Support for speech, language and communication needs does not stop at 16. Colleges in England must identify needs, put provision in place and review it, and an existing EHC plan can stay open until the young person turns 25. Knowing which duty covers which problem is what separates support that is ready in September from support that turns up half way through the second term.
What SLCN covers
Speech, language and communication needs sit inside the first of the four broad areas of need in the SEND code of practice, under communication and interaction, and the code covers them in paragraphs 6.28 to 6.35. The range is wide: a student may understand less than they appear to, struggle to build a sentence under time pressure, or miss the unwritten rules of group discussion.
Duties that carry on after 16
Best endeavours is a working duty rather than a slogan: section 66 of the Children and Families Act 2014 applies to general further education colleges, sixth form colleges and 16 to 19 academies, and it does not depend on whether an EHC plan exists. Under the Equality Act 2010 a college owes reasonable adjustments to disabled students, so moving a class, allowing processing time or changing how work is recorded can all be required.
没有 EHC 计划能拿到的学院支持 / SEN support without an EHC plan
Chapter 7 of the code of practice deals with further education, and it expects a four step cycle: assess, plan, do and review. Section 7.14 asks colleges to involve the student at every stage and, for students aged 16 to 18, to involve parents as well. None of this depends on an EHC plan: the college can arrange small group language work, note taking support or a quiet space itself. Verbal promises are where this layer fails, so hold start dates, names and review dates in writing.
有 EHC 计划的学生 / Where an EHC plan is in place
An EHC plan can remain in force until the day before the young person turns 25, provided they stay in education or training and the outcomes have not all been met. If a college is named in Section I of the plan it must admit the student, a duty set out in section 43 of the Children and Families Act 2014. Reviews after 16 should test whether the study programme matches what the plan promises, because provision described in detail at school often becomes vague at college, and vagueness is what makes delivery hard to check.
The annual review timetable
The annual review must be completed within 12 months of the date the plan was issued or the previous review finished, a cycle set out in regulations 18 to 21 of the Special Educational Needs and Disability Regulations 2014. The college arranges the meeting, circulates written advice at least two weeks beforehand and sends the report to the local authority and everyone invited within two weeks of the meeting; the authority then decides within four weeks whether to keep, amend or cease the plan, and any amended plan must be issued within eight weeks of that decision letter. Young people have 15 calendar days to comment on proposed changes, and where a change of college is expected the final plan naming the new institution has to be issued by 31 March.
The student holds the rights from 16
Once a young person reaches the end of the school year in which they turn 16, local authorities and other agencies are expected to deal with the young person rather than the parent. The right of appeal moves with it, so a dispute about the content of a plan or a decision to cease it is the student's to bring, and where parent and student disagree the student's view carries more weight. Colleges should therefore address review invitations and decision letters to the student, and a useful rehearsal is helping the student explain their own needs before the meeting.
Getting speech and language therapy into the plan
Speech and language therapy is health care provision, so it belongs in the health and provision sections of an EHC plan rather than in a general appendix. Section 42 of the Children and Families Act 2014 requires the local authority to secure the special educational provision specified in the plan, and where health care provision is specified the responsible commissioning body must arrange it; that body is usually the local Integrated Care Board, not the college, which is why chasing the right organisation matters.
What the published figures show
The DfE statistics on special educational needs in England, published on the gov.uk statistics service in June 2026, show that speech, language and communication needs is the most common primary need among pupils at SEN support at 25.7 per cent, followed by social, emotional and mental health needs at 24.8 per cent. Among pupils with an EHC plan the most common primary need is autistic spectrum disorder at 33.5 per cent, with speech, language and communication needs at 22.1 per cent. A separate release on 25 June 2026 found that only 46.1 per cent of new plans issued in 2025 were completed within 20 weeks.
Access arrangements and the evidence
JCQ regulates access arrangements for candidates with disabilities and learning difficulties, and it lists speech, language and communication needs as one of the need types that may require an adjustment, alongside 25 per cent extra time, supervised rest breaks, a reader or a word processor. Applications for 25 per cent extra time processed from 1 September 2025 must be supported not only by the relevant form but also by samples of internal tests and mock papers showing the arrangement in use, plus subject staff comments on why it is needed and how it is used. Where the basis is a learning difficulty, an assessment by a suitably qualified assessor, carried out no earlier than the start of year 9, can roll forward to AS, A level and other level 3 qualifications if the current criteria are still met.
Where the funding comes from
Funding for a 16 to 19 study programme comes in layers. The DfE operational guide for high needs funding in 2026 to 2027, published on gov.uk, treats a student as high needs when the additional cost of their special educational provision exceeds 6,000 pounds a year, with students aged 16 to 18 judged on that threshold while students aged 19 to 25 need an EHC plan to qualify. High needs place funding is set at 6,000 pounds per place for colleges and school sixth forms, and 10,000 pounds per place for special schools and alternative provision.
Moving to adult services
Section 58 of the Care Act 2014 requires a local authority to carry out a transition assessment where it appears that a young person is likely to have needs for care and support after turning 18, provided the assessment would be of significant benefit and the consent condition is met. The practical value is continuity, because speech and language therapy, social support and accommodation support often change hands around the eighteenth birthday, and where a plan specifies health care provision it should not lapse while adult services are still deciding.
The 2026 reform direction
教育部在 2026 年 2 月 23 日向议会提交了白皮书《Every child achieving and thriving》,配套的 SEND 改革咨询同期启动,政府在 2026 年 5 月说明意向是通过新的《Education for All Bill》立法。
The DfE laid the white paper Every child achieving and thriving before Parliament on 23 February 2026, alongside a consultation on SEND reform, and in May 2026 the government confirmed its intention to legislate through an Education for All Bill. The proposed structure adds three tiers above a universal offer: targeted support such as small group speech and language work, targeted plus support involving therapists and educational psychologists, and specialist provision for the most complex needs. An Individual Support Plan would record the support a student receives, and the white paper sets out a ten year programme with around 4 billion pounds of investment plus a triple lock intended to stop students losing effective support during the transition.
