Schools in England carry firmer duties on restraint and seclusion since 1 April 2026, when every significant incident of force, and every incident of seclusion or non-force restraint, became subject to a written record and prompt reporting to parents. Department for Education figures show autistic spectrum disorder is the most common primary need among pupils with an education, health and care plan, so these rules matter most for pupils with autism or learning difficulties. The sections below cover the definitions, the deadlines and the steps families can take on the day itself.
The guidance in force since 1 April 2026 splits four easily confused terms. A restrictive intervention is any physical or non-physical action that prevents, restricts or subdues movement of a pupil's body, while restraint is a non-disciplinary measure that immobilises a pupil or limits movement, with or without touch. Seclusion means keeping one pupil apart from others and stopping them leaving, whether by blocking the way or by making them fear punishment, and reasonable force means using no more force than necessary for the least time needed.
Three practices are banned however strong the reason looks. Force applied to punish, threaten or deter is illegal, and seclusion is not a disciplinary tool: it may only be used as a safety measure when a pupil is so dysregulated that others could be harmed, with supervision throughout and release once the immediate risk drops. The guidance also names dangerous methods, including pressure on the neck, chest or abdomen, covering the mouth or nose, and holding a pupil face down on the ground.
Two legal sources sit behind the paperwork, namely section 93A of the Education and Inspections Act 2006 and the Schools (Recording and Reporting of Seclusion and Restraint) (No. 2) (England) Regulations 2025. Every school must record each significant use of force and each incident of seclusion or non-force restraint in writing as soon as practicable, ideally the same day, and the duty still applies when a form of restraint was agreed with parents in a behaviour support plan. Records must cover names, the pupil's special educational needs status code, the time, place and duration, the triggers, the de-escalation steps tried first, the degree of force and any injuries.
The duty to inform parents is written separately from the right to see the record. Maintained schools must hand a copy of the written seclusion or restraint record to each parent, while independent and non-maintained special schools must provide the information in writing, and parents should be told as soon as practicable, ideally the same day. Only two exceptions exist, namely a pupil aged 20 or over, or a disclosure likely to cause serious harm to the pupil, in which case the incident goes to another parent who can be told safely or to the local authority.
The Department for Education guidance devotes a whole section to pupils with special educational needs, and the reasoning is straightforward. Some children react to painful or confusing situations with behaviour that can hurt themselves or others, and the triggers include pain, sensory overload, unfamiliar places, fear and anxiety, while pupils who find speech difficult often express needs through actions instead of words. The guidance accepts that this difference produces a measurable result, because pupils with special educational needs are disproportionately subject to restrictive interventions, and official statistics show 538,547 pupils in England holding an education, health and care plan in the 2026 release, with autistic spectrum disorder the primary need for 33.5 per cent of them.
The guidance puts prevention and de-escalation at the centre rather than the tidy handling of incidents afterwards. Schools are told to lean on staff who know the pupil well, identify the moments and settings where behaviour is more likely to escalate, and prepare in advance, with familiar triggers including pain, a supply teacher, an unexpected timetable change, noise in corridors and assemblies. Practical moves include removing the light or sound causing distress, changing body language and tone of voice, helping the pupil name feelings before they overload, and using familiar objects to redirect attention.
The guidance is specific about behaviour support plans, and co-production is the key word. Plans should be developed with the pupil and their parents at the right moment, not written by the school and sent home for a signature, and they should spell out the adjustments needed, the parts of the school environment that distress the pupil, and the ways that pupil communicates needs best. Any statement about increased physical contact needs discussion with teachers, parents, the pupil and health professionals, with clear limits, and the plan must be reviewed periodically and after any significant incident.
One firm requirement hides inside the guidance, and parents often miss it. Where it is already clear that a pupil is more likely to need reasonable force or another restrictive intervention, the school must have a risk assessment in place and should reduce the risk through training and prevention, which also reflects employers' duties under the Health and Safety at Work etc. Act 1974. Staff facing these situations should be trained in both safe and lawful use and in preventative strategies, so parents can ask which staff are trained, which provider delivered the course, how often it is refreshed, and whether supply teachers know the plan.
The Equality Act 2010 appears in the guidance as a required foundation for school policy, and it is the most practical lever for families. Disabled pupils are protected, and schools must take reasonable steps to avoid disadvantage so that a pupil can take a full part in the education on offer, which means thinking about how a rule lands on a child with sensory sensitivities. Day to day, a reasonable adjustment can be a sensory break mid-lesson, a quiet space the pupil can choose, a visual timetable or advance warning of a change, while examination arrangements such as extra time beyond 25 per cent must be applied for in advance.
Many pupils assume that only a hold or a grab counts as restraint, yet the new rules also cover blocking a doorway, sealing a space and taking away a walking aid. The common mistake is to complain by phone only, without putting the request in writing, so ask for a copy of the written record the same day and note the time and the way the notification arrived. Ask whether a behaviour support plan existed and whether its de-escalation steps were followed, let the child tell the story at their own pace and write their words down, and check for marks or delayed symptoms such as headache or arm pain.
The guidance keeps the dispute route short, because complaints about restrictive interventions are handled through the school's normal complaints procedure. The first step is to obtain that policy and read the deadlines and the addressee, which usually means writing to the head teacher or the special educational needs co-ordinator before escalating to the governing body or academy trust. Where pupil safety is involved, concerns can go to Ofsted, which inspects rather than adjudicates individual cases, while a complaint about the conduct of a member of staff is governed by the Keeping Children Safe in Education guidance on the gov.uk pages.
Restraint is often a symptom of a wider gap, so the special educational needs route runs alongside it. Schools in England provide two levels of support under the SEND Code of Practice, namely support funded by the school and an education, health and care plan issued by the local authority, and every mainstream school must appoint a special educational needs co-ordinator whom parents can ask to meet. The statutory cycle is assess, plan, do, review, and where existing support is not enough parents can ask the local authority for an EHC needs assessment, with a decision due within six weeks and a final plan within twenty weeks.
One further route is worth knowing because it carries a deadline. The Equality Act 2010 defines disability as a physical or mental impairment with a substantial and long-term adverse effect on normal day-to-day activity, which covers autism and most learning difficulties, and schools must not discriminate because of disability in admissions, in the provision of education and access to services, or in exclusions. Where parents believe reasonable adjustments were not made, a claim can be brought to the First-tier Tribunal, Health, Education and Social Care Chamber, sitting as the Special Educational Needs and Disability Tribunal, against the responsible body, and the SEND4 guide on gov.uk states that a claim must reach the tribunal within six months.
