Admissions law asks how a place is allocated and how it can be challenged. Immigration law asks what a child's status permits them to do while they are here. Overseas families frequently fail not because they have no entitlement, but because they apply the logic of one system to the problem created by another.
This article sets out the legal prerequisites and identity conditions that determine whether an overseas child can be admitted to a school in England. It covers maintained schools, academies and independent schools, and it distinguishes carefully between what the law requires, what guidance recommends and what individual local authorities or schools may ask for in practice. It deals with England only: Scotland, Wales and Northern Ireland have separate admissions frameworks and separate codes.
1. The Legal Foundations: Who Must Provide a School Place |
The starting point is section 14 of the Education Act 1996, which imposes a duty on every local authority in England to secure sufficient primary and secondary schools, in number, character and equipment, to provide for all pupils who are of compulsory school age in its area. The duty is framed in territorial terms: it is owed to children in the area. It is not drafted by reference to nationality, immigration status, residence length or the tax contributions of the parents.
Alongside section 14 sit several instruments that shape how the duty is discharged. The statutory School Admissions Code (currently the 2021 Code) governs how admission arrangements must be designed, consulted on, published and applied. The School Admission Appeals Code (2022) governs challenges. Part 6 of the Equality Act 2010 applies to schools as service providers and as admission authorities, and the Human Rights Act 1998 gives domestic effect to Article 2 of Protocol 1 of the European Convention on Human Rights, the right to education.
- Education Act 1996, s.14 — duty to secure sufficient school places for children in the area.
- Education Act 1996, s.7 and s.444 — parental duty to secure education, and the offence of failing to secure regular attendance.
- School Admissions Code 2021 — statutory code binding on all admission authorities.
- Equality Act 2010, Part 6 — prohibits discrimination in admissions and in the provision of education.
2. Compulsory School Age and the Parent's Statutory Duty |
Compulsory school age in England is defined by sections 8 and 576 of the Education Act 1996. A child becomes of compulsory school age on the prescribed day following their fifth birthday, the prescribed days being 31 August, 31 December and 31 March. Compulsory school age ends on the prescribed day following the child's sixteenth birthday. Below and above those thresholds, education is optional rather than compulsory, although the entitlement to a state-funded place is broader than the duty.
Compulsory school age: 5 → 16 (prescribed days: 31 Aug / 31 Dec / 31 Mar)
The practical consequence matters for overseas families. Where a parent is lawfully present in England with a child of compulsory school age, the parental duty under section 7 applies irrespective of the family's immigration status. Failure to secure regular attendance can lead to a penalty notice or prosecution under section 444. A family cannot avoid the duty by arguing that the child is a foreign national or that a visa application is pending.
Conversely, a child under compulsory school age cannot be compelled to attend, but may still be entitled to a funded early years place or to admission in the normal reception admissions round. Independent schools frequently admit children below compulsory school age under their own age criteria, and a Child Student visa can be granted from age four.
3. The No-Fees Rule at Maintained Schools |
The charging provisions of the Education Act 1996, in particular section 451, prohibit the charging of fees for admission to, or education at, a maintained school during school hours. This prohibition is not qualified by nationality or by immigration status. A state-maintained school in England cannot lawfully charge an overseas child tuition fees for the ordinary school curriculum delivered during the school day.
This is the single most misunderstood rule in the field. Parents sometimes assume that because they hold a visa with a "no recourse to public funds" (NRPF) condition, they must pay for a state school place. They do not. Education provided at a maintained school is not classified as a "public fund" for the purposes of the Immigration Rules. The list of public funds in the Immigration Rules covers welfare benefits, housing assistance and tax credits; it does not include school education.
- No fees for the school day — maintained schools and academies cannot charge for admission or for education during school hours.
- Optional extras may be charged — boarding, optional trips, music tuition and remote boarding provision may be charged, but must be genuinely optional.
- Independent schools set their own fees — the no-fees rule does not apply to the independent sector.
4. Immigration Status and the Right to a State School Place |
The central legal proposition is simple: a child's immigration status does not determine whether they are entitled to a school place in England. The local authority's section 14 duty and the admission authority's duties under the Admissions Code apply to children in the area, and the Department for Education has consistently advised that schools and admission authorities should not require evidence of immigration status as a condition of admission.
This means that a child who is in England unlawfully, or whose visa application is pending, or who is a dependant on a temporary route, must still be offered a school place if there is one available and the admission arrangements are met. Refusing a place purely because of status would be unlawful and would also engage the Equality Act 2010, since race as a protected characteristic includes nationality and ethnic or national origin.
