Child safeguarding in England is not the job of one school or one agency. The Children and Social Work Act 2017 made the local authority, the integrated care board and the chief officer of police the three statutory safeguarding partners who must publish joint multi-agency arrangements. Independent scrutiny is how the law checks that those arrangements actually work, and the clauses below all come from Working Together to Safeguard Children 2026, published by the Department for Education on 18 March 2026.
Only three bodies count as statutory safeguarding partners in England: the local authority, the integrated care board and the chief officer of police. Section 16E of the Children Act 2004, inserted by section 16 of the Children and Social Work Act 2017 and commenced on 29 June 2018, created that trio and abolished the old local safeguarding children boards, moving accountability onto named chief officers. Schools, colleges and nurseries belong to the wider group of relevant agencies, which must cooperate with the arrangements while the legal duty to make them work stays with the three partners.
Independent scrutiny is a legal duty rather than a voluntary extra. Section 16G of the Children Act 2004 requires the safeguarding partners to publish their local multi-agency arrangements and to ensure that the effectiveness of those arrangements is scrutinised by an independent person, with a report published at least once every twelve months. Working Together to Safeguard Children 2026 states in paragraph 95 that partners must ensure effective independent scrutiny is in place for their local area, so a missing scrutiny mechanism is itself a failure of compliance.
The guidance sets out seven functions for the scrutiny role. A scrutineer has to offer independent and rigorous support and challenge at both strategic and operational level, give the wider system assurance that the multi-agency arrangements are effective, and confirm that statutory duties are met and that learning from local child safeguarding practice reviews and national reviews is genuinely implemented. The role also has to carry the voice of children and families into the process, act as a critical friend who enables two-way discussion between frontline practitioners and leaders, and provide independent advice when agencies disagree so that escalation routes work.
How scrutiny is delivered is a local decision, although the guidance sets the boundaries. Paragraph 99 says the lead safeguarding partners must be satisfied that whatever model they choose produces objective and rigorous analysis, while paragraph 102 allows an individual scrutineer, an externally commissioned group, or a structure that sits either inside or apart from the partnership. Interviews, focus groups, data analysis, observation and peer review are all acceptable methods, and the experience of children and families has to form part of the evidence.
Independence is what makes scrutiny credible, and the guidance builds a structural wall around it. Paragraph 67 requires partnerships to separate the role of partnership chair from independent scrutiny and to keep three functions distinct: the chair convenes and decides, a business management function supplies resource and administration, and the scrutiny function challenges the partners. Because the chair is drawn from the delegated representatives of one of the three statutory partners, that person cannot double as the scrutineer, who must instead demonstrate real expertise in the area being scrutinised.
The arrangements are a public document with a minimum content fixed by the guidance. Paragraph 109 requires them to explain how the partners will identify and respond to children's needs, including which groups of children are over- or under-represented in services, how local child safeguarding practice reviews are commissioned and published, how independent scrutiny will run, and who the three partners, their delegates and the partnership chair are. Paragraph 110 adds how every school, college and early years setting is included at both operational and strategic level, how data is shared safely, how the work is funded, and how disputes and whistleblowing are handled.
The yearly report is where scrutiny turns into accountability. Paragraph 112 requires the partners to report jointly on twelve months of activity and on how effective the arrangements proved in practice, in a form that stays concise and accessible to families and practitioners. Paragraph 113 lists what must appear: each partner's contribution, themes emerging from scrutiny and inspections, evidence of impact on outcomes for children, priorities where little progress was made, learning from serious incidents, key decisions, how feedback from children and families was used, funding and value for money, and a review of the impact of independent scrutiny itself. Reports must be published by the end of September each year and reach the Panel and the Department for Education within seven days of publication.
Serious incident reporting is the second gate sitting alongside independent scrutiny. The local authority must notify the Child Safeguarding Practice Review Panel of qualifying incidents, and the Panel's annual report for 2024 to 2025, published on 29 April 2026, records 274 rapid reviews covering more than 360 children, with babies under one accounting for 34% of reviews and 60% of deaths. The 2026 guidance tightens the rapid review deadline to 15 working days from the notification, requires notification even before a child victim is named, extends death notifications for care leavers to age 24, and reads a 21% fall in notifications as likely under-reporting rather than reduced harm.
Independent scrutiny does not replace inspection, because the two interlock. Paragraph 94 records that each statutory partner faces its own regulator, so local authority children's services are inspected by Ofsted, police forces by HMICFRS and health by the CQC. Ofsted's framework for inspecting local authority children's services, first published in November 2017 and updated on 20 March 2026, schedules standard and short inspections roughly every three years plus or minus six months against an annual self-evaluation. Paragraph 98 places scrutiny inside that wider accountability system alongside those inspections and joint targeted area inspections, which four inspectorates run jointly under section 20 of the Children Act 2004 and where the set-up meeting includes the chair of the arrangements and the person responsible for independent scrutiny.
Schools are participants in the arrangements rather than bystanders. Paragraph 4 of the 2026 guidance states that it applies in its entirety to all early education and childcare settings, schools, colleges and other education providers, while the published arrangements must explain how every school, including independent schools, academies, free schools and alternative provision, is included at both operational and strategic level. Inside a school, Keeping Children Safe in Education, the Department for Education guidance issued in September 2025, requires a designated safeguarding lead drawn from the leadership team, with lead responsibility for safeguarding and child protection including online safety and filtering, and refresher training at least every two years.
None of this is closed material, because families can read it. Both the published arrangements and the yearly report must be signed off by all the lead partners, cross-referenced and easily accessible, with the report out by the end of September, and the arrangements must spell out how concerns are escalated and how whistleblowing and disputes are handled. In practice a concern starts with the school's designated safeguarding lead and can move to local authority children's social care, while inspection findings appear separately in Ofsted reports and as open letters after a joint targeted area inspection, so a parent can compare what the yearly report claims with what the school and the council actually do.
The framework is still moving, and the direction of travel is towards national oversight of a system that has been locally owned. Working Together to Safeguard Children 2026, published on 18 March 2026, replaced the December 2023 edition and rewrote the chapter on learning from serious incidents. The Children's Wellbeing and Schools Act 2026 brings multi-agency child protection teams, a stronger information-sharing duty and a single unique identifier, while the consultation on a Child Protection Authority ran from 11 December 2025 to 5 March 2026 with 379 responses and the government's response on 7 July 2026 accepted that the new body needs a statutory footing; until then the Panel keeps reviewing serious incidents, with 2027 set aside for building the Authority's capability.
