📚 How to Complain About Post-16 Education in the UK: DfE Scope and Process | 16
If you are 16 or over and studying at a sixth form college, a general further education college, a university technical college, an independent training provider or on an apprenticeship, you have the right to complain when something goes seriously wrong. Many students assume that the Department for Education (DfE) will investigate their case directly. In most situations it will not, because the DfE is a funder and a policy department, not a court of appeal for individual disputes.
1. The Post-16 Regulatory Landscape | 16
Post-16 education in England is not run by a single body. Funding comes mainly from the DfE, qualifications are regulated by Ofqual, quality is inspected by Ofsted, and special educational needs disputes are handled by local authorities and the SEND Tribunal. Knowing who owns your problem is the first step to solving it.
Different providers have different complaint routes, and using the wrong one can cost you months. The table below summarises the main settings.
| Exam results | 考试成绩 | Centre then awarding organisation | 考试中心→颁证机构 | Ofqual (process only) | Ofqual(仅程序问题) |
2. What the DfE Can and Cannot Do | 教育部能受理什么、不能受理什么
The DfE, through its further education complaints function (the work formerly carried out by the Education and Skills Funding Agency), can look at complaints about colleges and training providers that receive public funding. It can check whether a provider followed its own policies, whether funding rules were broken, and whether students were treated fairly under the contract the provider signed with the government.
Crucially, the DfE cannot change your grade, overturn an academic judgement, award you compensation, or force a college to reinstate you. It also cannot investigate a complaint that has not first been through the provider's own procedure.
- Can investigate | 可以调查: funding misuse, failure to follow published policies, poor handling of a complaint, course withdrawal without proper notice.
- Cannot investigate | 不能调查: marks and grades, individual admissions decisions at colleges, employment disputes, safeguarding allegations (these go to the local authority designated officer).
3. Step One: Exhaust the Provider's Own Procedure |
Every publicly funded college and training provider must publish a complaints policy. You normally have to complete it, including any appeal stage, before the DfE will look at your case. Ask for the policy in writing and note the deadlines it sets.
Most procedures have two stages: an informal or stage one complaint handled by a member of staff, and a formal stage two heard by a senior manager, principal or the governing body. A complaint is only "exhausted" when you hold a final written response, usually called a completion of procedures letter.
- Submit in writing and keep a dated copy. |
- State the outcome you want: an apology, a refund, a re-mark, a transfer, a policy change. |
- Ask for the final response letter if the provider tries to close the case informally. |
4. Step Two: Complaining to the DfE |
Once the provider has given its final response, you can escalate to the DfE's further education complaints team using the online form on the gov.uk website. Complaints are normally expected within 12 months of the event, so do not delay.
A strong submission is short, factual and evidence-based. Upload your final response letter, your earlier complaint, and any emails, timetables, attendance records or financial documents that support your account.
- Explain what happened, when, and who was involved. |
- Explain which published policy or funding rule you believe was broken. |
- Explain what you have already tried and what outcome you are seeking. |
The DfE will acknowledge your complaint and then decide whether it falls within scope. If it does, it may ask the provider for information, require the provider to reconsider the case, attach conditions to funding, or in serious cases refer the matter for intervention. It will not re-mark your work or award damages.
5. Qualifications, Exams and Grades |
Complaints about A level, BTEC, T Level and GCSE results follow a completely different pathway and never start with the DfE. Your first step is the exams officer at your centre, who can request a clerical check, a review of marking, or access to scripts.
If you are still unhappy, you can appeal to the awarding organisation. These appeals normally have two stages, and strict deadlines apply - marking reviews for university applicants are prioritised immediately after results day.
Ofqual regulates awarding organisations but does not handle individual results. It can, however, investigate whether an awarding organisation or a centre followed the required rules and procedures, which may lead to wider sanctions.
6. Apprenticeship Complaints |
Apprentices have two identities: a learner and an employee. That means two parallel complaint routes. Training quality issues go to the training provider and then to the DfE/ESFA; pay, hours, holiday and treatment at work go through the employer's grievance procedure.
If your employer or provider breaches your rights, you may be able to take a claim to an employment tribunal. Acas provides free early conciliation, and HMRC enforces the national minimum wage, including the apprentice rate.
End-point assessment disputes go to the end-point assessment organisation first, and only then to the DfE if a funding or regulatory rule has been broken.
7. Ofsted: Evidence, Not Adjudication | Ofsted:
Ofsted inspects providers but does not resolve individual complaints. If you report a concern, it is logged and may be shared with the inspection team, and it can shape the judgements in a future inspection report.
That makes Ofsted a powerful tool for systemic problems - unsafe workshops, unchecked staff, widespread bullying - rather than for your own individual grade or disciplinary case.
If you believe an inspection itself was conducted improperly, Ofsted has its own complaints procedure, which can ultimately be escalated to the Independent Complaints Adjudication Service for Ofsted.
Young people with an Education, Health and Care (EHC) plan keep their rights up to age 25, and from 16 they can appeal in their own name. Disputes about the content of a plan, or a refusal to assess or amend it, go to the First-tier Tribunal (SEND).
You normally have two months from the local authority's decision letter to appeal, or one month from the date on the mediation certificate - whichever is later. Mediation must usually be considered before appealing.
