School admission appeals in England run under a statutory code, so a parent's route to challenge a refusal does not depend on what an individual school chooses to offer. The 2022 revision put two questions out to public consultation between 7 February and 3 April, and officials received 488 written responses before publishing the government response in June 2022. One proposal survived and one was dropped, and the rules that remain carry fixed deadlines that schools and appeal panels are expected to meet.

The code is issued under section 84 of the School Standards and Framework Act 1998. Any revision has to follow the consultation duty in section 85(2) and then sit before Parliament for forty days. The revised code was laid on 16 June 2022, and an appointed day order fixed 1 October 2022 as the date it took effect, applying to appeals lodged on or after that day; academies are bound through their funding agreements rather than through local authority control.

The consultation was deliberately narrow, covering two changes plus a set of technical drafting updates to bring references into line with the 2021 School Admissions Code. The first question was whether hearings could be held remotely, by video conference and in limited cases by telephone; the second was whether a panel could finish an appeal with two members when the third had to withdraw. Responses were invited from every English local authority, national representative bodies, schools, multi-academy trusts, appeal panel members and parents.

The government published the breakdown of who replied, which says more about the debate than the headline figures do. Of the 488 written responses, 94 came from local authorities, 135 from schools and academy trusts, 72 from individuals, 169 from appeal panel members and 18 from appeals service providers and national bodies. The same document records that 41,110 appeals were heard in the 2020 to 2021 academic year with 7,823 succeeding, so the temporary arrangements were treated as a live question rather than a footnote.

Remote hearings attracted the strongest support of anything in the consultation, with 93% of respondents agreeing they should be an option. Views on format were far less uniform; 98% thought face to face hearings could be fair and transparent, 91% said the same about video conference, and only 60% extended that judgement to appeals held by telephone. Most respondents also accepted that the admission authority should choose the format, and the code that followed makes video conference the default while requiring panels to hear oral representations whatever the forum.

Opposition to telephone hearings centred on three things: the loss of visual cues, difficulty protecting privacy and confidentiality, and the disadvantage for appellants who need a sign language interpreter. The government accepted those concerns and refused to place telephone on the same footing as video. The current code therefore allows a hearing to be held entirely by telephone only where video conferencing cannot be used because of connectivity or accessibility and where both the appellant and the presenting officer agree.

The second proposal also had majority support, with 82% agreeing that two members could finish an appeal, but the government dropped it anyway. Opponents warned that a panel of two may look unfair to parents, that the chair's casting vote could effectively hand the outcome to one person, and that panels would lose the required mix of lay and education experience. Ministers judged that withdrawing members are rare and that the flexibility was barely used even during the pandemic, so the current code requires remaining hearings to be postponed and all appeals to be reheard if the missing member cannot return.

Panel composition is not left to chance: the code requires a chair plus at least two other members, drawn from both lay people and people with education experience or knowledge of local schools. Clerks must be independent of the school and of the local authority's education functions, and they must know the admissions codes and the relevant law. The regulations disqualify local authority members, current or former governors of the school in question, most people employed by the authority or governing body, and anyone whose connection with the case could raise doubts about impartiality; untrained members are also barred.

The appeals timetable has to contain four hard deadlines rather than general intentions. A parent gets at least 20 school days from the refusal notice to prepare and lodge a written appeal, and at least 10 school days' notice of the hearing itself, including the cut off for extra evidence. Clerks and admission authorities also work to fixed dates for exchanging papers, and decision letters should reach the parties within five school days, with the whole timetable published on the school website by 28 February each year.

Once an appeal is lodged, the code ties hearing dates to school days rather than to convenience. Appeals in the normal admissions round must be heard within 40 school days of the lodging deadline, late applications within 40 school days of that deadline where possible, and in-year applications within 30 school days of being lodged. Sixth form appeals where a place depended on exam results must be heard within 30 school days of the results being confirmed, and appeals submitted after the deadline must still be heard under the school's published timetable.

A refusal letter is not simply bad news; it has to state the reason for refusal, the right of appeal, the deadline and the contact details, and it must tell parents that grounds have to be put in writing. Importantly, admission authorities may not limit the grounds on which an appeal can be made, which means they cannot accept some kinds of argument and screen out others. Where a sixth form place is refused, the child and the parent each hold a right of appeal and any separate appeals must be heard together.

Every appeal outside infant class size follows the same two stage test. The panel first asks whether the admission arrangements complied with admissions law and were applied correctly and impartially, and whether admitting another child would prejudice efficient education or the efficient use of resources. If there is no prejudice, or if a lawful and properly applied arrangement would have offered the child a place, the appeal succeeds at that point; otherwise the panel weighs the prejudice to the school against the parent's case, which is why a school has to show something beyond the fact that its published admission number is full.

Infant class size appeals work differently, and the grounds are deliberately narrow. A panel can only uphold at the first stage if admitting the child would not breach the 30 pupil limit, if the arrangements breached admissions law and the child would otherwise have been offered a place, or if refusal was not a decision a reasonable admission authority would have made. That last test is a high bar, described in the case law as a decision beyond the range of responses open to a reasonable decision maker.

Losing an appeal does not create an automatic second appeal, and a fresh hearing only becomes possible if circumstances have changed materially and the authority has accepted a second application and refused again. Complaints about how a hearing was handled go to the Local Government and Social Care Ombudsman for maintained schools and to the Secretary of State for academies; the department's March 2026 review of academy appeals complaints looked at 284 complaints received between April and November 2025, upheld 45, and asked for fresh appeals in 19 of them. The review flags late or missing notices, inaccurate decision letters and clerk records that fail to show how prejudice and the parent's reasons were weighed, and complaints must normally be brought within six months.
