英格兰在2026年2月23日同时发布了两份文件,一份是学校白皮书《Every child achieving and thriving》,另一份是针对特殊教育需求与残障系统的改革咨询文件《SEND reform: putting children and young people first》。
On 23 February 2026 the Department for Education published the schools white paper Every child achieving and thriving alongside a consultation on special educational needs and disabilities; the white paper sets out a long term direction while the consultation asks for views on specific proposals, and both went live on the same day; the practical point for families is that neither document changes a child's support overnight, because a white paper is a statement of intent and a consultation is a request for evidence.
The white paper frames three lines of change, describing the shift as moving children's school experience from narrow to broad; the first line covers curriculum and activities so that school life serves more than exams, the second covers children who have been sidelined, including those with special educational needs and disabilities, and the third covers families and communities re-engaging with schools; a separate delivery plan for six thousand five hundred additional teachers sits alongside it, and the department describes the whole programme as a ten year reform delivered in stages.
The main consultation covers the whole zero to twenty five system, and the department invited responses from children and young people, families, teachers and school leaders, schools and trusts; early years providers, post sixteen providers, local authorities and representative groups were also asked; the question list runs to question thirty nine, which leaves a free text box for anything the fixed questions miss, and ministers hosted online events and webinars so that views came from families as well as from institutions.
The main consultation opened on 23 February 2026 and closed on 18 May 2026, a window of nearly twelve weeks; the department has since said it received thousands of responses and held more than two hundred engagement events, yet no formal response has been published and no date has been given; a Commons Library briefing updated on 1 September 2026 records that the government has not yet responded, while the later consultation on education outside school says its own response will appear on gov.uk in autumn 2026.
Alongside the white paper the department published shorter and simpler documents aimed at parents, schools, colleges and local authorities; British Sign Language versions of both the white paper and the consultation are available, and the main consultation also has an easy read version written in short sentences for readers who find long documents difficult; families who need braille or a twenty point large print copy can request one by email, and the two later consultations each carry their own page explaining what parents and carers need to know.
Two follow up consultations opened on 10 July 2026, after the main window had closed; one covers education otherwise than at school, the arrangements for children whose plan says they should be educated outside a school or college, and the other looks at how mainstream schools can receive support funding earlier; both closed on 18 September 2026, and the department says the responses to all three consultations will be considered together rather than one at a time.
Education otherwise than at school, usually shortened to EOTAS, applies to children whose education, health and care plan says they should be taught outside a school or college; the consultation is built in four parts covering who decides how EOTAS is arranged, how children already in EOTAS are supported, how children who cannot attend for health reasons stay in education, and how schools and local authorities use accredited online providers; one proposal would connect every child in EOTAS to a named school or college that manages the arrangements with the family and other services.
Mainstream schools currently meet the first six thousand pounds of additional support costs for each pupil with special educational needs, and the local authority high needs budget covers the rest; this consultation asks whether local authorities should be able to raise that threshold so more money reaches schools before a child crosses it, with a separate local SEND inclusion factor so the money can be traced; authorities must consult their schools forum and provide evidence of its views, and the department says this first phase is a test that builds evidence rather than a settled policy.
The statutory code of practice for special educational needs and disabilities, published in 2015, still governs how schools and local authorities must act; the twenty week deadline for an education, health and care plan, the requirement to appoint a special educational needs coordinator, and the assess, plan, do, review cycle all remain in place, as do local offers and the SEN information report each school publishes; the first year guidance from the department and NHS England says new legislation is expected from September 2029 and that existing support stays as it is until then.
The consultation does not pause local duties, so authorities carry on with the work already required of them; the high needs funding operational guide for the 2026 to 2027 year asks local authorities to review their arrangements and recalculate where funding per pupil with SEN support falls below one thousand eight hundred pounds; local offers and school SEN information reports must still be published and kept current, which is where families can check what is actually available locally.
The Education for All Bill was announced in the King's Speech in May 2026, and the SEND reforms are intended to be delivered through that legislation; no date has been confirmed for its introduction to Parliament, and the Commons Library briefing treats the timing as open, while the consultation on education outside school says its changes are expected to take effect from the 2029 to 2030 academic year; a white paper cannot change the law by itself, so the rights families hold today come from the current statutes and the code of practice built on them.
The online questionnaire for the main consultation has closed, but other routes to influence the system are still open; parent carer forums are statutory partners that local authorities must work with on SEND matters, and local offer pages usually explain how to give feedback and take part in reviews and co-design; writing down what actually happened, with dates, settings and outcomes, tends to carry more weight than a statement of general concern.
The Commons Education Committee published its report Solving the SEND Crisis in September 2025 after receiving more than eight hundred written submissions; on 30 April 2026 the committee wrote to the schools minister about the consultation, raising teacher and staff training, accountability, national inclusion standards, experts working close to schools, and mental health and wellbeing; the government response to those recommendations was published by the committee on 17 June 2026, so parents can read both documents to see which issues keep coming back.
An education, health and care plan does not lapse because a consultation is running, and the rights attached to it stay in force; appeals to the tribunal, mediation, school complaints procedures and local authority complaint routes all remain available, and the rule that a plan transfers on the day a family moves still applies; if support is reduced while the reforms are being discussed, families can ask which duty or decision the change rests on before choosing a route to challenge it.
