Some students in England need additional learning support, and the system gives that support a formal name, special educational needs and disabilities, usually shortened to SEND. Post-16 institutions are not a simple continuation of compulsory schooling, because they carry their own legal duties to identify needs, arrange support and adjust how students are assessed. This article sets out the rules that matter in practice: who is accountable, what training staff should have, where the funding comes from and who to approach when something goes wrong.
England's post-16 landscape has several institution types, because a student may join a further education college, stay in a school sixth form, or move to a 16 to 19 academy. The SEND code of practice 0 to 25, in force since January 2015, names further education colleges, sixth form colleges, 16 to 19 academies and independent specialist colleges approved under section 41 of the Children and Families Act 2014. Those providers must have regard to the code, co-operate with the local authority, admit a young person named in an EHC plan, and use best endeavours to secure the special educational provision a student needs; the best endeavours duty does not depend on having an EHC plan, and it runs up to age 25.
The code expects every college to have a named person with oversight of SEN provision, so that assessment, teaching and specialist support join up in one place; this is close to the SEN co-ordinator role in schools. That person normally logs what applicants declare about a learning difficulty, disability or medical condition, links curriculum staff with specialists, and checks that the support happens. Colleges should also join transition planning before enrolment, keep a student profile and support record, and use those records when discussing progress and next steps.
The code places the training duty on the college's governing body, which must make sure that all staff interact inclusively with students who have SEN or a disability and that the workforce holds appropriate expertise. Curriculum staff must be able to develop their skills, learn about effective practice and keep their knowledge current, so staff development is a continuing arrangement, not a one-off session for specialists. Colleges should also be able to draw on external expertise such as educational psychologists, child and adolescent mental health services, specialist teachers, supported employment services and therapists; where purposeful action has been taken and progress is still below expectation, the college or the student can ask the local authority for an EHC needs assessment.
Support should be evidence based, which means colleges need to know what works in the sector and then personalise it for the individual student. The code describes a cycle of assessing need, planning provision, delivering support, and reviewing and evaluating it so that it can be adjusted; the student should be involved at every stage, and for those aged 16 to 18 parents should be involved closely too. Records should set out the student's SEN, the interventions used, the specialists involved and the progress made towards agreed outcomes, because the frequent weakness is support that sits with several people and answers to nobody.
Schools should pass information about previous SEN provision to the post-16 provider before the young person takes up a place, preferably in the spring term before the new course starts, so that a suitable study programme and the right support can be prepared in advance. Colleges and schools should work in partnership on taster courses, link programmes and mentoring that help students with SEN learn the pace of college study. For a young person with an EHC plan, post-16 options are part of the preparing for adulthood focus of the annual review from year 9 onwards, and a receiving school or college must help shape the plan and define its outcomes.
Alongside the code sits an older legal duty under the Equality Act 2010, which forbids colleges from discriminating against, harassing or victimising disabled students and requires reasonable adjustments to prevent substantial disadvantage. That duty is anticipatory, so a college has to think in advance about the barriers a disabled student might meet and what adjustments would remove them, rather than waiting for the student to ask. Adjustments can cover step-free access, the format of handouts, the way a student is assessed, equipment and assistive technology; colleges should also keep their adjustments under review, because course demands and circumstances change over time.
Exam arrangements matter most to post-16 students, because any adjustment for GCSE or A-Level has to be approved by the awarding body. JCQ, the joint council for the awarding bodies, publishes the current year's access arrangements file on its website, and centres must apply as it requires and keep the evidence on record. The key test is the candidate's normal way of working; extra time, a separate room or a word processor must already be the student's usual way of completing classwork, and a 2026 change asks centres to consider supervised rest breaks before applying for extra time. A late request is the common mistake, so post-16 students should raise the matter with the college's learning support lead well before the exams.
After compulsory school age, which ends in the academic year in which a young person turns 16, the right to request and decide passes from parents to the young person. A student can ask the local authority for an EHC needs assessment at any point before their 25th birthday, as long as no assessment has been carried out in the previous six months, and a college can also make the request with the student's knowledge and agreement. During assessment the local authority must gather advice from relevant professionals, and the college must supply the educational advice requested; once a college is named in the plan it must admit the young person, and colleges have to be named by the end of March before a September start.
Money shapes what a college can deliver, and high needs funding for post-16 students comes in three elements. Elements 1 and 2 are the core funding a provider receives per student, described in the Department for Education guidance as up to 6000 pounds, while element 3 is the top-up for support costing more, paid by the local authority where the student lives and agreed each year. Students aged 19 to 24 who have an EHC plan and need more than 6000 pounds of additional support sit inside the same arrangements; for the 2026 to 2027 financial year the department suspended the high needs national funding formula, so local authority allocations are based on the previous year with adjustments, and colleges are expected to account for how the funding was used.
Employment is the centre of gravity in post-16 planning, and the code states that the vast majority of young people with SEN can reach sustainable paid work with the right preparation and support. A supported internship is the fullest version of that route for young people aged 16 to 24 who have an EHC plan, built around a substantial work placement supported by an expert job coach. The guidance treats it as a full-time study programme requiring at least 580 planned learning hours, normally lasting up to a year with an unpaid placement of at least six months; Access to Work can cover workplace support, element 3 can fund support costs above 6000 pounds, and students over 19 with an EHC plan can apply for the discretionary 16 to 19 bursary.
The code requires the local authority to make sure that the EHC plan review in year 9, and every review after it, includes a focus on preparing for adulthood, and reviews keep that focus when the young person is at college. Preparing for adulthood is not a slogan; it has to feed the plan's outcomes in employment, independent living, health and community participation. A college's duty does not stop at 18, because it must keep using best endeavours to secure the special educational provision needed by students aged 19 to 25 with SEN, and provide independent careers advice for all students up to 18 and for those aged 19 to 25 with an EHC plan. The final annual review before a plan ends should agree the steps into adult services, and the college should take part in it.
Inspection is where outside pressure meets everyday practice, and it is also how a family can judge whether a college is serious. Since 10 November 2025 Ofsted has used a report card framework for further education and skills providers, dropping the single overall grade in favour of separate evaluation areas, with inclusion listed as its own area on a five-point scale from exceptional to urgent improvement. Inspectors triangulate what they see on site against provider data supplied by the Department for Education rather than a leadership narrative. Case sampling focuses on disadvantaged learners, learners with SEND or high needs, learners known to social care, and learners without level 2 English or maths, and a learning walk with an inclusion focus normally includes the leader responsible for inclusion or SEND.
Families can start from the local authority's Local Offer, which must include post-16 education and training, apprenticeships and supported internships, services that help prepare for adulthood, and travel to and from post-16 institutions. Three questions are worth asking before choosing a college: who is the named person with oversight of SEN, how does the college identify and review needs, and who manages exam access arrangements. Where practice falls short of the code, the college complaints procedure comes first; a decision about an EHC plan can be appealed to the First-tier Tribunal. For a post-16 student the statutory rights belong to the young person rather than the parents, which is the easiest part of the 2014 reforms to overlook.
